FINANCIAL IMPACT: No financial impact. The City intends to vacate a small portion of right-of-way in front of the Connelly Station apartment complex that was acquired in anticipation of the extension of St. Patrick Way. During final design of the St. Patrick Way extension, it was determined that this right-of-way was not needed. Therefore, the eight square foot property will be dedicated to Essex Properties Trust, the owners of the apartment complex. A plat and legal description of the property is included as Exhibit A to Attachment 2 to this Staff Report. ANALYSIS: The General Plan designation is Downtown Dublin Specific Plan - Transit Oriented District. The vacation of the eight square foot subject property conforms with the Land Use and Circulation Element (Chapter 5) of the General Plan in that the existing use of the property is for landscaping in front of the Connelly Station apartment complex, which is compliant with the General Plan land use designation for the site. Staff is thus requesting this determination of conformity from the Planning Commission. 2 of 3 ENVIRONMENTAL REVIEW: This conformity determination is a report by the Planning Commission, not a project recommendation or approval, and is thus not a project as defined in CEQA Guidelines section 15378. NOTICING REQUIREMENTS/PUBLIC OUTREACH: Findings of General Plan Conformance are not subject to a public hearing; therefore, a public notice is not required. ATTACHMENTS: 1. ATTACHMENT 1 N 69'O8'15"E 1 .I~ 2 6.00' 1 FGEND RESOLUTION NO. 16-xx A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN FINDING THE PROPOSED VACATION BY THE CITY AND THE DEDICATION TO THE ADJACENT PROPERTY OWNER OF EIGHT SQUARE FEET OF ST.PATRICK WAY RIGHT OF WAY TO BE IN CONFORMANCE WITH THE DUBLIN GENERAL PLAN WHEREAS,the City proposes to vacate a small portion of right of way along the alignment of St. Patrick Way that was acquired for the extension of the roadway;and WHEREAS,the once the final design of the roadway was complete, it was determined that the property was not needed for right of way purposes;and WHEREAS,the vacation and dedication of the property will be in compliance with the existing General Plan land use designation of Downtown Dublin Specific Plan -Transit Oriented District and no land use changes are proposed;and WHEREAS, in accordance with Government Code §65402, the Planning Commission must report conformance with an adopted General Plan for any street vacation, abandonment, or the acquisition of real property for any public purpose;and WHEREAS,a Staff Report was submitted recommending that the Planning Commission adopt a resolution finding the proposed vacation by the City and the dedication to the adjacent property owner of eight square feet of St. Patrick Way right of way to be in conformance with the Dublin General Plan. NOW, THEREFORE, BE IT RESOLVED that the City of Dublin Planning Commission finds that the proposed vacation by the City and the dedication to the adjacent property owner of eight square feet of St. Patrick Way right of way to be in conformance with the Dublin General Plan pursuant to Government Code§65402.
