SUBJECT: Acceptance of Improvements
Tract 5511 Villages at Willow Creek
(Rafanelli and Nahas Subdivision Agreement)

RECOMMENDATION: 1) Adopt Resolution to accept the work completed.
2) Authorize Staff to accept maintenance bond at a
future date.
FINANCIAL STATEMENT: A maintenance bond in the amount of $848,476.00 to
guarantee against defects will be provided to the
City. Sweeping and other street maintenance costs
will be incurred by the City.
DESCRIPTION:
The Final Map for Tract 5511 was approved by the City Council on
September 8, 1986. This is the "Master Tract" for the Villages at Willow
Creek (formerly Villages at Alamo Creek) . This Tract subdivided 135 acres
into seven Villages, a park, a creek area, and some open space lots. The park
and open space lots have been deeded to the City; the creek is proposed to be
deeded to Zone 7. The only single-family detached lots are in Village VI
(Ridgecreek) , which is being sold and developed by Ahmanson Developments; the
rest of the Villages are townhouse or condominium developments.
Improvements in this portion of Tract 5511 include Dougherty Road north
of Amador Valley Blvd. , grading for the entire site, work on the creek for the
entire site, and construction of Wildwood Road and Willow Creek Drive. The
streets in Village VI (Shady Creek Road, Crossridge Road, Squirrel Creek
CIrcle, and Quail Creek Circle) are covered by a separate agreement with
Ahmanson Developments and are proposed to be accepted at a later date.
Improvements in Tract 5511 under the Rafanelli and Nahas agreement have
been inspected by the City Engineer and determined to be complete.
At the time the City and Rafanelli and Nahas executed the contract for
the Tract improvements, the subdivider was required to provide performance
bonds in the amount of $2,276,163 to provide the necessary security for the
performance of work involved. As the work is now completed, the performance
security requirement can be reduced, in accordance with the authority
contained in Section 66499.7 of the Government Code, the an amount necessary
to guarantee maintenance of the work for a one-year period following
acceptance of the work. The sanitary sewer and domestic water services have
been covered by a separate maintenance bond issued to DSRSD; the amount of the
maintenance bond is 25% of the amount of the remaining improvements rather
than 25% of the original performance bond. The subdivider will provide a new
maintenance bond in the amount of $848,476.00, which is 25% of said
improvement estimate, and which is sufficient to cover the one-year
maintenance guarantee period, at a future date.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

FOR THE ACCEPTANCE OF IMPROVEMENTS, PORTION OF
TRACT 5511 (VILLAGES AT WILLOW CREEK)
WHEREAS, the owner-subdivider of the aforesaid Tract previously
entered into a contract with the City of Dublin to improve said Tract in
accordance with plans and specifications on file with the City Engineer, said
Tract identified as follows:
a) Subdivider: Rafanelli and Nahas
b) Tract Location: Westerly of Dougherty Road and northerly of Amador Valley
Boulevard, to the northerly City Limit line.
c) Tract Size: 151 lots.
d) Resolution Approving Final Map: No. 92-86
e) City Streets Affected: Dougherty Road, Wildwood Road, Willow Creek Drive.
WHEREAS, said improvements have been completed in accordance with
said plans and specifications, and any approved modifications thereof, to the
satisfaction of the City Engineer of the City of Dublin; and
WHEREAS, as a condition of said contract, the subdivider is
required to guarantee the improvements and to maintain the completed work for
a period of one year following acceptance of the work by the said City of
Dublin; and
WHEREAS, as the improvements are now completed, the original
performance bond security requirement can be reduced, in accordance with the
authority contained in Section 66499.7 of the Government Code of the State of
California, to an amount found necessary to guarantee maintenance of the
completed work for the aforesaid one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within said Tract be, and they are hereby
approved and accepted subject to the aforesaid one-year guarantee; and
2. The aforesaid original performance bond security requirement be
reduced from the amount of $2,276,163 to a revised security requirement in the
amount of $908,360.00, upon acceptance by Staff of the replacement maintenance
bond in the said amount of $848,476.00 as security for the aforesaid one-year
guarantee period, and the Mayor of this City Council be, and she is hereby
authorized and directed to execute the said bond on behalf of the said City of
Dublin; and
3. The said original performance bond in the amount of $2,276,163
posted in connection with the work involved in the construction of said Tract
be hereby released upon acceptance of said maintenance bond.
PASSED, APPROVED, AND ADOPTED this 12th day of September, 1988.
