HomeMy WebLinkAboutReso 133-15 Parks & Comm Svcs Fees RESOLUTION NO. 133- 15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN RESCINDING RESOLUTIONS 50-93 AND 75-06 RELATING TO THE APPROVAL OF FEES FOR PARKS AND COMMUNITY SERVICES PROGRAMS WHEREAS, the City Council has adopted Long-Term Fiscal Sustainability as its top strategic priority as part of its most recent strategic planning process and directed Staff to evaluate the City's fee structure; and WHEREAS, the City Council approves the Master Fee Schedule, which includes all of the City's fees in exchange for services; and WHEREAS, the current exception is the Parks and Community Services Department, which has its fees approved by the Parks and Community Services Commission and the Heritage and Cultural Arts Commission. The City Council provided this authority to the commissions in Resolutions 50-93 and 75-06 respectively; and WHEREAS, Staff has reviewed the frequency with which these fees are updated and has determined that they do not exceed any frequency greater than that of the City Council's actions, which was the basis for the decision to provide such authority to these two commissions; and WHEREAS, consistent with the roles and bylaws established for these two commissions, they will continue to serve as an advisory body to the City Council and will make recommendations on the fees charged for programs and services. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby rescind Resolutions 50-93 and 75-06, attached hereto as Exhibit A. BE IT FURTHER RESOLVED that the City Council of the City of Dublin hereby authorizes the Parks and Community Services Director to present revisions to the fees and charges, as needed, to the Parks and Community Services Commission and the Heritage and Cultural Arts Commission, consistent with their respective bylaws as an advisory body to the City Council. AYES: Councilmembers Biddle, Hart, Wehrenberg, and Mayor Pro Tem Gupta NOES: None ABSENT: Mayor Haubert ABSTAIN: None / , I Al �I Mayor Pro Tern ATTEST: 61/147 C/r City Clerk Reso No. 133-15,Adopted 7-21-15, Item 4.17 Page 1 of 1 RESOLUTION NO. 50 - 93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ************************* ESTABLISHING A POLICY FOR THE DEVELOPMENT OF RECREATION PROGRAM FEES AND CHARGES • WHEREAS, fees and charges for programs and services provided by the Recreation Department often cannot be determined for a fiscal year because the programs that are offered depend on a number of factors, including availability of instructors, demand and current interests; and WHEREAS, the City Council wishes to establish a general policy for adoption of fees for programs and services provided by the Recreation Department that provides flexibility for establishing fees and charges in a timely manner. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DUBLIN RESOLVES that fees and charges for all recreation programs and services shall not exceed the estimated reasonable cost of providing the program or service. The Recreation Director, with the approval of the Parks and Recreation Commission, is. authorized to establish fees and charges for all recreation programs and services. The fees and charges shall be calculated to recover no more than the City's direct costs of providing the program or service plus indirect overhead. costs (both departmental and citywide) . BE IT FURTHER RESOLVED, that Resolution No. 79 - 84 be rescinded in it's entirety. PASSED, APPROVED AND' ADOPTED this 10th day of May, 1993. ABSENT: None. • M yor ATTEST- qt: C lerk RESOLUTION NO. 75 -06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ESTABLISHING A POLICY FOR THE DEVELOPMENT OF HERITAGE AND CULTURAL ARTS PROGRAM FEES AND CHARGES WHEREAS, fees and charges for programs and services provided by the Heritage and Cultural Arts Division often cannot be determined for a fiscal year because the programs that are offered depend on a number of factors, including availability of instructors, demand and current interests; and WHEREAS, the City Council wishes to establish a general policy for adoption of fees for programs and services provided by the Heritage and Cultural Arts Division that provides flexibility for establishing fees and charges in a timely manner,and WHEREAS, the City Council held a public hearing regarding the adoption of said fees and charges on May 16,2006; and WHEREAS, proper notice of said public hearing was given in all respects as required by law NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF DUBLIN RESOLVES that fees and charges for all heritage and cultural arts programs and services shall not exceed the estimated reasonable cost of providing the program or service. BE IT FURTHER RESOLVED THAT the Parks and Community Services Director, with the approval of the Heritage and Cultural Arts Commission, is authorized to establish fees and charges for all heritage and cultural arts programs and services. The fees and charges shall be calculated to recover no more than the City's direct costs of providing the program or service plus indirect overhead costs (both departmental and citywide).
