J. DeBernardi Seconded by Commissioner Martin C. Kauffman WHEREAS Volk-McLain Communities, Inc. has filed with the Alameda County Planning Commission an application for anAdjustment to erect 30 dwelling units in a manner that would reduce the building site area per dwelling unit from the required minimum of 29000 square feet to a mint um of 19690 square feet, located at the northeast corner of Amador Valley Boulevard and Donohue Drive in San Ramon Village, Pleasanton Township, as shown on a map on file with this Commission; and WHEREAS this Commission did hold a public hearing on said application at the hour of 1 :30 p.m. on the 28th day of February, 1962, In the Alameda County Office Building, Room 160, 224 West Winton Avenue, Hayward, California; and WI REAS it satisfactorily appears from affidavits on file that newspaper notice of said public hearing was given in all respects as required by law; and WHEREAS this Commission does find that: (a) There are exceptional or extraordinary circumstances or conditions applying to the land, building or use referred to in the application, which circumstances or conditions do not apply generally to land, buildings and uses or any thereof in the same district. (b) Granting the application is necessary for the preservation and .enjoyment of substantial property rights of the petitioner, which rights are enjoyed by other properties simili 'ly situated. (c) Granting the application will not, under the circumstances of the particular case, materially affect adversely the health or safety of persons residing or working in the neighborhood of the property of the applicant, and will not, under the circumstances of the particular case, be materially detrimental to the public welfare or injurious to property or improvements in.-the neighborhood. (d) Granting the application will be in accord with the purposes and intent- of the Zoning Ordinance and will not adversely affect the Master Plan of the County or any portion thereof: Now Therefore - 1 Resolution No. 4456 Page 2 BE IT RESOLVED that this Commission does hereby approve said application to erect 30 dwelling units in a manner that would reduce the building site area per dwelling unit from the required minimum of 2,000 square feet to a minimum of 1 ,690 square feet, located at the rrortheast corner of Amador Valley Boulevard and Donohue Drive in San Ramon Village, Pleasanton Township, as shown on a plot plan labelled "Exhibit A" on file with this Commission, a copy of which shall be forwarded to the County Building Official ; except as specifically stated above, the land and use of this property shall comply with all the provisions of the County Zoning Ordinance.
