The expansion to the hotel includes 900 sq.ft.of office space and a 1500 sq.ft.lobby expansion and a future expansion of a meeting room of 1400 sq.ft. The project also includes 3,500 sq.ft.outdoor patio and two freeway oriented towers for decorative purposes. A new use subject to review and approval is a spa(massage,facial,manicure and pedicures). RECOMMENDATION: Approve Exhibit A,a Resolution approving the Conditional Use Permit and Site Development Review for the Dublin Park Hotel(PA96-047). BACKGROUND: The development of the Dublin Park Hotel began under Alameda County in 1972 with the approval of the first site development review.The hotel was originally approved as a 93 unit hotel and restaurant(Howard Johnson Motor Lodge). Over time,conditional use permits were approved to expand the hotel use to what is now in place today,a 235 room hotel. In 1988 and 1990 approvals were granted to allow the existing hotel to add a beauty shop,gift shop,two offices,a dance floor and public dancing within the lounge,a vehicle rental lot,and sales and auction activities. A game room for military personnel was also approved for a one year period from 10/1/94 to 10/1/95. The Applicant,Pacific Valley Investors,recently purchased the hotel. During the spring and summer of 1996,they met with City staff to discuss their plans to update and improve the hotel. Their proposed expansion would exceed the City's ability to process the item as a minor modification to the existing Conditional Use Permit(the City's Zoning Ordinance requires that any expansions of use exceeding 1,000 sq.ft.obtain a new conditional use permit). Staff therefore suggested that the Applicant also examine the approved uses under their Conditional Use Permit to see if those uses should be updated at the same time. As a result,they have requested approval of a spa use which includes massage. ANALYSIS: Conditional Use Permit: Uses: The approved Conditional Use Permit(PA 91-036)allowed for a vehicle rental lot and office. Additionally,the most recently approved Conditional Use Permit(PA 93-033)allowed for a beauty shop, gift shop,offices and temporary retail sales and auction activities. Under this Conditional Use Permit(PA COPIES TO: Pacific Valley Investors ITEM NO. a.' PA File 96-047),these uses would continue to be allowed. The only additional use requested by this application is for a spa. The spa would be a use that includes massage, facials, manicures and pedicures. Any massage use must comply with the Massage Establishments and Massage Services regulations and requirements specified by Chapter 4.20 of the Dublin Municipal Code. The regulations require a massage therapist to obtain a massage permit from the Dublin Police Services prior to conducting the massage therapy business. Compliance with this Section of the Municipal Code has been made a condition of approval of this application. The existing uses within the hotel are currently operating in compliance with the conditions of approval of the existing Conditional Use Permits. Hotel Expansion: The Applicant is requesting as part of the Conditional Use Permit approval of a 3,800 sq.ft. expansion to the existing hotel. The expansion to the hotel includes 900 sq.ft. of office space and a 1500 sq.ft. lobby expansion.Also proposed is a future expansion of the meeting room area of 1,400 sq.ft. The project also includes 3,500 sq.ft. outdoor patio and two freeway oriented towers for decorative purposes (Exhibit B). Adequate on-site parking presently exists for the hotel and its related facilities. The hotel presently has 235 guest rooms, a restaurant and banquet facilities. As the chart below illustrates,after the expansion the hotel will have 83 spaces over the amount required by the Zoning Ordinance. Therefore, staff believes that there is sufficient parking for the additional public area and meeting room expansions. EXISTING PARKING REQUIRED RESERVED EXTRA PARKING PARKING PROVIDED WITH PARKING FOR PARKING FOR PROVIDED EXPANSION EXPANSION CAR RENTAL 373 spaces 340 spaces 237 spaces 20 spaces 83 spaces Site Development Review: The Applicant's plans (Exhibit B) indicate that improvements would be made to the site entry in the form of enhanced paving, landscaping and a new trellis porte corchere. On the east side of the building, a 1500 sq.ft. lobby expansion and a 3,500 sq.ft. patio area off the meeting rooms are proposed. The expanded lobby area will act as a pre-function staging area. The new patio area would be used by people utilizing the meeting rooms. In the future (indicated on the plans, Exhibit B, as Phase II), a new 1400 sq.ft. meeting room is proposed on the north side of the building. No plans are provided for the room at this time. When that project is designed, site development review will be required. The Applicant is proposing a "lightened up" color palette for the entire hotel, including the expansion. A color elevation and color chips will be presented at the meeting. The materials and style of the expansion match the existing building (Exhibit B, sheet A-3.1). The two towers that are proposed,will update the building and add some variation to the roof line. The patio addition would be enclosed by a masonry wall with a brick cap. Wrought iron inserts break up the wall at intervals, providing visual interest. 2 f�. Tower Height: This project is located in Development Zone 2 of the Downtown Specific Plan. Height limitations in this Zone are 45'. Additionally,the C-1 Zoning District,where this project is located also has a height limit of 45'. The Zoning Code does allow this height to be exceeded for decorative architectural elements. Section 8-60.10 states: "The building height limitations set forth in this Chapter apply generally to structures,also,but shall not apply to chimneys,church spires,flag poles,or to mechanical appurtenances necessary and incidental to the permitted use of a Building." The Specific Plan indicates that those development standards not mentioned in the Plan will generally be those required for the base C-1 Zoning District. Staff believes that based on this information, the intent of the Specific Plan would be to rely upon the Zoning Ordinance in this matter. Since the tower elements are decorative,and could be compared to a church spire,staff believes the 48 foot tower is appropriate. Conclusion: The Dublin Park Hotel Conditional Use Permit and Site Development Review is in scale with the site and parking,will provide additional meeting rooms in the Dublin Area and will update the architecture and uses of the hotel. GENERAL INFORMATION: APPLICANT/ Pacific Valley Investors PROPERTY OWNER: 1050 Ralston Avenue Belmont,CA 94002 LOCATION: 5.61+acres at 6680 Regional Street(APN 941-1500-047-3) EXISTING ZONING: C-1 General Commercial DOWNTOWN SPECIFIC PLAN DESIGNATION: Zone 2: General Commercial GENERAL PLAN DESIGNATION: Retail/Office ENVIRONMENTAL REVIEW: The project has been found to be Categorically Exempt from CEQA under Section 15301,Class 1(e)of the California Environmental Quality Act guidelines. The project consists of an addition to an existing structure that will not result in a increase in building area of more than 2,500 square feet. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING OF PA 96-047 DUBLIN PARK HOTEL CONDITIONAL USE PERMIT AND SITE DEVELOPMENT REVIEW WHEREAS, the Pacific Valley Investors,the owners of the Dublin Park Hotel submitted an application requesting approval of a Conditional Use Permit and Site Development Review to expand their current hotel by 3,800 sq.ft.and add a 3,500 sq.ft.patio, two tower elements,and a spa use that includes massage;and WHEREAS,this project was evaluated under the California Environmental Quality Act and was found to be exempt,Class 1 because the project is in an area where all public services and facilities are available to allow for maximum development permissible in the General Plan;and WHEREAS, the Planning Commission did hold a public hearing on said application on December 10,1996;and WHEREAS, proper notice of said public hearing was given in all respects as required by law;and WHEREAS, the staff report was submitted recommending that the application be conditionally approved;and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth and used their independent judgment to make a decision. NOW,THEREFORE,BE IT RESOLVED that the Planning Commission of the City of Dublin does hereby find: A. The approval of this application is consistent with the intent/purpose of Section 8-95.0 Site Development Review. B. The approval of this application,as conditioned,complies with the General Plan, with District Regulations and the general requirements established in the Zoning Ordinance and the Downtown Specific Plan C. The approval of this application,as conditioned,is in the best interests of the public health,safety and general welfare. EXNENET_a__ • D. The proposed site development,including site layout,vehicular access, circulation and parking,setbacks, height,walls,public safety and similar elements have been designed to provide a desirable environment for the development. E. As conditioned,architectural considerations, including the character,scale and quality of the design,the architectural relationship with the site and other buildings, building materials and colors,screening of exterior appurtenances,exterior lighting and similar elements have been incorporated into the project in order to insure compatibility of this development with the development's design concept or theme and the character of adjacent buildings and uses. F. As conditioned, landscape considerations, including the locations,type,size, color,texture and coverage of plant materials,provisions and similar elements have been considered to insure visual relief and an attractive environment for the public. NOW,THEREFORE,BE IT FURTHER RESOLVED that the Planning Commission of the City of Dublin does hereby find that: A) The expansion of use is required by the public need because it provides for a more viable business and tourist hotel in the City of Dublin. B) The use will be properly related to other land uses,transportation and service facilities in the vicinity. The use is adjacent the on and off ramps to highway 580. Additionally, it has good access to Dublin Boulevard. C) The proposed project will not materially affect the health or safety of persons residing or working in the vicinity because all applicable regulations will be met;and D) The project will not be contrary to the specific intent clauses or performance standards established for the district in which it is located because conditions have been applied to ensure conformance with applicable zoning regulations,and because the use is consistent with the character of the surrounding area. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 96-047, Dublin Park Hotel Conditional Use Permit and Site Development Review application,as generally depicted by materials labeled Exhibit B, stamped approved and on file with the Dublin Planning Department and subject to the following conditions: Unless stated otherwise,all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use,and shall be subject to Planning Department review and approval. General: 1. This Conditional Use Permit approval shall supersede the previous Conditional Use Permits, PA 88-042 PA 91-036 and PA 93-033. 2. PA 96-047 is approved to allow public dancing within the banquet rooms(San Miguel, Acapulco and Monterey and any new meeting rooms that are created by this action)and the continued operation and use of a beauty shop,gift shop,offices,a dance floor within the lounge,the temporary retail sales and auction activities,a car rental agency and spa, including massage, within the Dublin Park Hotel located at 6800 Regional Street,as generally depicted on the hotel site plan(Exhibit B)and as specified by the conditions of approval. [PL] 3. All uses as approved,including existing uses,shall occur only within the specific areas indicated on the hotel site plan,(Exhibit B). [PL], 4. The Applicant shall comply with all applicable city of Dublin Site Development Review Standard Conditions and the City of Dublin Non-Residential Security Requirements. [PL] 5. The office uses shall be limited to that which is primarily oriented toward services for the hotel visitors and guests. Any other proposed uses for the offices shall be subject to prior Community Development Director and written approval. [PL] 6. No exterior signage shall be utilized or installed on the premises for the approved uses within the hotel. Any new or proposed signs on the site shall be subject to Planning department review and approval prior to installation or uses. [PL] 7. No modifications or relocation of the approved uses within the hotel site shall occur without prior review and written approval of the Planning Director and Chief of Police and must comply with all applicable zoning,building code and engineering regulations, including issuance of building permits if required. [PL, PO, B, PW] 8. No loudspeakers or amplified music shall be permitted to project or be placed outside of the building. All activities associated with the approved uses shall be conducted entirely within the building.[PL, PO] 9. The Applicant shall control all activities on the hotel site so as not to create a nuisance to the existing or surrounding business. [PL] 3 10. The Developer shall comply with applicable Dougherty Regional Fire Authority,Public Works Department,Dublin Police Service,Alameda County Flood Control District Zone 7 and Dublin San Ramon Services District requirements. Prior to issuance of building permits or the installation of any improvements related to this project,the Developer shall supply written statements from each such agency or department to the Planning Department,indicating that all applicable conditions required have been or will be met. [B] 11. This approval shall be null and void in the event the approved uses cease to operate for a continuous one-year period. [PL] 12. At any time during the effectiveness of this approval,the approval shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to enforcement action. [PL] Fees: 13. Prior to issuance of a building permit the following fees shall be paid: a) The City's Public Utilities Fee shall be paid.[PR,B] b) All utility connection fees, plan checking fees,inspection fees,permit fees and fees associated with a wastewater discharge permit shall be paid to DSRSD in accordance with the rates and schedules established in the DSRSD Code. [DSR,B] c) Those traffic impact fees in effect at the time of issuance of the building permit. This fee shall include any regional traffic impact fee which may be in effect.[PW, B] d) All applicable fees per Zone 7 Ordinances.[Zone 7,B] Auction and Sales: 14. Each individual temporary retail sales and auction activity and any public dance promoter shall obtain a valid business license from the City of Dublin in compliance with Chapter 4.04 of the Dublin Municipal Code.[F,PO] 15. The applicant shall submit to the Planning Department a letter which specifically states the type of auction activity,the merchandise to be sold,date(s),time and location. All auctioneers shall submit a copy of a valid State Auctioneers Permit. A copy of the letter and auctioneer's permit shall be submitted to the Planning Department a minimum of four(4)calendar days prior to an event being held. [PL] 4 -7-7 16. Each sales/auction event shall not exceed ten(10)consecutive days. A minimum of thirty(30)days shall lapse between events for the same uses. [PL] Public Dance: 17. Prior to any public dance event held by a promoter,the Applicant shall obtain a separate dance permit from Dublin Police Services. The Applicant shall comply with all Dublin Police Services requirements and the Dance Permit regulations as specified in Chapter 5.52 of the Dublin Municipal Code. [PO] 18. The Applicant shall maintain a valid dance permit for public dancing on the premises at all times. The Applicant shall submit to the Planning Department a copy of any/all dance permits issued by Dublin Police Services.[PL,PO] 19. The Applicant shall comply with all applicable regulations and requirements of the Uniform Building and Fire Code relating to the occupancy requirements within the lounge and banquet rooms.[F,B] 20. For the use of the dance floor within the lounge and public dancing within the banquet rooms,the Applicant shall comply with all applicable Dublin Police Services and Dublin Municipal Code requirements including,but not limited to,the following: [PO,PL] a) At all times while dancing is occurring within the lounge,there will be at least one (1)security guard on duty to provide facility security. The number of security guards may be increased as required by the Dublin Police Services. b) The Applicant shall comply with the required State Alcohol Beverage Control regulations and requirements,specifically,that any intoxicated persons shall not be served alcoholic beverages. c) During all business hours that the establishment is open to the public,all permits and licenses shall be posted and made available for viewing by Dublin Police Services. d) The parking lot of the hotel premises shall be equipped with exterior lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot. e) All exterior lighting shall be of a design and placement so as not to cause glare onto adjacent properties or businesses. Any modifications to the exterior lighting shall be subject to review and written approval of the Community Development Director and Dublin Police Services. f) The Applicant shall be responsible for maintaining the hotel premises in a safe, clean and litter-free conditions at all times. 5 • g) There shall be no pool tables or coin-operated games,including electronic arcade games,maintained upon the premises at any time. Massage: 21. Prior to establishing the use,the Applicant and the massage therapist shall obtain massage permits from Dublin Police Services and shall comply with the massage requirements specified in Chapter 4.20 of the Dublin Municipal Code. [PO,PL] 22. Prior to establishing the use,the Applicant and massage therapist shall submit evidence to the Planning Department that the permits specified in the previous condition have been obtained. [PL] 23. The Applicant and massage therapist shall comply with all applicable regulations and requirements of the Building Inspection Department,Dougherty Regional Fire Authority and Dublin Police Services. [B,F,PO] 24. All activities associated with the massage establishment use shall be conducted entirely within the enclosed building. [PL] 25. The Applicant shall control all business activity so as not to create a public or private nuisance to the existing or surrounding businesses. [PL,PO] Car Rental Use: 26. The activities associated with the vehicle rental business will be[PL]: a) Administrative and management duties; b) Customer service; c) Rental vehicle pick-up and delivery;and d) Temporary storage and parking of rental vehicles within the designated area of the parking lot(Parcel 1). 27. Twenty reserved spaces shall be provided for the rental car business to be located on Parcel 1 as shown on Exhibit B,page 1. Said parking area shall be marked and labeled "reserved".[B,PL] 28. The rental office shall be restricted to the lobby or administrative office area of the hotel. [PL,B] 29. The applicant shall provide on-site directional signage with a maximum sign area of 8 square feet within the hotel parking lot,including directions to the rental office and rental vehicle parking area[PL,PW] 6 30. The servicing or washing of the rental vehicles or equipment on the site is not permitted. [PL] 31. No modifications or relocation of the rental use within the hotel site shall occur without prior review and written approval from the Director of Community Development. Any modifications or relocations must comply with all applicable zoning,building code and engineering regulations,including issuance of building permits if required.[PL,B,PW]. Site Development Review: 32. The hotel and proposed additions shall be painted to match the"Color Scheme for Dublin Park Hotel"prepared by Bob Buckter color consultant,marked received, December 2,1996. The materials used for the addition shall match those of the existing building.[PL,B] 33. Prior to receiving building permit for the Phase II meeting room expansion as shown on Exhibit B,Site Development Review approval shall be required.[PL,B) 34. All ducts,meters,air conditioning equipment and other mechanical equipment that is on- site or roof-mounted shall be effectively screened from view.[PL] 35. A final detailed Landscape and Irrigation Plan(at 1 inch=20 feet or larger),along with a cost estimate of the work and materials proposed,shall be submitted for review and approval by the Community Development Director. Landscape and Irrigation Plans shall be signed by a licensed architect. Final landscape plans shall indicate the common and botanical names,container size,growth rate and number of each plant. All landscaping, as shown on the Landscape and Irrigation Plan,shall include drought tolerant vegetation.[PL] 36. The final landscape plan shall be generally consistent with the preliminary landscape plans as shown on Exhibit B,dated received by the Planning Department on October 25, 1996.[PL] 37. Landscaping shall not obstruct the sight distance of motorists,pedestrians or bicyclists. Except for trees,landscaping at drive aisle intersections shall not be taller than thirty (30)inches above the curb. Landscaping at drive aisle intersections must not be taller than thirty(30)inches.[PL] 38. The Applicant shall complete and submit to the Dublin Planning Department the Standard Plant Material,Irrigation and Maintenance Agreement.[PL] 39. The Applicant shall submit written documentation to the Public Works Department(in the form of a Landscape Documentation Package and other required documents)that the development conforms to the City's Water-Efficient Landscaping Ordinance.[PL] 7 7-10 40. All newly-striped parking spaces shall be double-striped with 4-inch wide stripes set approximately 2 feet apart as shown on the"Typical Parking Striping Detail". Handicapped,visitor,employee and compact parking spaces shall be appropriately identified on the pavement and designated on the parking plan.[PL,PW] 41. Handicapped ramps and parking stalls shall be provided and maintained as required by the State of California Title 24 provisions including the provision of an eight(8)foot wide striped handicapped ramp for a handicapped van parking space.[PL,B] 42. The Applicant shall provide a minimum one foot wide raised curb or equivalent on landscape fingers and islands adjacent to parking stalls to allow for pedestrian access. [PL] 43. The Applicant shall provide continuous curbing for all parking stalls.[PW] 44. The applicant shall obtain a grading/site improvement permit from the Department of Public Works prior to issuance of a building permit.[PW] 45. The applicant shall provide a 25-foot minimum drive isle between the existing parking stalls and the proposed lobby expansion.[PW] 46. Should the City be required to remove the decorative paving within the existing storm drain easement due to construction or maintenance of storm drain facilities it shall be the responsibility of the property owner to replace the decorative paving.[PW] 47. Domestic and fire protection waterline systems for Commercial Developments shall be designed to be looped or interconnected to avoid dead end sections in accordance with requirements of the DSRSD Standard Specifications and sound engineering practice. [DSR] 48. No sewerline or water line construction shall be permitted unless the proper utility construction permit has been issued by DSRSD. A construction permit will only be issued after all of the items in Condition 13 have been satisfied. [DSR] 49. The Applicant shall hold DSRSD,its Board of Directors,commissions,employees,and agents of DSRSD harmless and indemnify the same from any litigation,claims,or fines resulting from completion of the project.
