PUBLIC HEARINGS 8.1 PA 96-003 Unocal Service Station/Food Mart/Car Wash Conditional Use Permit and Site Development Review at 6401 Dublin Blvd. Unocal is proposing to reconstruct their existing service station which will involve the addition of a new 1,300 square foot`Fast Break' food mart with a 960 square foot drive-through automatic car wash. The project will include a new fuel island canopy,dispensers,landscaping,parking,signage,sidewalk and driveway improvements,including minor off-site improvements on the adjacent Pak-N-Save site. 8.2 PA 96-023 Dougherty Shell Service Station Conditional Use Permit and Site Development Review at 5933 Dougherty Rd. C&J Cox Corporation with Shell Oil Company is proposing to build a new service station facility, to be constructed on two parcels at the northeast corner of Dublin Boulevard and Dougherty Road,on the current site of Harrison's Marine Center. This project involves the construction of a new 2,340 square foot`ETD' food mart store with an attached 900 square foot automatic drive-through car wash. The project will include a 60' x 78' fuel island canopy with new landscaping and signage,and sidewalk and driveway improvements along the Dougherty Road and Dublin Boulevard frontages. Additional off-site access and driveway improvements will be made on the City owned remnant parcel adjacent to the project site. 9. PA Address File ENVIRONMENTAL REVIEW: The project has been reviewed in accordance with the California Environmental Quality Act(CEQA)and the State CEQA Guidelines.An Initial Study of Environmental Review was completed on May 6,1996, and a Negative Declaration has been prepared because the project will not have a significant impact on the environment. ZONING HISTORY: C-2462: On June 28,1972,the Alameda County Zoning Administrator approved a Conditional Use Permit to Angelo Gaspare and Unocal 76 for a Type A Service Station,in the C-2,General Commercial District. PA 92-058: On August 29,1992,The Planning Director approved a Sign Site Development Review to Unocal for a freestanding Service Station display structure/price sign and wall-mounted signs. PROJECT: Unocal is proposing to reconstruct their existing service station which will involve the addition of a new 1,300 square foot'Fast Break'food mart with a 960 square foot drive-through automatic car wash. The project will include a new fuel island canopy,dispensers,landscaping,parking,signage,sidewalk and driveway improvements,including minor off-site improvements on the adjacent Pak-N-Save site. Conditional Use Permit A Conditional Use Permit is required by Section 8-49.2,A6 and A8 of the Zoning Ordinance,to ensure that the current and proposed use of the service station is consistent with the Retail/Office& Automotive uses designated under the Dublin General Plan. The current service station operates under an approved Conditional Use Permit granted by the Alameda County Zoning Administrator in 1972. Modifications and/or additions to the existing service station use,such as the addition of the food mart and car wash use and the complete redesign and layout of the service station,requires a new Conditional Use Permit and subsequent Site Development Review approval by the Planning Commission. The Unocal facility is classified in the Zoning Ordinance,under Section 8-65.0,as a Service Station Type'A'. This type of use applies to the operation of a facility for the refueling and lubrication of motor vehicles.The car wash is also considered a drive in or drive through use per Section 8-49.2,A6. The Zoning Ordinance specifies that both a Service Station Type'A'and a drive in or drive through use, are considered Conditional Uses in the C-2,General Commercial zone district. The food mart is considered a retail store which is a permitted use in the C-2 district. Site Development Review A Site Development Review is used to examine the Applicant's development proposal to determine the project's quality of site planning,architecture,and landscape design. The entire design and layout of this facility matches the current style of new service stations now being used by Unocal. The food mart and car wash buildings and the fuel island canopy will be constructed with a combination of cement plaster,metal facia panels and masonry. The fuel island canopy will be enhanced by the placement of an orange translucent light tube on the east and west elevations of the canopy. Similiar orange and blue light tubes will be installed on the food mart building and the car wash building as shown on the Elevation Drawings,Exhibit'A'. The trash enclosure will be of masonry construction and will be painted to match the buildings. c)- 0F37 -2- • All landscaping on this site will be updated and improved,as shown by the Preliminary Landscape Plan,Exhibit'A'.Additional landscaping will be added to the north facing masonry wall of the car wash building with the planting of climbing vines to help prevent potential tagging by graffiti vandals. The use of the climbing vines will also minimize the visual impact of the large masonry wall. In order to accommodate the new layout and circulation pattern of the service station,the Applicant will make minor modifications to the parking spaces and landscaping planters on a small portion of Pak-N-Save's parking lot adjacent to the project site,as shown on Exhibit'A'. These modifications will be,1)the elimination of 14 parking spaces to allow for two way drive-aisle access through the Pak-N-Save site,and 2)relocate the shared access driveway onto Dublin Boulevard,which is on the Pak-N-Save property and is used by Unocal through an approved easement. These modifications are intended to improve parking and traffic flow,and to facilitate better vehicular access to and from the service station and Pak-N-Save. The elimination of the 14 parking spaces will not reduce the number of spaces needed for the Pak-N-Save site,which has a total of 629 parking spaces and requires a total of 600 parking spaces. A large number of parking spaces on the Pak- N-Save site are underutilized. The Applicant has secured prior written approval from Safeway,Inc.,the Pak-N-Save property owner,for the modifications to their parking lot and driveway. A condition specifying this approval has been included in the Resolution,Exhibit'D'. The project will include an offer of dedication of land for the future roadway widening of both Dublin Boulevard and Dougherty Road. The Property Owner will offer a dedication of 8-feet of property along the Dublin Boulevard frontage and 8-feet of property along the Dougherty Road frontage. The Public Works Department has determined that this offer of dedication compensates for and pre-mitigates, any traffic impacts or fees as a result of this project and the offer of dedication adequately covers the necessary roadway improvements planned for the future widening of Dublin Boulevard and Dougherty Road. This offer of dedication will be recorded prior to the issuance of a building permit and this requirement is indicated as a condition of approval in the Resolution,Exhibit'D'. Conclusion The project,as proposed,will be a major improvement to an older and outdated facility and the improvements will greatly enhance the image of the area. This project,as proposed,is in compliance with the provisions of the Zoning Ordinance. The project has been reviewed by other City departments and affected government agencies and their specific conditions have been incorporated into the Resolutions, Exhibits C and D,as conditions of approval. WHEREAS,the Applicant,Ron Jacobs of Robert Lee&Associates,has filed a Conditional Use Permit and Site Development Review application requesting approval to reconstruct and expand the existing Unocal Service Station,located at 6401 Dublin Boulevard.The project will include a new fuel island canopy,dispensers, landscaping,parking,signage,sidewalk and driveway improvements,including minor off-site improvements on the adjacent Pak-N-Save site;and WHEREAS,the Planning Commission held a public hearing on said Site Development Review application on August 6,1996;and WHEREAS,proper notice of said public hearing was given in all respects as required by law;and WHEREAS,the application has been reviewed in accordance with the provisions of the California Environmental Quality Act(CEQA)and a Negative Declaration has been prepared because the project will not have a significant impact on the environment;and WHEREAS,the Staff Report was submitted recommending that the application be conditionally approved;and WHEREAS,the Planning Commission did hear and consider all said reports,recommendations and testimony hereinabove set forth. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 96-003,Unocal 76 Service Station Site Development Review application as generally shown on Exhibit A,stamped approved and on file with the Dublin Planning Department,subject to the approval of the related Conditional Use Permit Resolution and to the following conditions: CONDITIONS OF APPRQVAL: Unless stated otherwise,all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use.and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. The Property Owner shall grant to the City of Dublin an irrevocable offer of dedication of an 8-foot wide right-of-way along the Dublin Boulevard frontage and an 8-foot wide right-of-way along the Dougherty Road frontage for future roadway widening,as shown on the approved site plan. This offer of dedication shall be subject to Public Works Director and City Attorney review and shall be completed and submitted prior to the issuance of a building permit. [PL,PW,ADM,FIN] PARKING 5. All customer parking spaces shall be as shown on the approved plans and shall be subject to review and approval of the Planning Director and Public Works Director. All parking spaces shall be double-striped with 4-inch wide stripes set approximately 2 feet apart. A final detailed Landscape and Irrigation Plan(at 1 inch=20 feet or larger),along with a cost estimate of the work and materials proposed,shall be submitted for review and approval by the Planning Department. Landscape and Irrigation Plans shall be signed by a licensed landscape architect. Final landscape plans shall indicate the common and botanical names,container size,growth rate and number of each plant. All landscaping,as shown on the Landscape and Irrigation Plan,shall include drought tolerant vegetation. [PL] 10. The final landscape plan shall be generally consistent with the preliminary landscape plans prepared by Ronald J.Allison,Landscape Architects,dated received by the Planning Department on June 23,1995 (Exhibit A). [PL] 11. Landscaping at the driveways and at the intersection of Dublin Boulevard and Dougherty Road shall not obstruct the sight distance of motorists,pedestrians or bicyclists. The Applicant shall complete and submit to the Dublin Planning Department the Standard Plant Material, Irrigation and Maintenance Agreement,Attachment 3. [PL] ARCHITECTURAL 13. Exterior colors and materials for the proposed food mart building,car wash building,the fuel island canopy and the trash enclosure,shall be as shown by the Material and Color Samples,submitted by the Applicant on February 20,1996. All ducts,meters,air conditioning equipment and other mechanical equipment that is on-site or roof mounted shall be effectively screened from public view with materials architecturally compatible with the main structures. [PL] LIGHTING 14. Exterior lighting shall be provided and shall be of a design and placement so as not to cause glare onto adjoining properties or businesses. Lighting used after daylight hours shall be adequate to provide for security needs(1.5 foot candles). Any wall lighting around the perimeters of the buildings shall be supplied to provide"wash"security lighting. The Applicant shall provide photometrics and cut sheets subject to the review and approval of the Police Department and the Planning Director. [PL,B,PO] FIRE PROTECTION 15. The Applicant shall comply with all applicable regulations and requirements of the Dougherty Regional Fire Authority(DRFA). [F] 16. The placement of freestanding shelving or other similar types of interior appurtenances,as indicated in the floor plan of the food mart,shall allow for maximum visual surveillance of the alcohol cold storage area from the employee service/cashier area. [PO] 22. Security devices,such as the use of mirrors or closed circuit video systems,shall be provided for in the food mart to minimize potential theft problems. [PO] 23. All security hardware for the new convenience store/food mart must comply with the City of Dublin Non- Residential Security Requirements(Attached). Security hardware must be provided for doors,windows, roof,vents,and skylights. [B,PO] 24. The Property Owner and operator of the service station facility shall keep the site clear of graffiti vandalism on a regular and continuous basis at all times. Graffiti resistant paints for the structures and film for windows or glass should be used. [PO,PL] 25. The Applicant shall work with the Dublin Police Department on an ongoing basis to establish an effective robbery,theft prevention and security program. [PO] 26. Prior to issuance of building permits,the Applicant shall provide written documentation to the Planning Department that all Dublin Police Services requirements have been,or will be,met. [PO,PL] DRAINAGE/GRADING 27. The Applicant shall submit a grading,drainage and improvement plan subject to review and approval by the Public Works Director. If needed,a grading permit shall be required for site grading and drainage. [PW] 28. Roof drains shall empty into approved dissipating devices. Roof water,or other concentrated drainage, shall not be directed onto adjacent properties,sidewalks or driveways. No drainage shall flow across property lines. [PW,B] 29. Where storm water flows against a curb,a curb with gutter shall be used. The flow line of all asphalt paved areas carrying water shall be slurry sealed at least three feet on either side of the center of the swale. [PW] 30. All catch basins within paved areas not against curb and gutter shall be a 3 foot concrete apron around all sides of the inlet per City of Dublin Standard Plans. [PW] 31. The Applicant and Property Owner shall comply with all National Pollution Discharge Elimination System (NPDES)regulations and requirements at all times. [PW] ON&OFF-SITE/PUBLIC IMPROVEMENTS 32. The Applicant shall relocate and modify the existing shared access driveway along Dublin Boulevard as shown on the approved plans,Exhibit'A'. All work and improvements shall be subject to the review and approval of the Public Works Director. [PW] 33. The Applicant shall remove and modify the parking spaces,landscape planters and drive-aisle on the adjacent Pak-N-Save parking lot as shown on the approved Plans,Exhibit'A'. All work and improvements on the Pak-N-Save site shall be subject to the review and approval of the property owner of the Pak-N-Save site and the Public Works Director prior to the issuance of a building permit. [PW] 34. Any new on-site pedestrian walkways shall maintain a minimum 4-foot unobstructed width. [PL] 35. All damaged on-site existing pavement sections,if any,shall be repaired or replaced as directed by the Public Works Director. [PW] 36. Any improvements within the public right-of-way,including curb,gutter,sidewalks,driveways,paving and utilities,shall be constructed in accordance with approved standards and/or plans and may be constructed only after an encroachment permit has been issued. The Applicant shall be responsible for correcting deficiencies,if any,in the existing frontage improvements and to the existing driveways to the satisfaction of the Public Works Director and shall be accomplished at no expense to the City. [PW] DEBRIS/DUST/CONSTRUCTION ACTIVITY 38. Measures shall be taken to contain all trash,construction debris,and materials on-site until disposal off- site can be arranged. The Applicant shall keep adjoining public streets and private properties free and clean of project dirt,mud,and materials during the construction period. The Applicant shall be responsible for corrective measures at no expense to the City of Dublin. [B,PW] 39. Areas undergoing grading,and all other construction activities,shall be watered,or other dust palliative measures used,to prevent dust,as conditions warrant. [PW,B] 40. The use of any temporary construction fencing shall be subject to the review and approval of the Public Works Director and the Building Official. [PW,B,PL] MISCELLANEOUS 41. The design of the trash enclosure shall be architecturally compatible with the main structures and shall be painted to match the existing food mart building. The design of the trash enclosure shall reflect the dimensional criteria deemed acceptable by the Livermore Dublin Disposal Service,and shall incorporate use of a 10'x 10'concrete apron in front of the enclosure to facilitate the disposal company's mechanical pick-up service. If wooden doors are utilized,the doors shall be trimmed with a heavy metal lip. Raised concrete curbing shall be provided inside the trash enclosure area to serve as wheel stops for the metal trash bins in order to protect the interior walls of the enclosure. [PL,B] 42. The Applicant shall submit a demolition plan for the existing service station to the Alameda County Health Department for review and approval. [CO,B,F] 43. Prior to the issuance of a building or demolition permit,the Applicant shall supply written confirmation that the requirements of the Alameda County Health Department have been,or will be met. [PL,F,B, CO] 44. The Applicant shall comply with all applicable regulations and requirements of the Uniform Building Code and the Building Inspection Department. [B] 45. Building permits for the proposed project shall be secured and construction commenced within one year after the effective date of this approval or said approval shall be void. This one year period may be extended an additional six(6)months after the expiration date of this approval(Applicant must submit a written request for the extension prior to the expiration date)by the Community Development Director upon the determination that the Conditions of Approval remain adequate to assure that the above stated Findings of Approval will continue to be met. [B,PL] 46. To apply for building permits,the Applicant shall submit six(6)sets of construction plans to the Building Department for plan check. Each set of plans shall have attached an annotated copy of these conditions of approval. The notations shall clearly indicate how all conditions of approval will be complied with. Doors. Exterior doors which are located at the rear, or side, or away from the primary entrance shall be solid doors with no glazing and shall be installed in metal frames. Exterior wood doors shall be solid wood construction 1 3/4" thick or hollow metal doors. 2. Locking devices. Exterior swinging doors which are exit doors as setforth in Chapter 33 shall have cylinder dead-bolt locks which shall be openable without the use of key, special effort, or knowledge. In Group B occupancies, a double cylinder dead-bolt lock may be used on the main exit door if there is a readily - visible, durable sign on, or adjacent, to the door stating, "this door to remain unlocked during business hours." The sign shall be in letters not less than 1 inch high on contrasting background. When unlocked the single door and both leaves of a pair of doors shall be free to swing without operation of any latching device. Doors which are not exit doors shall have the inactive leaf secured with flush-bolts at the top and bottoms. The bolts shall be hardened steel 1/4" minimum diameter and shall engage a metal strike plate to, a minimum depth of 3/8 inch. The dead bolts shall be hardened steel and shall have a minimum of a one inch throw. If the cylinder of the lock protrudes from the face of the door it shall be fitted with a cylinder ring geared so that it cannot be griped with pliers or other wrenching devices. Vehicle door, overhead doors, and sliding doors shall be secured with metal to metal locking devices which prevent the door from opening. 3. Strike plates. Strike plates for wood jambs shall be the high security type and shall be secured with a minimum of two wood screws 3" long which shall engage the door studs. 4. Jambs. Inswinging doors with wood jambs shall have rabitted jambs. The jambs on the strike side shall have solid shims above and below the strike plates and the opposite jamb shall have solid shims at the level of the strike plate. Both door studs shall be reinforced with horizontal solid blocking at the approximate height of strike. 5. Hinges. Exterior doors shall have non-removable hinge pins. 6. Sliding glass doors. Sliding glass doors shall comply with Chapter 54. The primary locking device shall be operable by a keyed or code lock inside. Doors with 2 sliding panels shall be locked at the meeting rails and shall have an auxiliary locking device as described above. 8. Windows. All accessible windows which are not located at the front or main entrance side of a non-residential building shall be made secure as follows: a) Sliding glass windows shall be secured on the inside with a locking device capable of withstanding prying or wrenching. An auxiliary lock shall be installed on each sliding window that prevents movement in the sliding track. b) Louvered windows shall not be used within eight feet of ground level, adjacent structures, or fire escapes. c) Casement type windows shall be secured with a :petal to metal locking device contacting both frames of the window at the meeting edge. Openable transoms. All exterior openable transoms exceeding 8 x 12 which are not located on the front or main entrance side of a non-residential building shall be protected with a steel grill and 1/4" minimum bars not more than 2" on center or by a screen with 1/8" diameter wire mesh not more than 2" on center mounted on the inside. 9. Roof openings. PA 90-066: On November 19,1990,the Planning Commission denied a Conditional Use Permit and Site Development Review request to Chevron for a new service station facility with food mart and car wash. On September 23,1991,the City Council,upon appeal of the Planning Commissions decision,approved the Conditional Use Permit and Site Development Review request to Chevron for the service station/food mart/car wash facility. The project was never started and the approval expired on September 23,1992. PA 94-003: On February 7,1994,the Planning Commission approved a Conditional Use Permit and Site Development Review request to Harrison's Marine Center to establish a boat sales and storage facility. The approval was valid for a 1-year period. On November 7,1994, the Planning Commission approved a time extension request to allow Harrison's Marine to operate for an additional 1-year period. On February 27,1996,the Planning Director approved a Minor Amendment request to the Conditional Use Permit for an additional 1-year time extension to continue operating the boat sales and storage facility. PROJECT: C&J Cox Corporation with Shell Oil Company is proposing to build a new service station facility, to be constructed on two parcels at the northeast corner of Dublin Boulevard and Dougherty Road,on the current site of Harrison's Marine Center. This project involves the construction of a new 2,340 square foot 'ETD'food mart store with an attached 900 square foot automatic drive-through car wash. The project will include a 60'x 78'fuel island canopy with new landscaping and signage,and sidewalk and driveway improvements along the Dougherty Road and Dublin Boulevard frontages. Additional off-site access and driveway improvements will be made on the City owned remnant parcel adjacent to the project site. Conditional Use Permit A Conditional Use Permit is required by Section 8-49.2,A6 and A8,to ensure that the proposed use of the new service station facility is consistent with the Retail/Office&Automotive uses designated under the Dublin General Plan. The use and operation of a service station and the automatic drive- through car wash requires approval of a Conditional Use Permit,and the design and layout of the facility requires subsequent Site Development Review approval by the Planning Commission. The proposed Shell service station is classified in the Zoning Ordinance,under Section 8-65.0,as a Service Station Type'A'. This type of use applies to the operation of a facility for the refueling and lubrication of motor vehicles.The car wash is also considered a drive in or drive through use,per Section 8-49.2,A6. The Zoning Ordinance specifies that both a Service Station Type'A'and a drive in or drive through use,are considered Conditional Uses in the C-2,General Commercial Zoning District. The food mart is considered a retail store which is a permitted use in the C-2 district. Site Development Review A Site Development Review is used to examine the development proposal to determine the project's quality of site planning and access,architecture,and landscape design. The architecture and layout of this facility matches the current style of service stations used by Shell Oil Company. The food mart and car wash building and the fuel island canopy will be constructed with a combination of textured concrete,wainscot with ceramic tiles and sheet metal panels. The trash enclosure will be of masonry -2- O .2e S . construction and will be painted to match the food mart and car wash building. Since the service station will be built over two separate parcels under the same ownership(APN 941-550-9-17&10-17),the merger of these two parcels will be required. A condition has been included in the Resolution of the Site Development Review(Exhibit D)requiring the merger of these parcels prior to the issuance of a building permit. All landscaping proposed for this site will be as shown on the Preliminary Landscape Plan,labeled Exhibit'A'. Additionally,the Applicant will install new street trees and irrigation lines within the sidewalk. The north facing wall of the food store and car wash may have the potential to be tagged by graffiti vandals. Staff recommends the use of climbing vines or other type of landscaping feature,such as a trellis or lattice structure,that will help prevent the wall from being tagged with graffiti. For security purposes,Police Services recommends the placement of a window in back of the food mart to allow for the clear view of the rear of the building and the car wash. Staff has included specific conditions specifying the concern of graffiti and the placement of a window behind the food mart in the Resolution, Exhibit'D'. In order to accommodate access to the site for traffic traveling westbound on Dublin Boulevard, the Applicant will make minor site improvements on the City-owned remnant parcel adjacent to the project site,as shown on Exhibit'A'. A 70-foot wide access easement exists on the City-owned parcel as shown on the site plan,and the Applicant will install paving,curb-cut and driveway within the easement for right turns onto and from westbound Dublin Boulevard. The existing Dougherty Road driveway used by Harrison's Marine Center along the northern portion of the site will be eliminated and a new driveway will be constructed closer to the intersection. Staff recommends that an additional 20-foot wide access through-way along the north property line be provided between the BJ Dublin Commercial property and the service station site. This through-way will provide future access between these parcels especially for the future development of the BJ Dublin Commercial site. A condition specifying this is included in the Resolution,Exhibit'D'. All proposed driveway and access through-way modifications will accommodate the design,layout and circulation pattern of the service station facility and will improve traffic flow. Several years ago,the Property Owner made roadway and sidewalk improvements along both the Dublin Boulevard and Dougherty Road frontages. The Traffic Impact Fee Study for this project,conducted by TJKM,determined the amount of the impact fee at approximately$95,000. The Public Works Department has determined that the roadway and sidewalk improvements made by the property owner, was in excess of$95,000,and these improvements compensate for and pre-mitigates,any traffic impacts that may result from the service station use. Public Works also requires the Applicant to dedicate a 10-foot wide public utility and street access easement along the Dublin Boulevard and Dougherty Road frontages. This easement will need to be recorded prior to the issuance of a building permit and this requirement is indicated as a condition of approval in the Resolution,Exhibit'D'. Conclusion This project,as proposed,will be an attractive facility and will greatly enhance the image of the area,especially to future retail and service commercial developments adjacent to the site and along east bound Dublin Boulevard. The proposed project is in compliance with the provisions of the Zoning Ordinance. The project has been reviewed by other City departments and affected government agencies and their specific conditions have been incorporated into the Resolutions,Exhibits C and D,as conditions of approval. -3- PAGE 3 oFA. All ducts,meters,air conditioning equipment and other mechanical equipment that is on-site or roof mounted shall be effectively screened from public view with materials architecturally compatible with the main structures. [PL] LIGHTING 14. Exterior lighting shall be provided and shall be of a design and placement so as not to cause glare onto adjoining properties or businesses. Lighting used after daylight hours shall be adequate to provide for security needs(1.5 foot candles). Any wall lighting around the perimeters of the buildings shall be supplied to provide"wash"security lighting. Prior to the issuance of a building permit,complete improvement plans shall be submitted to DSRSD that conform to the requirements of the DSRSD Code,the DSRSD"Standard Procedures,Specifications and Drawings for Design and Installation of Water and Wastewater Facilities",all applicable DSRSD Master Plans and all DSRSD policies. Prior to the issuance of a building permit,all utility connection fees,plan check fees,inspection fees,permit fees and fees associated with a wastewater discharge permit shall be paid to DSRSD in accordance with the rates and schedules established in the DSRSD Code. The Applicant shall hold DSRSD,its Board of Directors,commissions,employees,and agents of DSRSD harmless and indemnify the same from any litigation,claims,or fines resulting from completion of the project. [DSR] 24. DSRSD"Standard Procedures,Specifications and Drawings"requires a grease and sand trap to be installed in the car wash. Grading around the perimeter of the building should not allow for storm water to enter the grease and sand trap. [DSR] 25. Prior to issuance of building permits,the Applicant shall provide written documentation to the Planning Department that the requirements of DSRSD have been,or will be,met. [DSR,B,PL] POLICE SECURITY 26. For security purposes,an additional window shall be installed at the rear of the food mart building. The placement of freestanding shelving or other similar types of interior appurtenances,as indicated in the floor plan of the food mart,shall allow for maximum visual surveillance of the alcohol cold storage area from the employee service/cashier area. The Applicant/Operator and/or Property Owner shall keep the service station facility clear of graffiti vandalism on a regular and continuous basis at all times. The Applicant shall work with the Dublin Police Department on an ongoing basis to establish an effective robbery,theft prevention and security program. [PO] 32. Prior to issuance of building permits,the Applicant shall provide written documentation to the Planning Department that all Dublin Police Services requirements have been,or will be,met. [PO, PL] DRAINAGE/GRADING 33. The Applicant shall submit a grading,drainage and improvement plan subject to review and approval by the Public Works Director. If needed,a grading permit shall be required for site grading and drainage. [PW] 34. Roof drains shall empty into approved dissipating devices. Roof water,or other concentrated drainage,shall not be directed onto adjacent properties,sidewalks or driveways. No drainage shall flow across property lines. [PW,B] 35. The design of the trash enclosure shall be architecturally compatible with the main structures and shall be painted to match the existing food mart building. The design of the trash enclosure shall reflect the dimensional criteria deemed acceptable by the Livermore Dublin Disposal Service,and shall incorporate use of a 10'x 10'concrete apron in front of the enclosure to facilitate the disposal company's mechanical pick-up service. If wooden doors are utilized,the doors shall be trimmed with a heavy metal lip. Raised concrete curbing shall be provided inside the trash enclosure area to serve as wheel stops for the metal trash bins in order to protect the interior walls of the enclosure. [PL,B] 50. Doors. Exterior doors which are located at the rear, or side, or away from the primary entrance shall be solid doors with no glazing and shall be installed in metal frames. Exterior wood doors shall be solid wood construction 1 3/4" thick or hollow metal doors. 2. Locking devices. Exterior swinging doors which are exit doors as setforth in Chapter 33 shall have cylinder dead-bolt locks which shall be openable without the use of key, special effort, or knowledge. In Group B occupancies, a double cylinder dead-bolt lock may be used on the main exit door if there is a readily visible, durable sign on, or adjacent, to the door stating, "this door to remain unlocked during business hours." The sign shall be in letters not less than 1 inch high on contrasting background. When unlocked the single door and both leaves of a pair of doors shall be free to swing without operation of any latching device. Doors which are not exit doors shall have the inactive leaf secured with flush-bolts at the top and bottoms. The bolts shall be hardened steel 1/4" minimum diameter and shall engage a metal strike plate to, a minimum depth of 3/8 inch. The dead bolts shall be hardened steel and shall have a minimum of a one inch throw. Sliding glass doors shall be fitted with a locking device that shall engage the strike sufficiently to prevent its being disengaged by any possible movement of the door within the space or clearances provided for installation and operation. Doors with 2 sliding panels shall be locked at the meeting rails and shall have an auxiliary locking device as described above. 8. Windows. All accessible windows which are not located at the front or main entrance side of a non-residential building shall be made secure as follows: a) Sliding glass windows shall be secured on the inside with a locking device capable of withstanding prying or wrenching. An auxiliary lock shall be installed on each sliding window that prevents movement in the sliding track. b) Louvered windows shall not be used within eight feet of ground level, adjacent structures, or fire escapes. c) Casement type windows shall be secured with a metal to metal locking device contacting both frames of the window at the meeting edge. All exterior openable transoms exceeding 8 x 12 which are not located on the front or main entrance side of a non-residential building shall be protected with a steel grill and 1/4" minimum bars not more than 2" on center or by a screen with 1/8" diameter wire mesh not more than 2" on center mounted on the inside. 9. Roof openings. All skylights on the roof of a non-residential building shall be protected by: a) Iron bars 1/2 inch minimum diameter not more than 8" on center or; b) A screen with 1/8" diameter wire mesh not more than 2" on center. APPLICANT: City of Dublin LOCATION: Citywide ANALYSIS: The City of Dublin Zoning Ordinance is the Alameda County Zoning Ordinance which was adopted by reference by the City when it incorporated in 1982. The last comprehensive update of the Ordinance by Alameda County was in 1967. Amendments have been made over the years to sections of the Ordinance including signage, recycling bins, outdoor sales, fortunetelling, sleeping in vehicles, massage establishments, planned developments, and permit procedures. Despite these amendments, many problems with the Ordinance remain. For example, the land uses addressed by the Ordinance are not very comprehensive. Many land uses such as telecommunications facilities, martial arts studios, auto brokers, garage sales, residential care for the elderly, and community care facilities are not addressed. The Parking section requires far more parking spaces than are necessary which inhibits business development. The Accessory Structures section is unclear and obsolete. The consequences of updating the Ordinance are many. The Ordinance could enhance business development rather than inhibit it. It could promote more flexible and innovative approaches to development such as staggered front yard setbacks and height standards that reflect today's larger homes. It should promote better use of landscaping, making our industrial and commercial areas more attractive to developers and customers. Finally, it needs to be clearly edited, incorporating graphics and tables, and including all previously approved amendments to the Ordinance. The City Council has given the update of the Zoning Ordinance a high priority. No funds are budgeted for the update during Fiscal Year 1996-1997, so Staff will be preparing the update on a time-available basis and without the assistance of consultants. Staff is proposing that the Ordinance be updated section-by-section, with those sections which most urgently need attention being considered first. Staff has analyzed the Zoning Ordinance to determine which sections have shown the greatest need of updating. Staff requests that the Planning Commission give guidance about these and any additional areas of the Ordinance that should be revised, that it comment on Staffs recommendations regarding the priority of the sections to be reviewed, that it select a work program and procedures, and that it appoint a Zoning Ordinance Steering Committee. The decisions of the Planning Commission should be made by a straw-vote based on a consensus of the Commission. Staff has prepared the following list of high and medium priority tasks that have been divided into substantive issues, roles and responsibilities, and administration: ZONING ORDINANCE SECTIONS WHICH NEED TO BE UPDATED SUBSTANTIVE ISSUES HIGH PRIORITY 1. PERMITTED AND CONDITIONAL USES. Revise permitted and conditional uses in Residential, Commercial, and Manufacturing zones to reflect new land use types, and current planning practice. 2. PARKING. Revise Parking regulations to meet current industry and planning standards and to address the parking of commercial vehicles. The current parking standards require more parking than is necessary. 3. ACCESSORY STRUCTURES AND ACCESSORY USES. Revise Accessory Structures and Accessory Uses to more clearly state where different types of accessory structures can be located, and to reflect accessory structure types that were not in existence or commonly used at the time this Ordinance was written, such as satellite dishes, hot tubs, and spas. 2 a 'CO7 4. SETBACKS. Reexamine setback requirements for all zones. An example would be to allow staggered front yard setbacks to provide streetscape variety, or to require larger sideyard setbacks in residential areas. 5. LANDSCAPING. The current Ordinance does not address landscaping for industrial or commercial lots, require continued landscape maintenance, or the preservation of mature trees. 6. HEIGHT. Revise height requirements for residential zones. The Ordinance now restricts the height of single family dwellings to a maximum of 25 feet. Most new homes average 32 feet in height. 7. HOME OCCUPATIONS. The current home occupation regulations do not adequately address issues such as firearms sales, number of parked commercial vehicles, employees, use of homes for mail order businesses where multiple deliveries occur per day, and new types of appliances or machines that should not be worked on in a single family home. 8. FENCE, WALLS AND HEDGES. Revise Fence, Walls and Hedges regulations to make the Ordinance language more clear. Flexibility could be allowed for lattice screens on top of walls. 9. NON-CONFORMITY. Revise Non-Conforming Uses and Structures regulations to include the amortization of structures. 10. PLANNED DEVELOPMENT. Revise Planned Development regulations to allow shell planned developments and to clarify the section. MEDIUM PRIORITY 1. HILLSIDE REGULATIONS. Adopt hillside development regulations to provide means of protecting hillside values. 2. TELECOMMUNICATIONS. Adopt telecommunications regulations to address the issue of location of facilities in the City. 3. USEABLE OPEN SPACE. Adopt private and group useable open space regulations to ensure provision of adequate level useable open space for residential units. 4. DESIGN CRITERIA. Adopt design criteria to ensure that buildings are attractive and consistent with the design of the surrounding structures. 5. COMBINING DISTRICTS. Eliminate Combining Districts and transfer their functions to zones. 3 3 7 6. BICYCLE STORAGE. Adopt bicycle storage regulations to ensure provision of bicycle racks in the proper locations. 7. HIGHWAY COMMERCIAL. Eliminate Highway Commercial zone and transfer function to other commercial zones. 8. SECOND UNITS. Revise the Second Units portion of the Ordinance to require full hook-up to utilities including payment of fees. Consider allowing larger units. ROLES AND RESPONSIBILITIES 1. GENERAL AND PROCEDURES SECTIONS. Update and clarify the General and Procedures sections of the Ordinance with the goal of simplifying procedures and lowering the level of review of permits to speed their issuance. Also, clarify the roles and responsibilities of the Staff, Zoning Administrator, Planning Commission, and City Council. ADMINISTRATION 1. EDIT ORDINANCE. Edit the Ordinance to make it more user-friendly. This would include use of small easy-to-use tables, cross-referencing, short paragraphs and sections, an index, section locators at top of the page, simple regulations, simple language, graphics, charts, diagrams, and variable and readable fonts. The edit would include all previously adopted amendments to the Ordinance in the final text, and would delete sections of old Ordinance that do not apply to Dublin. 2. PURPOSE AND INTENT SECTION. Include a Purpose and Intent section at the beginning of each section to provide direction and structure for the section and to ensure that each regulation has a firm legal foundation. 3. DEFINITION SECTION. At present the Definition section of the Ordinance is not very comprehensive, and does not reflect current terminology. It should be updated to provide definitions of the types of land uses, and other terms and phrases used in the Zoning Ordinance that are technical or specialized, or that may not reflect common usage. WORK PROGRAM AND PROCEDURES Staff has proposed several work program options for your review. We recommend Option 2 because in will require fewer study sessions, steering committee meetings, Staff reports, and distributions. This option could result in longer study sessions. 4 L, , y 1 - Option 1: Address one issue before a Zoning Ordinance Steering Committee every two weeks. This work program would bring a section (or sections if minor) before a Zoning Ordinance Steering Committee every two weeks. This program is ambitious and could be quite demanding if it continued over an extended period of time. The Committee may wish to take breaks or schedule longer times between study sessions to allow for more difficult issues to be addressed. The Committee would make a report to the Planning Commission once a month on the progress of the update and of the specific section of the Zoning Ordinance addressed that month and accept direction from the Commission. Option 2: Address two or three issues before the Zoning Ordinance Steering Committee once a month. This option would bring the same number of Ordinance sections before the Committee each month as Option 1, but would reduce the number of study sessions, reports and distributions from two to one per month. This would simplify the procedure because fewer study sessions, Staff Reports and distributions would be required, but could result in longer meetings. This work program would allow Staff to better utilize its time to research two or three issues a month, prepare a report and bring it to the Committee. The Committee would make a report to the Planning Commission once a month. Option 3: Address two or three issues before the Planning Commission once a month. This option would be similar to Option 2 but would involve the entire Planning Commission in the update process. There would be no Zoning Ordinance Steering Committee. It would occupy most or all of the agenda of one Planning Commission a month. This option would have the advantage of involving all of the planing commissioners. However, it would have the drawbacks of requiring the focus of all of the commissioners over a long series of monthly meetings (some of whom do not have the time to devote to the process), displacing or delaying some PA cases, and making agendas crowded and long. SUMMARY Option 1 would bring Zoning Ordinance sections before the Zoning Ordinance Steering Committee every two weeks Option 2 would bring the same number of sections before the Committee every four weeks. Option 3 would bring the proposed changes before the full Planning Commission. Staff recommends that the Planning Commission direct Staff to pursue Option 2. This work program would provide for greater flexibility, reduce administrative costs, and ensure Planning Commission participation in the review process by representation by two of its members on the Zoning Ordinance Steering Committee. 5 7 • r PROCEDURES A study session would be held on a weekday evening. Staff would make a presentation on a given issue and outline various approaches to revising it. The Committee would then give direction to staff on that issue. The Committee would then make a presentation at the last Planning Commission meeting of the month on the progress of the project. When all of the study sessions have been held, Staff will bring the all the proposed revisions back to the Planning Commission for one more study session to wrap up any details and then schedule a final public hearing to consider adoption of a Resolution recommending that the City Council adopt a revised Zoning Ordinance. Staff has tentatively scheduled Zoning Ordinance Review study sessions for August 20, and September 10, 1996. If the Planning Commission determines the sections of the ordinance that it wishes to be addressed, establishes priorities, determines the work program and appoints a Zoning Ordinance Steering Committee at this meeting, those study sessions will not be necessary. If any of these issues are unresolved, Staff will bring them back for discussion on September 20, 1996. If the Planning Commission takes action on this item tonight and establishes a Zoning Ordinance Steering Committee, that Committee could meet for the first time during the week of September 9th, and report to the Planning Commission on September 24, 1996. APPOINTMENT OF A ZONING ORDINANCE STEERING COMMITTEE A Zoning Ordinance Steering Committee would assist in the revision of the Ordinance by contributing advice on the details of the revisions, would represent the Planning Commission in the process, and ensure that the resulting Ordinance is drafted to a high professional standard. The committee would meet one or two times a month in night meetings. At those meetings the committee would review alternative approaches to a given issue and work with Staff to arrive at the best approach to that issue. The Committee would report to the Planning Commission once a month and receive direction on the issue(s) addressed by the Committee that month. Staff recommends that the Planning Commission appoint a Zoning Ordinance Steering Committee to assist in the revision of the Zoning Ordinance as shown in Option 2. It is requested that the committee consist of two members of the Planning Commission reflecting diverse views, a member of the business community, and Dennis Carrington, Senior Planner/Zoning Administrator. Election and Term of Office The Chairperson,Vice Chairperson and Secretary are elected by the majority of the Commission for a one-year term and hold office until their successors are elected or until their terms as members of the Commission expire. The officers are elected at the first meeting of the Commission in December of each year. Elections;whether regular or to fill vacancies,shall be held only if at least four Commission members are present. B. A committee may not represent the Commission before the Council or other bodies unless it has first received the authorization of the Commission to do so. III. MEETINGS A. These dispensers will accelerate the fueling process and help facilitate traffic flow on the site. It will also provide greater ease of use through lightweight nozzles and hoses. A credit card activated or card reader system will be installed to allow for payment at the pump. The dispensers will be moved further apart to allow for easier access to the pumps. The gasoline island canopy will conform to the proposed architecture of the facility. Included in this project are improvements in canopy down lighting to make the fueling area safer. Gasoline service will be available 24 hours per day. All of these improvements are geared towards one goal: to make gasoline purchasing as safe, easy and fast as possible. UNOCAL. FASTBREAK FOOD MART FASTBREAK is an ancillary food mart business operating on the site in conjunction with the primary business of gasoline sales. The floor space will offer pre-packaged food items, beverages,tobacco, beer,wine and other name brand items pre-approved by Unocal. The sale or rental of adult magazines,videos,tapes, discs,or films will not be permitted at FASTBREAK food marts. There will be no coin operated amusement devices or video games on the premises. UNOCAL 76 PROWASH EXPRESS SERVICE CAR WASH PROWASH EXPRESS SERVICE car wash is a car wash business providing superior, convenient,car washing services, using a soft cloth with state-of-the- art environmentally responsible equipment. PROWASH EXPRESS SERVICE features a forty(40)foot soft cloth car wash that cleans the exterior of the car only. Unlike a full-service car wash,the customer remains in the car as the conveyor pushes their car through the tunnel. The exterior of the car is quickly towel dried before the customer leaves the facility. The entire process takes only two(2)minutes,yet the customers receive full-service quality. Key operational features include: • Ability to purchase a car wash at the dispenser,food mart or at the entrance to the car wash. • 80%of the water used is reclaimed. • PROWASH EXPRESS SERVICE will be open from 6:00 a.m. to 8:00 p.m. daily. UNOCAL 76 RESTROOM DESIGN Unocal believes that clean restrooms are an important service to offer to the motoring public. Therefore,the FASTBREAK food mart includes the addition of restrooms for both men and women. Restrooms will be designed in accordance with ADA standards and are located inside the FASTBREAK food mart for safety and convenience. UNOCAL * EXTERIOR LIGHTING UPGRADE This project includes the installation of state-of-the-art metal halide light fixtures which provide high intensity, energy down lighting designed not to impact adjacent properties or public right-of-ways. The improved down lighting will deter loitering and provide a safer, more secure environment for the customer.
