HomeMy WebLinkAbout6.1 HearSaleExcessROWFshry CITY OF DUBLIN —_ it AGENDA STATEMENT - City Council Meeting Date: May 11, 1987 SUBJECT: Public Hearing: Sale of Excess Right-of-Way To The Fishery Restaurant EXHIBITS ATTACHED: 1) Resolution 2) Location Map RECOMMENDATION: 1) Open Public Hearing 2) Receive Staff presentation and public testimony 3) Question Staff and the public 4) Close Public Hearing and deliberate 5) Adopt Resolution approving sale and authorize Mayor to consummate agreement FINANCIAL STATEMENT: 3,671 square feet at $8.50 per square foot = $31,204 DESCRIPTION: On April 27, 1987, the City Council set a hearing date on the sale of .086 acre of City property along San Ramon Road, north of Amador Valley Blvd. , fronting the property owned by The Fishery Restaurant (7400 San Ramon Road). The owners of The Fishery have requested to purchase this property and have agreed to the City's price of $8.50 per square foot so that an independent appraisal is not necessary. The City is required to hold a public hearing in regard to sale of public property. Notice of this hearing was published in the newspaper on May first and posted in the City's three designated locations, as well as on the property itself. Staff recommends that the City Council conduct the public hearing and adopt the resolution approving the sale and authorizing the Mayor to execute the agreement. Ron Rivers RESOLUTION NO. -87 -- A RESOLUTION OF THE CITY COUNCIL ` OF THE CITY OF DUBLIN APPROVING SALE OF CITY PROPERTY TO THE FISHERY AND AUTHORIZING MAYOR TO CONSUMMATE THE AGREEMENT WHEREAS, The Fishery has requested the City to enter into negotiations to sell .086 acre of City property adjacent to San Ramon Road north of Amador Valley Blvd., more particularly described in Exhibit A attached hereto, in conjunction with construction of a restaurant at 7400 San -Ramon Road; and WHEREAS, the City Council established the subject property as surplus on December 22, 1986 and directed Staff to notify appropriate agencies of the City's offer to sell the property; and WHEREAS, said agencies declined interest in purchasing the property; and WHEREAS, on April 27, 1987, the City Council stated its intention to sell the subject property and set a hearing on the matter; and WHEREAS, on May 11, 1987, the City Council held a public hearing, received all protests, and overruled the protests by at least a four-fifths vote; NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council approves the sale of subject City property to The Fishery for the sum of $31,204. BE IT FURTHER RESOLVED that the City Council authorizes the Mayor to consummate an agreement for the sale of subject City property. PASSED, APPROVED, AND ADOPTED this .11th day of May, 1987. CITY OF DUBLIN NOTICE OF PUBLIC HEARING (Continued from Meeting of May 11, 1987) The City Council of the City of Dublin will hold a public hearing regarding the sale of surplus public property, to wit, a parcel of approximately .086 acre, located on the westerly side of San Ramon Road, north of Amador Valley Blvd., and fronting the property owned by the developers of The Fishery Restaurant, more particularly described as follows: Al I that certain real property situtated in the unincorporated area of the Township of Pleasanton, County of Alameda, State of California, described as follows: Beginning at the southeaster corner of land described in the deed from Northern California and Nevada District Council of the Assembl les of God, Inc., to the County of Alameda, filed for record May 30, 1974, in Book 3692 of Official Records at page 960 (Series No. 74-69222), Records of Alameda County, California; thence from said POINT OF BEGINNING along the southerly line of said County of Alameda parcel South 80° 28' 12" West (the bearing of said southerly line taken as South 80° 28' 12" West for the purpose of writing this description) 31.98 feet to the beginning of a non-tangent curve concave to the west having a radius of 278.00 feet, a radial line to said radius point bears North 71° 46' 33" West; thence in' a northerly direction along the arc of said curve 134.66 feet through a central angle of 27° 45' 15" to a point on the westerly line of that certain parcel of land described in the deed from Ernest A. Any persons wishing to protest the sale of said property may do so in person at the meeting or by submitting protests in writing to the office of the City Engineer, 6500 Dub]in Blvd., Suite D, Dublin, CA 94568, prior to the date and hour of said hearing. If no protests are received, or if said protests are overruled by a four- fifths vote of the City Council, the sale will. take place fo]lowing the hearing at the meeting of May 26, 1987.
