Regular Meeting - March 20, 1995
A regular meeting of the City of Dublin Planning Commission was held on Monday, March 20,
1995, in the Dublin Civic Center City Council Chambers. The meeting was called to order at 7:32
by Commissioner Zika.
ROLL CALL
Present: Comtnissioners Zika, Geist, Jennings, Johnson, and Lockhart; Laurence L. Tong,
Planning Director; Dennis Carrington, Senior Planner; Ra.lph Kachadourian, Assistant Planner,
and Gaylene Burkett, Recording Secretary.

Cm. Zika led the Commission, Staff, and those present in the pledge of allegiance to the flag.

The minutes of the March 6, 1995, meeting were approved as submitted.

PUBLIC HEARING

8.1 PA 94-052 CrossWinds Church Exnansion Conditional Use Permit. The
project consists of an expansion of the seating capacit,y of the church auditorium
by 484 peonle at 6444 Sierra Court. This increased expansion will require a
minimum of 81 additional off-site parkin~ s.paces which will be ~rovided on the
adjacent parcel located at 6780 Siena Court. Expansion of the church's seatin~
capaci requires ap~roval of a new Conditional Use Pernut. The existing
Conditional Use Pernut, PA 92-038, which is valid until August 27, 1997, allowed
for the operation of the church with a total seating capaci ,
o,ty f 700 people within I
the auditorium and a minimum of 175 on-site parking spaces. '

Ralph Kachadourian, Assistant Planner, presented the staff report. He stated the additional
parking spaces were required and the Applicant had planned and proposed to have the additional
parking spaces on the adjacent property to the north at 6780 Sierra Court. Since the Church use
was a temporary use until 1997, the installation of the sidewalk would be adequate in lieu of a
traffic impact fee and the Applicant would submit a completion bond to insure the sidewalk
along the frontage of 6780 Sierra Court installation. Staff recommended adoption of the draft
Resolution approving the Negative Declaration and the draft Resolution approving the
Conditional Use Permit.
Cm. Zika asked if the Applicant was present.
ivlarty Cutrone, Executive Pastor for CrossWinds Church, stated he would be happy to answer
any questions the Commission may have.
Cm. Zika asked why they did not obtain a permit before installing the bleachers.
Mr. Cutrone stated Dublin High School made the bleachers available to the Church last summer
and they needed to haul them away immediately, or the School would trash them. He stated they
did not want to leave them outside, but had no other place to store them, so they installed them
and kept them retracted until they received approval.
Cm. Zika asked Mr. Cutrone if he was aware that he did need approval.
Mr. Cutrone stated yes.
Cm. Jennings stated she felt the letter was well written.
Cm. Zika stated that his pet peeve was people doing things without first getting the proper
permission.
Cm. Lockhart asked what would happen if the 6780 Sierra Court property was sold.
Mr. Kachadourian stated that the Applicant had secured written permission from the owners and
since there was an agreement, the new owner would probably come in and discuss the previous
approvals and agreements with Staff.
Cm. Zika asked what would happen if the new owner failed to honor the previous approvals and
agreements.
Mr. Carrington, Senior Planner, stated it could be made a Condition of Approval; however, now
if they did sell the building at 6780 Sierra Court, the new owner could invalidate the agreement
and they could loose the parking spaces.

Cm. Lockhart asked who would install the sidewalk.
Mr. Cutrone staxed there were several options and they would be working with Mr. Kachadourian
on the sidewalk specifications.
Cm. Geist asked if the additional parking needs were just on Sundays and Wednesdays, or are there
other minor functions during the weeknights.
Mr. Cutrone stated they do have other functions on weeknights, but they are not heavy traf~c
functions.
Cm. Zika asked how much was the tra,f~'ic impact fee .
Mehran Sepehri, Senior Civil Engineer, answered he had not computed the traffic impact fees,
because the project was temporary for two years.
Cm. Geist asked what would happen in two years, would the Conditional Use Pernut expire?
Mr. Cutrone stated they were looking for land.
Cm. Zika closed the public hearing.
On motion by Cm. Jennings, seconded by Cm. Lockhart, the Planniug Commission unanimously
voted to approve the draft Resolution adopting the Negative Declaration and approve the draft
Resolution adopting the Conditional Use Permit for PA 94-052.
NEW OR UNFINISHED BUSINESS
9.1 Review of Planning Commission Rules of Procedure
Laurence L.Tong, Planning Director, presented a staff report on Planning Commission Rules and
Procedures. He stated Staffhad prepared a draft Resolution incorparating the potential
amendments so that Planning Commission appointments would be subject to the approval of the
entire Planning Commission, not just on the appointment of the Chairperson. This would provide
some consistency with the process in use by the Mayor and City Council.
Cm. Zika asked when the Planning Commission might be broken into subcommittees.
Mr. Tong stated that to date, the Commission had not had the need, but they may wish to in the
future.
Cm. Zika stated he could see the need on other Commissions, but not the Planning Commission and
did not feel the need.
Cm. Jennings asked how many subcommittees were appointed in the past.
Mr. Tong answered none.

Cm. Lockhart stated in the future, there ma.y be a ne~l for subcommittees.

Cm. Zika. stated that in the past, everyone was invited on field trips, and he wauld like to see it
open to everyone in the future.
~ Cm. Jennings asked if this amendment was to make it more consistent with other rules.
Mr. Tong answered yes, and it was totally up to the Commission.
Cm. Zika stated that he felt it should be open to everyone.
Cm. 7ennings asked if the amendment was to be able to catl on a Commissioner's expertise in a
certain field without having all the Commissioner's getting involved.
Cm. Johnson asked if it was to bring in additional people.
Mr. Tong answered no, that under e~cisting rules, the Chairperson would appoint all
subcommittees.
Cm. Zika stated he had never seen a need, and if one arose, he would ask for volunteers.
Cm. Lockhart stated he felt there may be a need for it in the future.
Cm. Zika stated he did not have a problem with it one way or another.
Cm. Jennings asked if Government Code, Section 54950 would be deleted.
Mr. Tong answered that part of the Code would go unspoken.
Cm. Johnson sta.ted he did not have a problem with appointing Committees.
On motion by Cm. Lockhart, seconded by Cm. Geist, and by mianimous vote, the Planning
Commission voted to adopted the draft Resolution to amend the Pla.nning Commission Rules of
Procedure.
Cm. 7ennings pointed out a few granunatical correctians to be made to the draft Resolution.
Mr. Tong informed the Commissioners that at the upcoming City Council meeting on March 27,
they will hear the Petco appeal and a request from Tru-mark homes for a generaI plan amendment
study initiation.
