The meeting was called to order at 7:30 p.m. by Commissioner North. * * * * * * * * * * ROLL CALL Present: Commissioners Burnham, Downey, North, and Rafanelli; Laurence L. Tong, Planning Director; Dennis Carrington, Senior Planner; Carol Cirelli, Senior Planner; Ralph Kachadourian, Assistant Planner; and Fawn Holman, Recording Secretary. North led the Commission, Staff, and those present in the pledge of allegiance to the flag. * * * * * * * * * * ADDITIONS OR REVISIONS TO THE AGENDA The minutes for March 21, 1994, were approved as submitted. * * * * * * * * ~ ~ ORAL COMMUNICATIONS None * * * * * * * * * * WRITTEN COMMUNICATIONS None * * * * * * * * * * PUBLIC HEARING SUBJECT: P_A 94-010 Classic Auto Center Conditional Use Permit request to allow an outdoor display area for two vehicles to be located within the landscaped area directly in front of the business at 6891 Village Parkway. Cm. North opened the public hearing and asked for the staff report. Regular Meeting PCM-1994-43 May 2, 1994 [5-2min] • • Mr. Ralph Kachadourian, Assistant Planner, presented the staff report, indicating that Staff recommended approval of the Conditional Use Permit. Cm. North asked if consideration was given to people slowing their cars on Village Parkway to view the vehicles on display. Mr. Kachadourian indicated that the Public Works Department had not expressed concern regarding that matter. Cm. North asked if parallel parking, which was currently allowed on the street in front of the building, would remain the same. Mr. Kachadourian indicated that parallel parking would still be allowed. Mr. Jay Rawitzer, Applicant, indicated that potential car buyers had a difficult time finding his showroom because he had no outdoor display and the sign was obscured by trees. Cm. Burnham asked who was responsible for the maintenance/trimming of the trees in front of the building. Mr. Kachadourian indicated that the trees were within the public right-of-way, which made them the responsibility of the City. The Applicant had recently requested that Public Works to trim the trees and, according to the City maintenace supervisor, were scheduled for near-future trimming. Cm. Burnham asked if the vehicles could be brought out the double doors or through the front of the building. Mr. Rawitzer indicated that the main reason raas that the building was not ventilated in such a way to allow starting/driving vehicles inside the building. Even if the doors were wide enough to get a car through, he would have to push the vehicles in and out. Cm. North clarified that the cars displayed in front would be parkecl in back when the store was closed. Mr. Rawitzer indicated that none of the classic cars would be left outside while the store was closed. Cm. Downey asked if the Applicant had considered signs or arrows to bring attention to his business. 1Kre Rawitzer indicated that he was waiting for the Sign Ordiance Amendment to be completed before he made any signage decisions. He indicated that the large sign he currently had was obscured by the City-owned trees. Cm. North asked if the Applicant agreed with the conditions of approval. Burnham, and with a vote of 4-0, the Planning Commission adopted RESOLUTION 94 - O11 APPROVING PA 94-010 CLASSIC AUTO CENTER CONDITIONAL USE PERMIT REQUE8T FOR AN OUTDOOR DI$PLAY AREA FOR TWO VEHICLES LOCATED WITHIN THE LANDSCAPED AREA DIRECTLY IN FRONT OF THE BUSINE88 AT 6891 VILLAGE PARRWAY SUBJECT: PA 93-062 City of Dublin Sign Ordinance Revision Proi,ect proposal to amend the Zoning Ordinance pertaining to the requlation of signs (continued from the 3/21/94 Planninq Commission meeting - to be contined to the 5/16L94 Planninq Commission meetina). Cm. North indicated that Staff recommended that the Commission continue this item to the May 16, 1994, Planning Commission meeting in order to provide time for the City Attorney's comments to be incorporated into the document and to be delivered to the Commission in a timely manner. With a unanimous vote from the Planning Commission, this item was continued to the May 16, 1994, meeting. * * * * * * * * * * NEW OR UNFINISHED BUSINESS SUBJECT: General Plan Conformity for the Santa Rita Commercial Center project located at the southeast corner of Dublin Boulevard/ Hacienda Drive. Cm. North asked for the staff report. Ms. Carol Cirelli, Senior Planner, presented the staff report, indicating that the County planned to dispose of the surplus property and then develop it as a retail/commercial center. Staff recommended approval of the draft resolution finding that the location, purpose and extent of the proposed disposal of Santa Rita lands to be in conformance with the Eastern Dublin General Plan Amendment and Specific Plan and Dublin General Plan. Cm. North asked if the property was included in the Eastern Dublin Environmental Impact Report (EIR). Ms. Cirelli indicated that the property was covered in the Eastern Dublin EIR. Cm. North asked if the County was going to sell the property to Sears. Mr. Tong indicated that the County was negotiating with Homart. Rafanelli, and with a vote of 4-0, the Planning Commission adopted RESOLUTION NO. 94 - 012 REPORT BY THE CITY OF DUBLIN PLANNING COMMI88ION AS TO THE CONFORMITY OF LOCATION, PURPOSE AND E%TENT OF THE PROPOSED DISPOSAL OF SANTA RITA LANDS SURPLUS PROPERTY WITH THE ADOPTED GENERAL PLAN AND EASTERN DUBLIN SPECIFIC PLAN OF THE CITY OF DUBLIN SUBJECT: Tnitiation of Zonin~y Ordinance Amendment StudY rega~rdinc~ Planned Deveiapment Districts. Cm. North asked for the staff report. Ms. Cirelli presented the staff report, indicating that Staff recommended approval of the Draft Resolution Exhibit A initiating the zoning ordinance amendment study to the PD District provisions of the Zoning Ordinance. If the Planning Commission concurred, Staff would ' prepare a study and draft ordinance amending the Zoning Ordinance and schedule a public hearing on May 16, 1994. Cm. North asked if all of the Eastern Dublin lawsuits had been settled. Mr. Tong indicated that the City had won the initial hearing before the judge; the appeal period would expire the first full week of June. On motion from Cm. Rafanelli, seconded by Cm. Downey, and with a vote of 4-0, the Planning Commission adopted RESOLUTION NO. 94 - 013 INITIATING A Z~NING ORDINANCE AMENDMENT STUDY TO SECTION 8-31.0 PD (PLANNED DEVELOPMENT) DISTRICTS OF THE ZONING ORDINANCE * * * * * * * * * * OTHER BUSINESS (Commission/Staff Informational Only Reports) Cm. Downey asked about the removal of trees in the Orchard Supply Hardware center. lder trees had been removed and Mr. Carrin ton indicated that several A 9 would be replaced with 22 Honey Locust trees, which had a more transparent canopy, and shrubbery. The parking configuration of the center was also being modified. Cm. North indicated that the Commission may want to study how much a site can be changed without having to come before the Commission for approval. He expressed concern about such major modifications being made without needing Planning Commission approval. Regular Meeting PCM-1994-46 May 2, 1994 [5-2min] . , , ~ ~ Cm. Burnham asked which city had jurisdiction on Kimball Street. The street did not have striping to indicate where the middle of the street was located. Mr. Tong indicated that the street, from the back of the sidewalk, was entirely within the City of San Ramon; although, the homes were in Dublin. Cm. Burnham asked why the Dublin police would set up their radar on a San Ramon street. Mr. Tong was not aware that Dublin police set up their radar on Kimball Street. He suggested they may be doing it in cooperation with San Ramon police because, even though the street was in San Ramon, Dublin residents access their homes from that street.
