HomeMy WebLinkAboutPC Minutes 04-05-1993 . ~ ~ Regular Meetinq - April 5, 1993 A regular meeting of the City of Dublin Planning Commission was held on April 5,.1993, in the Dublin Civic Center Council Chambers. The meeting was called to order at 7:30 p.m. by Commissioner Zika. ROLL CALL Present: Commissioners Burnham, North, Rafanelli and Zika; Laurence L. Tong, Planning Director; Carol Cirelli, Associate Planner; Ralph Kachadourian, Assistant Planner; and Gail Adams, Recording Secretary. Absent: Commissioner Barnes PLEDGE OF ALLEGIANCE TO THE FLAG Cm. Zika led the Commission, Staff, and those present in the pledge of allegiance to the flag. ADDITIONS OR REVISIONS TO THE AGENDA The minutes for March 15, 1993 were approved as submitted. ORAL COMMUNICATIONS None WRITTEN COMMUNICATIONS None PUBLIC HEARINGS SUBJECT: PA 93-005 Taq's Towinq Canditional Use Permit request to operate a storaqe facility and vard for abandoned, wrecked and inoperative vehicles and for the parking of tow trucks and storage of lonq term recreational vehicles located at 6005 "A" Scarlett Court Cm. Zika opened the public hearing. Mr. Ralph Kachadourian presented the staff report to the Commission and Staff recommended approval of the application. Cm. Burnham felt that there would be various damaged automobiles being stored at the facility. He asked what happens when the site is full. Mr. Kachadourian explained that this was a temporary storage facility, most likely no more than thirty days. Cm. North asked where the vehicles were stored at the present time. . Regular Meeting PCM-1993-17 April 5, 1993 [4-5min] ~ • ~ Mr. Kachadourian indicated they had been stored in Pleasanton and are now being stored at the Dublin facility. He reviewed photos of the site with the Commission. Cm. Zika indicated he had been to the site and observed that there were at least 20 vehicles stored outside with 5-6 of those vehicles with heavy damage. There was also a large tractor outdoors. Would the Applicant be moving the badly damaged vehicles into the building and how many vehicles were allowed on the site? Mr. Kachadourian referred to Condition #3 and indicated only 20 vehicles were allowed to be stored on the site. Cm. North asked for clarification on if there were a maximum of 20 vehicles allowed on the site at any one time. Cm. Zika was concerned that the site would resemble a junk yard with so many vehicles being stored outside the building. Mr. Tong clarified that the intent of Condition #3 was to have no more than 20 vehicles stored outside of the building at any one time. Mr. Kachadourian further clarified that this did not count the long- term storage which would be a separate area. Cm. Rafanelli understood this to mean there could be additional vehicles stored within the building. Mr. Kachadourian indicated this was correct. Cm. Zika asked for clarification on the Zone 7 easement behind the building. Mr. Kachadourian referred to Condition #14 indicating there would be a 15 foot easement behind ~he building; however, the Applicant could utilize the gate area. Cm. Burnham asked about if there was a PGE easement as well. Mr. Kachadourian referred to the site plan indicating where there was a 25 foot easement. Reinie Tagliapietra, Applicant, explained his operation to the Planning Commission. He indicated that the tractor mentioned had been leaking fuel; however has been cleaned up. There were three heavy- damage vehicles that had been moved inside the building and he had spoken to the employees about this concern. He was aware of the 15 foot easement and had no problems with any of the conditions of approval. Cm. Rafanelli asked if there were any concerns with vandalism. He clarified that there should not be any problems with limiting the vehicles outdoors to under 20. There were only eight vehicles out on Thursday. Cm. Zika closed the public hearing. On motion from Cm. Rafanelli (modifying Condition #3 clarifying that the exterior storage area was limited to 20 vehicles), seconded by Cm. North, and with a vote of 4-0, the Planning Commission adopted RESOLIITION NO. 93-011 APPROVING PA 93-005 TAG'S TOWING CONDITIONAL USE PERMIT TO ALLO~ THE OPERATION OF A STORAGE FACILITY AND YARD FOR ABANDONED, WRECRED AND INOPERATIVE VEHICLES AND FOR THE PARRING OF TOW TRUCR3 AND OTHER VEHICLE STORAGE USES SUCH AS LONG TERM RECREATIONAL VEHICLE STORAGE LOCATED AT 6005 "A" SCARLETT COURT SUBJECT: PA 93-008 20/20 Recycle Center Conditional Use Permit recruest to allow the operation of a recycling redemption center for aluminum, plastic and glass beverage containers at the Pak'n Save Shopping Center parking lot located at 6605 Dublin Boulevard Cm. Zika opened the public hearing. Ms. Carol Cirelli presented the staff report and Staff recommended approval of the application. Cm. North asked if this operation would be in conflict with the existing Salvation Army truck located on the site. Ms. Cirelli indicated that the recycling business would be located west of the Pak'n Save building and there would be different items collected. There was a demand for the recycling operation. Cm. North had concerns with the signage on the trailer and indicated that it should indicate that parking is not allowed in the street or drive aisles. He asked if there were any comments received from the Salvation Army. Ms. Cirelli indicated the Salvation Army had no concerns. Cm. Zika asked if there had been any complaints on the recycling center located at Albertsons. Mr. Kachadourian indicated that there was a newspaper recycling operation (Pacific Rim) located at the Albertsons' site. Cm. Burnham asked if there was written permission from the Pak'n Save property owner. Regular Meeting PCM-1993-19 April 5, 1993 [4-5min] , • ~ Ms. Cirelli indicated yes. Also, the public hearing notice was mailed I to all property owners within 300 feet of the parcel. j Cm. Zika asked the Applicant if he had talked to the Salvation Army and if they had any concerns. Doug Bridwell, Applicant, indicated that the Salvation Army had moved ' their operation inside their building and that they are not permitted , to collect glass, plastic and aluminum. The proposed 20/20 Recycling , site was certified by he State of California. Safeway Stores, owners of Pak'n Save, had approached him about utilizing the parking lot for his recycling business. Mr. Bridwell indicated that he had no concerns with the conditions of approval and would like to be notified if any problems arise with the operation of his business. Cm. Zika asked what procedures would be implemented with items that were considered hazardous materials. Mr. Bridwell stated that the site would be steam cleaned on a regular basis and disposable items would be sent to a disposal site. Cm. Burnham asked how often were the recycling bins transferred and what happens when items are left there without personnel. Mr. Bridwell indicated that he would coordinate the transfer setup with Pak'n Save's management. The operation would be manned and monitored. The Pak'n Save store attendants will be responsible for bringing items (if any) in at night and cleaning the site up. There should not be any debris on the site. Cm. North noted to the Staff that the employee located at the Albertson's site did not know where the nearest disposal site for oil was. Mr. Bridwell indicated he would notify the attendant. Cm. Zika closed the public hearing. On motion from Cm. North, seconded by Cm. Rafanelli, and with a vote of 4-0, the Planning Commission adopted RESOLOTION NO. 93-012 APPROVING PA 93-008 CONDITIONAL USE PERMIT REQUEST TO ALLOW THE OPERATION OF A RECYCLE REDEMPTION CENTER IN THE PAR'N SAVE SHOPPING CENTER PARRING LOT, LOCATED AT 6605 DUBLIN BOULEVARD UNFINISHED BUSINESS None Regular Meeting PCM-1993-20 April 5, 1993 [4-5min] II . • OTHER BUSINESS Mr. Tong indicated the City Council had reviewed the Eastern Dublin project on March 30th. They directed Staff to report on Alternative #2 and continued the meeting to April 27th. The item is also referred back to the Planning Commission on May 3rd and will go back up to the City Council on May lOth. Mr. Tong stated that there would be only one item to be reviewed at the April 19th meeting and asked the Commission if they would prefer a meeting on April 19th or wait until the last meeting of May. Cm. North asked how soon the Commission would receive the Eastern Dublin report for the May 3rd meeting. Mr. Tong commented that the staff report would be anywhere from 3-20 pages and there would be a full blown public hearing on May 3rd. The Commission requested that the April 19th meeting be canceled. COMMISSIONER'S CONCERNS Cm. Burnham indicated there seemed to be a lot of misunderstanding regarding the Eastern Dublin plan and clarified that the Planning Commission did not approve the Eastern Dublin plan. Mr. Tong stated that Staff tried to make it clear that the public hearing was for the proposed plan as recommended by the Planning Commission. However, this did not seem to sink in. Cm. North had concerns regarding Wayne's Gun Shop van and felt that this was an inoperable vehicle. Mr. Tong indicated the van was operable; however, would contact the owner.
