The meeting was called to order at 7:30 p.m. by Cammissioner Burnham, Chairperson. * * * * ROLL CALL Present: Commissioners Barnes, Burnham, North and Rafanelli; Laurence L. Tong, Planning Director; Maureen O'Halioran, Senior Planner; David Choy, Associate Planner; Delmar Tompkins, Planning Intern; and Angie Stepp, Recordinq Secretary, Absent: Commissioner Zika * * * * PLEDGE OF ALLEGIANCE TO THE FLAG Cm. Burnham led the Commission, Staff, and those present in the piedge of allegiance to the flag. ADDITIONS OR REVISIONS TO THE AGENDA None MINUTES OF PREVIOUS MEETINGS The Minutes of November 4, 1991 were approved. ORAL COMMTTNICATIONS None WRITTEN COMMUNICATIONS None PUBLIC HEARINGS SUBJECT: PA 91-077 Andre School of Dance Conditional Use Permit approval to allow the operation of a dance studio Icommercial recreationaZ facilityj in a G-2-B-40 General, Commercial Combining District Zone at 7015 Dublin Boulevard Cm. Burnham opened the public hearinq and asked far the staff report. Regular Meeting PCM-1991-144 November 18, 1991 [11-18] ~ ~ ~ Mr. Tompkins presented the staff report to the Commission. He ~ indicated the discovery for a need for a conditional use permit came about as a result of a business license review. He stated the Building Department observed the lack of a required second exit from the facility which made the facility in violation of the Unifornt Building Code. The owner of the property and the Building Department have been in communication with each on this issue and as of last Friday, they have both worked out a solution to this problem. Mr. Tompkins stated the project is in compliance with the Zoning Ordinance and the General Plan. Staff is recommending approval of the Applicant's Conditional Use Permit, subject to the conditions specified in the Draft Resolution (Exhibit B). Cm. North asked if Staff knew if the required second exit has been provided. Mr. Tompkins stated a solution had been worked out by the owner of the property and the Building Department. Cm. North stated the solution was not indicated in the conditions of approval. Mr. Tompkins stated the required second exit was a part of Condition #2 whereby the owner shall comply with all applicable Building and Planning regulations. Cm. Burnham asked if the Applicant was present and wished to make any comments. The Applicant, Beverly Ashour, was present; she indicated the required second exit had been completed as of last Friday. There were no questions from the Commissioners. Cm. Burnham closed the public hearing. On motion from Cm. Barnes, seconded by Cm. North, and with a vote of 4-0, the Commission adopted RESOLUTION NO. 91-058 APPROVING PA 91-077 ANDRE SCHOOL OF DANCE CONDITIONAL USE PERMIT REQUEST TO ALLOW THE ESTABLISHMENT OF A DANCE SCHOOL (COMMERCIAL RECREATION FACILITY) AT 7015 DUBLIN BOULEVARD IN A C-2-B-40, GENERAL COMMERCIAL COMBINING DISTRICT ZONE SUBJECT: PA 91-082 Cast & Company Instructional Dance Studio Conditional Use Permit Cm. Burnham opened the public hearing and asked for the staff report. Mr. Choy presented the staff report to the Commission. Regular Meeting PCM-1991-145 Nove~ber 18, 1991 [11-18] ~ • i , Cm. Rafanelli asked Staff if the noise level in the vicinity of the • intended dance studio will pose a problem to the adjacent residents since the dance studio will remain open until 10:00 p.m. Mr. Choy stated a condition has been placed on the project that the interior noise level be monitored and which prohibits any exterior amplification of noise from the buildinq. Mr. Choy indicated Condition #5 will enable Staff to review the use permit should a problem occur regarding the noise level to adjacent residents or businesses. Cm. Burnham asked if the Applicant was present and wished to make any comments. The Applicant, Mr. Ron Tye, was present, and had no comments. There were no questions €rom the Commissioners. Cm. Burnham closed the public hearing. On motion from Cm. North, seconded by Cm. Rafanelli, and with a vote of 4-0, the Commission adopted RESOLUTION NO. 91-059 APPROVING PA 91-082 CAST ~ COMPANY CONDITIONAL USE PERMIT TO ESTABLISH A COMMERCIAL RSCREATION USE, INSTRUCTIONAL DANCE STUDIO, AT 7232 SAN RAMON ROAD NEW OR UNFINiSHED BUSINESS None OTIiER BUSINESS Mr. Tong stated that at the November 25, 1991 City Council meeting, the Council directed Staff to prepare a resoiution for approval of the Dublin Cinema Sign Variance Appeal and continued the item to the November 25, 1991 City Council meeting with findings of approval for the Variance. The Density Bonus Ordinance will again be taken back to the City Council on November 25, 1991. At the December 2, 1991 Planning Commission meeting, the election of officers will take place. At this time, there are five public hearing items scheduled for December 2, 1991. PLANNING COMI~IISSIONERS' CONCERNS Cm. Barnes stated her only concern was with the Dublin post offiee. She could not understand why a letter mailed from the Dublin City Offices would take two days to arrive at her house in Dublin. She felt Staff was not to blame. Burnham wondered why the Dublin post office has a separate Dublin " post office receptacle since 'Out of town' and 'Local' mail are both ~ routed to the Oakland post office. Cm. North commented that Staff could save clerical expense and postaqe by holding the Planning Commission's mail for the next Commission meeting. Cm. Barnes commented that Appealable Action Letters must be mailed in order for the Commissioners to receive them before the ap~eal time has expired. She noted that not receiving the Appealable Aetion Letters before their expiration date was a previaus Commissioners' concern. Cm. North agreed that Cm. Barnes was correct. Cm. Burnham requested Staff to correct his mailing address on letters from the City. Mr. Tong asked if the letters were mailed by the City and from what City department. Cm. Burnham commented the letters were from all City departments. Mr. Tong requested Cm. Burnham to bring in one of the incorrectly addressed letters so that Staff may track down the mailing source. Cm. Burnham was concerned about Staff delivering the Commissioners' packets late in the evening and inquired about receiving the packets earlier in the day. Mr. Tong explained that many times it is a matter of the various project planners needing to complete their staff reports. He indicated that on occasion there are mechanical problems with the copy machine. Mr. Tonq advised the Commission that Staff has improved the delivery time of the agenda packets over previous years. He indicated that project planners will strive to qet the reports in on schedule and Staff will continue to attempt earlier delivery of the agenda packets.
