Reqular Meeting - April 2, 1990
A regular meeting of the City of Dublin Planning Commission was
held on April 2, 1990, in the Dublin Civic Center Council
Chambers. The meeting was called to order at 7:35 p.m. by
Chairman Burnham, Chairperson.

ROLL CALL
Present: Commissioners Burnham, Mack, and Okun; Laurence L.
Tong, Planning Director; Carol Cirelli, Associate Planner and
Gail Adams, Planning Secretary.
ABSENT: Commissioner Barnes and Zika

PLEDGE OF ALLEGIANCE TO THE FLAG
Cm. Burnham led the Commission, Staff, and those present in the
pledge of allegiance to the flag.

ADDITIONS OR REVISIONS TO THE AGENDA
None
MINUTES OF PREVIOUS MEETING
The minutes of March 19, 1990 were approved.

PUBLIC HEARINGS
SUBJECT: PA 90-011 Medina's Gvm Conditional Use Permit request
for a new chiropractic space in the existing exercise
studio and an extension of PA 87-042 Conditional Use
Permit for the exercise studio located at 6735 Sierra
Court

Cm. Burnham opened the public hearing and asked for the Staff
Report.
Ms. Carol Cirelli presented the staff report to the Commission.
She indicated that the Applicant had concerns regarding two of
the conditions of approval. These conditions would require users
of the chiropractic service to be members of the gym as well as
restrict the chiropractic office from having separate access
limitations.
Ms. Cirelli indicated that the.Applicant was requesting that
family members of the gym also be allowed to use the chiropractic
service.
Ms. Cirelli indicated that Staff was recommending continuance of
this item to the April 16th meeting so that the Applicant could
have his attorney review the application and conditions of
approval.
Cm. Burnham said it was apparent that medical offices were not
permitted in this zoning district, and asked who would be
benefitting from the business, the gym or the medical profession?
Mr. Tong concurred with Cm. Burnham. He indicated Staff had
concerns in regards to the medical office use and wanted the
service to be an ancillary use~for the gym.
Cm. Mack asked that the language in Finding "A" on Exhibit B
should be clarified before the resolution was adopted.
Cm. Burnham asked if Staff was aware of any other gyms in the
area that accommodated chiropractic and/or medical services.
Mr. Tong indicated that Staff was not aware of any, however,
would research various establishments and address the question at
the next meeting.
Mr. Teo Beam, Applicant, indicated that he would like gym members
to be able to have their family members use his services, as well
as handicapped individuals. He was involved with the Special
Olympics and direct access to his medical office would eliminate
wheelchair access conflicts.
Cm. Okun asked if inedical offices were permitted under the
current zoning regulations.
Mr. Tong indicated no, not as a principle use; only as an
accessory use.
Cm. Okun asked the Applicant what the percentage of his patrons
would be gym members versus family members.
Mr. Beam indicated that approximately 50~ of his business would
be used by gym members.

Cm. Burnham asked if Condition #7 could indicate that only gym
members and family members of the gym would be allowed to use the
medical services.
Mr. Tong indicated that this condition could be considered,
however it would be very difficult to determine who was a family
member and who was not.
Cm. Burnham agreed that the chiropractic use should have the same
hours as the gym as well as the access limitation requirement.
Cm. Okun asked Staff where the closest place that would allow
medical office uses.
Mr. Tong indicated that medical office uses were allowed in
designated areas on Dublin Boulevard.
Mr. Tong indicated that if the Commission was not in a position
to make a recommendation, then the Commission should leave the
public hearing open and continue the item to the April 16th
meeting.
Cm. Burnham indicated that he understood the Applicant's position
and would like to see the Commission reach a compromise.
Cm. Mack concurred with Staff's ~ecommendations.
The Commission requested Staff to look into other cities'
requirements and research how many gym facilities had associated
with chiropractic uses.
Mr. Beam asked if the Commission could approve the Conditional
Use Permit at this time to allow the gym facility to continue
their operation.
Staff indicated that the Zoning Investigator would be informed
regarding the continuance of the meeting and the gym would be
allowed to operate until a decision is made.
The Planning Commission kept the public hearing open and
continued the item until the April 16th meeting.
NEW OR UNFINISHED BUSINESS
Mr. Tong indicated that the City Council would be hearing the
second reading for the First Western Planned Development Rezoning
ordinance; considering the Dublin Boulevard Extension General
Plan Amendment and authorizing a right-of-way line study for a
two lane access road out to the east.
Cm. Okun asked if the Bart settlement would affect the extensian.

Mr. Tong indicated that some funding for the extension would be
provided to the City.
OTHER BUSINESS
None
PLANNING COMMISSIONERS' CONCERNS
The Commission and Staff discussed the current zoning ordinance
policies and the possibility of studying future policy changes.
ADJOURNMENT
There being no further business, the meeting was adjourned at
8:20 p.m.
