The meeting was called to order at 7:00 p.m. by Cm. Barnes, Chairperson. ~ ~ ~ ~ ROLL CALL PRESENT: Commissioners Barnes, Burnham, Mack, and Tempel, Commissioner Zika absent, Laurence L. Barnes led the Commission, Staff, and those present in the pled e of g allegiance to the fla . g ~ ~ ~ ~ ADDITIONS OR REVISIONS TO THE AGENDA None. ~ ~ ~ ~c MINUTES OF PREVIOUS MEETING The minutes of the meeting of March 21, 1988, were approved as presented. ~ ~ ~ ~ ORAL COMMUNICATIONS None. ~ ~ ~ ~ WRITTEN COMMUNICATIONS Mr. Tong advised that the Commission had received 7 action letters and 2 notices of appeal. ~ ~ ~ ~ Regular Meeting PCM-8-59 April 4, 1988 ~ ~ PUBLIC HEARINGS SUBJECT: PA 88-003 Villages at Willaw Creek Sign Program Conditional Use Permit and Variance request for directional tract signs and subdivision sale, rent, or lease signs to exceed allowable square footage, height and setback restrictions west of Dougherty Road north and south of Amador Valley Boulevard (continued from meeting of March 7, and March 21, 198$). Cm. Barnes opened the public hearing and called for the Staff Regort. Mr. Barger stated that this application was originally continued from the March 7, 1988, Planning Commission meeting. At that meeting the Planning Commission was unable to make a decision due to disagreements between Staff and the Applicant regarding what types of signs were proposed. The Planning Commission asked Staff and the Applicant to meet to resolve this issue and create a sign program that was acceptable to both parties. On March 9, 1988, Staff and the Applicant met. It was clarified that some of the signs could be designed as subdivision sale/lease/rent signs and other signs as directional tract signs. The Applicant presented a combination of seven signs, some were subdivision sale/lease/rent signs and some were directional tract signs. Of these some would exceed maximum height and copy square footage restrictions, while other may not. This was not acceptable to Staff. On March 14, 1988, the Applicant submitted a revised sign program and on March 21, 1988, the Planning Commission reviewed the revised sign program and determined that three directional tract signs were acceptable and therefore findings in support of the Conditional Use Permit and Variance regarding these signs could be made Mr. Barger petitioned that the public hearing be continued with regard to the subdivision sale/rent/lease signs. The Applicant was on vacation and has requested a continuance of this part of the application. Cm. Barnes closed the public hearing. On motion by Cm. Burnham, seconded by Cm. Tempel and by a 4-0 vote (Cm. Zika absent) a Resolution was adopted to conditionally approve the directional tract signs Variance for the Villages at Willow Creek Road Regular Meeting PCM-8-60 April 4, 1988 • ~ RESOLUTION N0. 8$ - 019 CONDITIONALLY APPROVING THAT PORTION OF PA 88-003 VILLAGES AT WILLOW CREEK ROAD, DOUGHERTY ROAD AND AMADOR VALLEY BOULEVARD DIRECTIONAL TRACT SIGNS VARIANCE On motion by Cm. Mack, seconded by Cm. Burnham and by a 4-0 vote (Cm. Zika absent) it was moved that subdivision/sale/lease/rent signs be continued to the Planning Commission meeting of April 1$, 1988. SUBJECT: PA 88-001 Waseca Kubota Tractors Conditional Use Permit request to allow the retail sale and repair of industrial equipment and maehinery and to allow the outside storage and display of industrial equipment and machinery at 6305 Dougherty Road. Cm. Barnes opened the public hearing and called for the Staff Repo~t. Mr. Barger presented the application which involves Waseca Kubota Tractors Conditional Use Permit request to operate their tractor trailor sales and repair business from the building located at 6305 Dougherty Road in the M-1, Light Industrial Zoning District. They propose to store their equipment on the site, as well as, display four small tractors outside of the building in front of their occupancy. They also propose to advertise their business by using two wall-mounted signs, one on the southern elevation and on on the west elevation. The business presently occupies approximately 5,500+ square feet in this 18,250+ industrial building. The applicant has indicated that he would like to expand his business so that it occupies an additional 2,200+ square feet of floor area within the building. Staff is recomrnending that this expansion be allowed as part of this Conditional Use Permit. Waseca Kubota Tractors has been in business at the subject site since 1986 without Planning Commission approval. The City's Zoning Investigator has been pursuing the owner of this business to get him to apply for a Conditional Use Permit to legalize his business at this location and to deal with the issue of having signs that had not received Planning Department approval. Mr. Barger stated that prior to moving to the Dougherty Road location the business had been operated behind the old Burns European Motors car dealership on Dublin Boulevard and at the end of Golden Gate Drive. The City's Zoning Investigator has indicated that at each site there have been a number of problems with this business concerning storing tractors and equipment illegally in required parking areas, in required yard areas and without the required Conditional Use Permit for outdoor storage and display. Mr. Barger continued with regard to the Conditional Use Permit. The M-1 zoning district allows consideration of the following through the Conditional Use Permit procedure: 1) outdoor storage and display of equipment and supplies if conducted within an area enclosed by a solid wall or fence; and 2) retail sale of industrial equipment and machinery. Regular Meeting FCM-8-61 April 4, 1988 • ~ Staff has visited the site on numerous occasions. Although the majority of Waseca Kubota's wares are stored within an enclosed fenced area on the property, tractors were illegally being stored throughout the site including in the parking lot, access isles, in required yard setbacks and on the Southern Pacific right-of-way. From a land use standpoint, the business is appropriately located. This building contains similar types of tenants. The building was originally approved for industrial uses, but over time, the uses have moved toward heavy commercial. The General Plan designation for the site is Business Park Industrial/Outdoor Storage. The proposed use would be in conformance with the policies of the General Plan. The business would also like to display four small tractors in the landscape planters on the west side of the building. Mr. Barger continued with the following regarding signs. The business has two wall-mounted signs that are illegal and consequently cannot be recommended to be approved. The sign located on the southern elevation is illegal because it is not located on a business frontage occupied by the tenant. The Applicant states that he intents to occupy that space in the future and thus the sign should be allowed to stay. Staff contends that when the business moves into that space, signing can be considered on that frontage through Site Development Review. But until then, the sign must be removed. The sign on the west elevation is illegal because they have not applied for and received Site Development Review approval. Staff recommends that the Commission direct the Applicant to apply for Site Development Review for this sign no later than April 29, 1988. If the application has not been received by this date, the sign will have to be removed immediately. Mr. Barger stated that Staff recommends that the Planning Commission adopt the resolution approving the Conditional Use Permit and direct the Applicant to remove the illegal sign on the south elevation and apply for Site Development Review for the sign on the west elevation no later than April 29, 1988. The Applicant, Mr. Mike Waseca, 6305 Dougherty Road stated he agreed with Staff recommendation and will remove the southern sign. He futher stated that he feels since he is a tractor and not a car sales office that he is more noticable. He mentioned he would like to have some consideration regarding having a location for customers to drap off tractors and that he plans on installing glass on the south side of the building when he expands. He felt that his previous locations made it hard to comply with regulations regarding outside storage. Cm. Mack questioned if Mr. Waseca planned to apply for a Site Development Review for the sign on the west wall. Mr. Waseca stated that yes he will follow through, but thought it was included with the current application. Cm. Mack asked if Mr. Waseca had contacted his neighbors regarding the storage of cars on the site. Regular Meeting PCM-8-62 April 4, 1988 ~ • • Mr. Waseca stated that he had contacted his neighbors but had no authority to have the automobiles removed. Cm. Barnes closed the public hearing. On motion by Cm. Mack, seconded by Cm. Burnham and a 4-0 vote (Cm. Zika absent) a Resolution was adopted approving Waseca Kubota Tractors Conditional Use Permit for 6405 Dougherty Road. RESOLUTIONS N0. 88 - 02a APPROVING PA 88-001 WASECA KUBOTA TRACTORS CONDITIONAL USE PERMIT FOR 6305 DOUGHERTY ROAD SUBJECT: Proposed Plan Line for New Road Parallel to and Southerly of Dublin Boulevard to consider establishment of plan lines for new road between Regional Street and Amador Plaza Road. Cm. Barnes opened the public hearing and called for the Staff Report. Mr. Tong presented this item regarding the proposed parallel road to the south of Dublin Boulevard connection Regional Street to Amador Plaza Road. Mr. Tong stated that a parallel road south of Dublin Boulevard will offer benefits to downtown circulation and traffic flow such as, 1) traffic at major intersections along Dublin Boulevard will be equalized; 2) three long cul-de- sacs will be eliminated, facilitating movement; 3) access from one cul-de-sac to another can be provided without requiring travel on Dublin Boulevard; 4) internal circulation will be provided south of Dublin Boulevard, which will encourage development and additional pedestrian links in the area; and 5) access will be provided to the future BART parking lot frorn three access points. In general, the road will have area-wide cireulation benefits by providing an alternate route. Mr. Tong stated the right-of-way of 65 feet would provide two traffic lanes and a center two-way left turn lane (44 feet) plus parkways on either side. Due to limitations of space between existing buildings, the right-of-way will need to narrow to 64 feet for approximately 600 feet. Mr. Tong stated the roadway will necessitate the removal of 174 parking spaces behind Ross/Orchard Supply and 122 from the front of Unisource, Depending on final design of the roadway, the street may be able to accommodate on-street parking to reduce impacts from the loss of on-site parking. The praject will also reduce the back-up area for truck loading at Unisource. Mr. Tong stated with regard to timing and costs that no precise schedule has been established for constructing the road and estimated costs for sthe road are about $3 million. Mr. Thompson, City Engineer, elaborated further with regard to the proposed roadway and showed on a map the principal property owners and route suggested. Regular Meeting PCM-8-63 April 4, 1988 , • ~ Cm. Burnham questioned if the main reason for the roadway was for BART. Mr. Tong stated that the roadway would benefit BART, but it would also help with the congastion problem that additional development in the area would add to. Mr. Thompson stated the roadway would also allow for a second emergency exit. Harvey E. Levine, Attorney, 720 Knoll Center Parkway, Pleasanton, representing the Woolvertons and Pat Costello (Crown Chevrolet) stated the Woolvertons were not happy with the recommendations for the roadway. He stated that equalizing traffic, development in the area, and BART were of no benefit to the Woolvertons. Mr. Levine asked that an alternative route for the roadway be researched that would be more of a benefit to the Woolvertons and Mr. Costello. Sharon Slater, P.O. Box 1267, Lafayette, CA, Bedford Properties, was concerned with the fact that the road was very close to the Unisource building, and stated she would like to ask for a continuance for a inore thorough review. Cm. Burnham asked why the roadway was planned using this particular route. Mr. Thompson stated several alternatives were considered and that this was Staff's recommendation. Cm. Barnes closed the public hearing. Sharon Slater, stated she had just received the Staff recommendation and would like more time to review the report that there could possibly be a problem with future tenants in that particular building. Mr. Thompson stated he had met several time with Pat Fell, Bedford Properties and she said she would rather have the City propose an alignment. Cm. Burnham stated that due to the Enea property settlement we seemed to be stuck with the road location. Mr. Tong stated that TJKM had reviewed the road location along the Flood Control Channel and found it difficult to access along Regional Street and Amador Plaza Road and that it would be developed on only one side. Cm. Burnham stated he felt the roadway needs more study. Cm. Barnes felt the alignment of the road was not good for Crown Chevrolet, and that it needed more study. Cm. Tempel felt there shauld be more study. Cm. Mack also felt the issue needed more study. Regular Meeting PCM-8-64 April 4, 1988 . ~ ~ On motion by Cm. Tempel, seconded by Cm. Mack, and a 4-0 vote (Cm. Zika absent) it was moved to continue the roadway item to the May 2, 1988 Planning Commission meeting. ~ ~ ~ ~ NEW BUSINESS OR UNFINISHED BUSINESS None. ~ ~ ~ ~ OTHER BUSINESS Mr. Tong stated that the Shell Oil Sign Variance Appeal and Howard Johnson Sign Variance Appeal will be heard at the next City Council meeting. ~ ~ ~ ~ PLANNING COMMISSIONERS' CONCERNS Cm. Tempel had no concerns. Cm. Burnham questioned the sign ordinance and if there was any way to keep from having problems with certain type signs and the possibility of adapting to these types of signs. Mr. Tong stated a survey can be made of surrounding cities with regard to "stock national signs" and what is being done in other jurisdictions with regards to these types of signs. Cm. Mack asked why the cornpanies do not present sign at the time of application. Mr. Tong asked what types of signs the Commission was interested in seeing. Cm. Barnes stated stock signs from parent companies. Cm. Mack had no concerns. Cm. Barnes questioned the status on the access agreement between Target and Albertson's.
