' Regular Meeting - November 21, 1988 A regular meeting of the City of Dublin Planning Commission was held on November 21, 1988, in the Meeting Room, Dublin Library. The raeeting was called to order at 7:00 p.m. by Cm. Barnes opened the public hearing and called for the Staff Report. Ms. 0'Halloran indicated that this application had been continued from the November 7, 1988 meeting and that the Commission had directed Staff to contact the Applicant and School District requesting their attendance at the November 21st meeting. Ms. 0'Halloran indicated that the Applicant was requesting approval of a Conditional Use Permit to modify Condition #27 (Resolution No. 87-059 of PA 87-103) which required installation of a masonry or prefabricated concrete wall with a 6' minimum height abutting existing or future residential uses. This approval would allow the Applicant to use a chain link fence with redwood slats. Ms. 0'Halloran indicated that at the last meeting Mr. George Garrett, a resident on Aldea Street, was opposed to the Applicant's request to install the chain link/redwood slat fence instead of the concrete wall. He also expressed his concerns regarding the bus mechanic shop directly behind his property that had a noisy generator which he believed the concrete wall would screen. Ms. 0'Halloran indicated that the Planning Commission had closed the public hearing at the last meeting and recommended re-opening the public hearing in order to accept public testimony. Cm. Zika asked if a cover could be put over the air compressor. Ms. 0'Halloran stated that this could required as a condition of approval. Cm. Zika and Ms. 0'Halloran discussed the angle and height of the fence. Mr. Halim Aksoy, Applicant, explained the wall heights and variations in height with the Planning Commission and indicated the fence areas on the wall map. Cm. Burnham asked about the 5' easement and if there would be two fences at this spot. Cm. Burnham asked about the 55 gallon storage tank. Ms. 0'Halloran indicated that Condition #19 restricts storage within 10 feet from the property line. The Zoning Investigator can check the situation. Regular Meeting PCM-7-208 November 21, 1988 • • Stanley Maleski, Dublin School District, indicated that the compressor was not used very much and for not more than 30-60 minutes at a time. He stated that the time slot of when the compressor was in use could be altered to satisfy the property owners. Mr. Garrett, 8095 Aldea Street, indicated that he was under the impression that there would be only one fence, not two. Mr. Maleski explained that the original use permit required a concrete block fence which would be 5' back from the property lines. The chain link fence would have remained on the property line and there would have been two fences. Cm. Zika indicated that Condition #27 stated the fence would "abut" the property line. Ms. 0'Halloran indicated that there was some flexibility in the conditian as the condition stated "The exact location of this wall may vary according to the arrangements made between the subdivider and the respective adjoining residential property owners". Crn. Burnham indicated he would like to see some kind of retaining wall. Cm. Barnes indicated her concerns over the chain link fence and redwood slats and would like to see something better. Ms. 0'Halloran indicated that Condition #2 of the draft resolution, which amends Condition #27, can be modified by the Planning Commission. Cm. Zika asked Mr. Garrett what the property owners would like to have. Mr. Garrett indicated he would like to see the concrete wall constructed. Mr. Maleski indicated that some of the fence is still in good shape. The property owners would like to have a concrete wall because it would increase the property value; however that was not the school's responsibility. He stated he would like to be a good neighbor and could consider a wooden fence. Cm. Burnham asked what the legal standpoint would be in the maintenance of the fence. Ms. 0'Halloran indicated that if the fence is required as a condition of approval as a project fence, the maintenance would be the Applicant's responsibility. Mr. Aksoy indicated that a concrete wall cannot be built on an easement. The fence would be moved back 5' and when referring to Parcel #10, the wall would be built 14' back. Cm. Mr. Aksoy indicated that there were no plans to enclose the compressor. Cm. Barnes closed the public hearing. Cm. Zika asked what kind of condition of approval would be needed to require the enclosure of the air compressor. Ms. 0'Halloran indicated that a Condition #3 could be added to the resolution. Mr. Barger indicated that a sound meter could be used to indicate noise levels and a condition could be added to require noise levels to be within General Plan guidelines and can be reviewed and approved by the Planning Director. Cm. Burnham indicated he would like to see a wood fence instead of the proposed cyclone fence. Cm. Zika asked if there could be a condition of approval requiring the property owners acceptance. Ms. 0'Halloran indicated that a declaration of the property owners could be required. Condition #27 could maintain a wood fence and this condition could be re-worded. Cm. Burnham asked why the Applicant should be responsible for the fence. Ms. 0'Halloran indicated that it is typical for an Applicant-to be responsible for fencing required as a condition of approval for the project. Cm. Zika asked if there could be a condition saying that the wood fence which would be replacing the cyclone fence was a one time offer. Cm. Barnes indicated that she wanted the fence to look good from all sides. Cm. Zika and Ms. 0'Halloran discussed the wording of Condition #27A. Ms. 0'Halloran stated the wording for Condition #27A could be as follows: 27.A. The Applicant shall install a 6 foot tall uniform wood fence along that portion of the project's boundary which directly abuts existing or planned residential uses subject to review and approval of the Planning Director. Said fence shall be installed as a one time offer at the residential property owners option. Prior to installation of the fence the Applicant shall provide written notification to the abutting property owners of the proposed fence. The Applicant shall submit to the Planning Director a signed statement from the effected property owners acknowledging receipt, review and understanding of the new fence proposal and indicating whether they choose to have the fence installed. The timing of the installation of the wood fence shall be generally consistent with the timing of installation of perimeter landscaping called for in Condition #58 for Tentative Map 5616 (Planning Commission Resolution No. 86-053). ~~~~~~~~~~~~~*~~~~~~~~~~*~~~~~~~~~*~~~~~*~~~~*~~*~~~~~~*~~~~~~~~~~~~~~~**~r~~~~ Regular Meeting PCM-7-210 November 21, 1988 • • On motion from Cm. Zika, with modifications to Condition #27A as stated and the addition of a condition requiring the Applicant to enclose the compressor unit to visually and acoustically screen the unit subject to the Planning Director and Building Official satisfaction, seconded by Cm. Burnham, with a vote of 4-0, the Planning Commission adopted RESOLUTION N0. 88-066 APPROVING PA 88-098 DUBLIN SCHOOL DISTRICT CONDITIONAL USE PERMIT MODIFYING CONDITION #27 OF PLANNING COMMISSION RESOLUTION N0. 87-059 SUBJECT: 87-172 Dublin High School Conditional Use Permit to Al1ow the Continued Use of a Mobile Home on the Dublin High School Site for Occupancy by Security Personnel at 8151 Village Parkway Cm. Barnes opened the public hearing and called for the Staff Report. Mr. Barger indicated that this application was for a Conditional Use Permit to allow the continued use of a mobile home on the Dublin High School site for security personnel. Mr. Barger indicated that the mobile home has been on the school site since 1977 with use permit approvals being issued up to September 10, 1983. After this date, however, the permit was no longer valid and the mobile home has been on the site since 1983 without approvals from the City. Mr. Barger indicated that the Zoning Investigator had been pursuing the School District to get them to apply for a permit and an application°was submitted to the Planning Department in December of 1987. This application was not complete. The Dublin Unified School District was created at this time and the application was finally complete in October of 1988 and was now ready for approvals. Mr. Barger indicated that the single wide mobile home was located on the south eastern portion of the site and was not readily visible from the streat or from adjacent residences. Mr. Barger indicated that there was a family of four residing in the mobile home and this provided 24 hours a day, 7 days a week security for the school grounds and facilities. Mr. Barger indicated that there were two tool sheds located adjacent to the mobile home and can be approved as part of this permit. Mr. Barger indicated that there was various debris accumulating around the mobile home and there was a condition of approval requiring the removal of this debris. ~~~t~~~*~~~~~~c~~~~~~~~~~~~~t~~~~~t~~~~~~~~~~~~~c~~*~~~~~~~~~~~~~~~~~~~~~~c~~~~~t*~~~ Regular Meeting PCM-7-211 November 21, 1988 , • ~ Mr. Barger indicated that this proposal had been reviewed by all departments concerned and there were no complaints received. The Planning Department recommends approval of this application subject to the conditions of approval shown in the draft resolution. Cm. Zika asked if the tool sheds were metal buildings. Mr. Barger indicated that the one shed had wood shingles and the other was made of a metal similar to the mobile home. Cm. Burnham asked why it took so long to have the permit approved. Mr. Barger said that it was an oversight on part of the City and a lack of response from the School District. Cm. Burnham agreed that the debris should be cleaned up. Cm. Barnes closed the public hearing. On motion from Cm. Burnham, seconded by Cm. Mack, with a vote of 4-0, the Planning Commission adopted RESOLUTION N0. 88 - 067 APPROVING PA 87-172 DUBLIN HIGH SCHOOL CONDITIONAL USE PERMIT REQUEST TO ALLOW THE CONTINUED USE OF A MOBILE HOME ON TAE DUBLIN HIGH SCHOOL SITE FOR OCCUPANCY BY SECURITY PERSONNEL AT 8151 VILLAGE PARKWAY SUBJECT: PA 88-091 Villages at Alamo Creek Conditional Use Permit Req;uest to Al1ow Modifications to Specific Conditions of the Original Planned Development and Tentative Tract Map Extension Request for Trct 5511 at Dougherty Road and Amador Valley Boulevard Cm. Barnes opened the public hearing and called for the Staff Report. Mr. Barger indicated that on March 24, 1986, the City Council granted approvals for a Planned Development (PA 85-041.1) and Tentative Map (PA 85- 041.2) for the Villages at Alamo Creek project. Mr. Barger indicated that the Applicant is requesting a modification to Conditions #46c and #53 of the Planned Development through the Conditional Use permit process. The Applicant is also requesting a time extension to Master Tract Map 5511. Mr. Barger indicated that the original Condition #46c required the Applicant to have a signal installed at Amador Valley Boulevard and Dougherty Road prior to occupancy of more than 300 units. The Applicant is requesting the signal to be completed by December 31, 1988. This request is acceptable to the Public Works Director and Planning Department. Regular Meeting PCM-7-212 November 21, 1988 ~ • / ' • ~ Mr. Barger indicated that Condition #53 required the developer to construct two additional lanes along Dougherty Road prior to the occupancy of 650 units. The Applicant is requesting that the road be completed within 180 days of removal of utility services. The Public Works Director indicated that the relocation of the PG&E facilities is scheduled to be complete in early spring of 1989. The Public Works Director recommends that the extension be granted so that the road be completed within 60 calendar days of removal of the utility services or prior to the occupancy of 650 units, whichever occurs last. Mr. Barger indicated that a revision to the draft resolution had been made since the Staff Report was written. Condition #53 would state that the 90 day period may be extended an additional 90 days, at the discretion of the Public Works Director, and a letter requesting this extension is required at least two weeks prior to the expiration of the initial 90 day extension. With respect to the Tract Map Extension, Mr. Barger indicated that the City Council approved Tentative Map 5511 on March 24, 1986 for the Villages and this approval was valid to September 24, 1988. The Applicant submitted a request for a two-year extension on August 29, 1988. Mr. Barger indicated that the Subdivision Ordinance states that the approval period for tentative maps is 2-1/2 years and an extension can be requested for a total period of 3 years. Mr. Barger indicated that there were tract maps still to be filed and finaled under Tract Map 5511, and Staff was in support of the extension request. Staff is recommending that the extension be granted for three years instead of two years. This extension would expire on September 24, 1991. Cm. Zika asked how many units were occupied at this time. Ron Nahas, Applicant, stated that there were approximately 270 units occupied within the Villages. Mr. Nahas indicated that he concurred with Staff on their recommendations and appreciated the Staff's additional time allotted. Cm. Barnes asked what the description of a"unit" was. Mr. Barger indicated that a unit meant a house, apartment, townhomes, etc. Mr. Nahas indicated that the signal arms were up and underground in. He foresaw no problem with the December 31st deadline. Cm. Barnes asked what was holding up the two lane extension on Dougherty Road. Mr. Nahas indicated that the existing utility lines are in the median and when the road alignment occurs, the median is not always correct. Mr. Nahas stated that he was in the middle of negotiations to remove what is there (cable, bent poles, etc.) and until this problem was corrected, the work cannot be done. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~r~c~~~~~~~~~~~~~~~~~~~~~~~~~~~~t~~~~r~~~~~~~*~~~~r~~~~ Regular Meeting PCM-7-213 November 21, 1988 i • Mr. Barger indicated that the utilities are to be removed by spring of next year. Cm. Barnes asked what time period did Mr. Nahas expect on the completion of the road. Mr. Nahas indicated that he was looking at next summer. Cm. Barnes indicated that she liked the project, however had concerns on the traffic at Dougherty and Amador Valley. Mr. Nahas reiterated that the work should be done by next summer. Cm. Barnes closed the public hearing. Mr. Burnham asked who was responsible for the retaining wall in front of the Arroyo Vista project. Mr. Nahas indicated that project was the City's. On motion from Cm. Mack, with modifications to Condition #53, seconded by Gm. Zika, with a vote of 4-0, the Planning Commission adopted RESOLUTION N0. 88 - 068 APPROVING PA 88-091, VILLAGES AT ALAMO CREEK CONDITIONAL USE PERMIT TO ALLOW MODIFICATIONS TO CONDITIONS OF APPROVAL #46G AND #53 OF PA 85-041.1 (CITY COUNCIL RESOLUTION N0. 3L-86) On motion from Cm. Zika, seconded by Cm. Burnham, with a vote of 4-0, the Planning Commission adopted RESOLUTION N0. 88 - 069 APPROVING PA 88-091, VILLAGES AT ALAMO CREEK, TENTATIVE MAP EXTENSION REQUEST FOR MASTER TRACT 5511 OF PA 85-041.2 (CITY COUNCIL RESOLUTION N0. 32-86) ~ ~ ~ ~ NEW BUSINESS OR UNFINISHED BUSINESS SUBJECT: PA 87-031 East Dublin General Plan Amendment/Specific Plan Studies and En~ironmental Impact Report. Review of the Administrative Draft Goals Policies and Ob_jetives of the East Dublin General Plan Amendment Mr. Barger indicated that this item was originally scheduled for the November 21, 1988 Planning Commission meeting, however, Staff had determined that a thorough in-house review must take place first. Mack had concerns over the newspapers' outlook on the City's housing developments. Cm.
