Regular Meeting - August 20, 1984 A regular meeting of the City of Dublin Planning Commission was held on August 20, 1984, in the Meeting Room, Dublin Library. The meeting was called to order at 7:30 p.m. by Cm. Alexander, Chairman. * * * * ROLL CALL PRESENT: Gommissioners Alexander, Petty, Mack, Barnes, and Raley, Thomas P. DeLuca, Associate Planner, and Laurence L. Tong, Planning Director. * * * * PLEDGE OF ALLEGIANCE Chairman Alexander, led the Commission, Staff, and those present in the pledge of allegiance to the flag. * * * * MINUTES OF PREVIOUS MEETING The minutes of the regular meeting of August 6, 1984, were approved as corrected, with Chairman Alexander noted as being absent. * * * * ORAL COMMUNICATION None * * * * WRITTEN COMMUNICATION 1) A Communication from the Fair Political Practices Commission was distributed to all the Commissioners. 2) Mr. Tong read an announcement regarding a Planning Commissioner's program at the State American Planning Association Conference to be held on Friday, September 14, 1984, from 12 noon to 5 p.m. at the 0akland Hyatt. Regular Meeting PCM-3-88 8/20/84 C ` • ~ * * * * PUBLIC HEARING SUBJECT: PA 84-041 Valley Christian Center, Conditional Use Permit Mr. Tong noted that the applicant had requested a continuance of this application. The Planning Commission decided to continue the application until the September 4, 1984 Planning Commission Meeting. PUBLIC HEARING SUBJECT: PA 84-045 Waseca Tractor Sales, Conditional Use Permit and Site Development Review Modification, 6797 Dublin Boulevard Mr. DeLuca presented the Staff Report which was a request by Mike Waseca for a Conditional Use Permit and Site Development Review Modification to allow tractors sales at 6797 Dublin Boulevard. Mr. DeLuca noted that Staff had no problems with this application provided that all sales, servicing and displays be conducted inside the building. Mike waseca, applicant, addressed the Planning Commission and stated that he agreed with the Staff Report, however, he noted that his tractors range in size up to 89 H.P. Tom Huening, owner, addressed the Planning Commission and stated that other than one item, he was in agreement with the Staff report. That one item was the replacing of the two damaged trees noted in the Staff report. Mr. Huening felt that additional time should be given to allow the trees to return to a healthy condition. Commissioner Raley indicated that he felt the trees would return to a normal vigor if given some additional time. It was moved by Commissioner Raley and seconded by Commissioner Barnes that the Planning Commission adopt the resolution approving Mike Waseca's request for Conditional Use Permit and Site Development Review Modification to allow tractor sales at 6797 Dublin Boulevard with the following changes to Condition 4 to read: 4) Should the two damaged trees not return to normal vigor by 8/1/85, the property owner shall replace the trees in kind within 60 days thereafter. RESOLUTION NO. 84-41 APPROVAL OF PA 84-045, MIKE WASECA'S CONDITIONAL USE PERMIT AND SITE DEVELOPMENT REVIEW MODIFICATION TO ALLOW TRACTOR SALES AT 6797 DUBLIN BOULEVARD SUBJECT: PA 84-043 Zoning Ordinance Amendment regarding Arts and Crafts Fairs Mr. Tong presented the Staff report which was a zoning ordinance amendment which would allow Arts and Crafts Fairs which meet specified criteria. Mr. Tong noted that the ordinance amendment would allow an Administrative Conditional Use Permit to be issued for one Arts and Crafts Fair per year, per site, which is sponsored by a bona fide church, school, neighborhood group or local non-profit non-restrictive civic or service organization for the sale of handmade, handcrafted items by the original artist. The ordinance amendment would require a Conditional Use Permit for Arts and Crafts Fairs up to a maximum of four days per year, per site, also sponsored by a bona fide church, school, neighborhood group, or local non-profit, non-restrictive civic or service organi zation . Commissioner Raley questioned whether all Arts and Crafts Fairs could not be located inside a building, such as Heritage Park or Shannon Center. Mr. Tong noted that Staff initially directs the various artists to the Heritage Park or Shannon Center, so that such activities could be conducted inside. It was moved by Commissioner Petty and seconded by Commissioner Mack to recommend to the City Council that the ordinance be adopted. Voice vote found all in favor except Commissioner Raley. RESOLUTION NO. 84-43 RECOMMENDING APPROVAL OF PA 84-043, ZONING ORDINANCE AMENDMENT REGARDING ARTS AND CRAFTS FAIRS Regular Meeting PCM-3-90 8/20/84 . ~ • SUBJECT: PA 84-044, Zoning Ordinance Amendment regarding Newspaper Recycling Bins Mr. Tong presented the Staff report which was a zoning ordinance amendment establishing procedures and regulations relating to newspaper recycling bins. Mr. Tong noted that the Council had previously directed Staff to draft such an ordinance to clarify the regulations and procedures related to newspaper recycling bins. Mr. Tong amended the Staff report and ordinance during the presentation to clearly specify that the amendment would relate directly to non-profit groups and would not require visual screening. Mr. Tong further noted that precautions would be taken to ensure that the newspaper recycling bins do not become unsightly or accumulate an excessive amount of debris around them. The Planning Commission indicated their support for the resolution and ordinance provided that precautions would be taken to ensure that newspaper recycling bins are handled in an attractive manner. It was moved by Commissioner Petty and seconded by Commissioner Barnes to recommend to the City Council that the ordinance be adopted with the following changes: Section 1 under Item 1, eliminate three words; °both", "commercial" and "and", Under item 2, eliminate the word "screening". Under item 3, eliminate the words "commercial and". Under Section 2, amend the second sentence to read "The term Recycling Center does not include any processing activity, nor does the term recycling center include a single recycling bin permitted as an Administrative Conditional Use." Under Section 3, change the wording to read; "A single newspaper recycling bin for up to one year, sponsored by a bona fide church, school, neighborhood group or local non-profit non- restrictive civic or service organization, as an accessory use to a lawfully existing permitted use. Voice vote found all in favor. Regular Meeting PCM-3-91 8/20/84 ~ i , ~ ~ RESOLUTION NO. 84-42 RECOMMENDING THAT PA 84-044, AN ORDINANCE RELATING TO NEWSPAPER RECYCLING BINS BE APPROVED * * * * UNFINISHED BUSINESS None * * * * NEW BUSINESS None * * * * OTHER BUSINESS The Commissioners directed Staff to look into the following items: 1) Outdoor display for Schwinn bicycles on Amador Valley Boulevard. 2) Status of Winning Action Investments 3) Abandoned cars at the Mobile Gas Station on Village Parkway. 4) Permitted locations for Recreational Vehicles. * * * * ADJOURNMENT There being no further business, the meeting was adjourned at 9:25 p.m..
