Regular Meeting - August 19, 198~
A regular meeting of the City of Dublin Planning Commission was
held on August 19, 1985, in the Meeting Room, Dublin Library. ,
The meeting was called to order at 7:35 p.m, by Commissioner '
Alexander, Chairman.

PRESENT: Commissioners Barnes, Petty, Raley, Chairman Alexander
and Laurence L. Tong, Planning Director and Kevin J. Gailey,
Senior Planner.

Cm. Alexander led the Commission, Staff, and those present in the
pledge of allegiance to the flag.

MINUTES OF PREVIOUS MEETING
The minutes of the regular meeting of July 15, 1985, the
adjourned meeting of July 18, 1985, the adjourned meeting of.
August 5, 1985, and the regular meeting of August 5, 19$5, were
approved as submitted.

ORAL COMMUNICATION
Ms. Beth DeRoos requested the Commission direct Staff to
investigate the "no turn on red" sign at the intersection of
Amador Valley Blvd, and the entrance to Dublin Place Shopping
Center as relates to its height on the pole and problems with its
visibility.

WRITTEN COMMUNICATION
Mr. Tong advised the Commission that a letter from Francis Mulson
regarding agenda item 8.1 - Kaufman & Broad had been received.
It was decided that discussion on the letter should be put off.
until that item was considered. Mr. Tong also indicated that a
brouchure detailing the U.C, extension course entitled "Planning
Commission's Institute" had been included in the Commission's
packet.

PUBLIC HEARING
7.1 PA 85-058 Jay & Veena Kinhal Conditional Use Permit to allow
continued operation of a daycare center for a maximum of 34
children at 7890 Oxbow Lane (continued from Planning
Commission meeting of August 5, 1985).
Cm. Alexander opened the public hearing and called for the Staff
report.
Mr. Tong presented the Staff report and indicated that the
correct site address was 7890 Oxbow Lane, not 7872 as was
incorrectly indicated on the agenda. Mr. Tong indicated that the
use of the site as a daycare extended back to a Conditional Use
Permit approval by Alameda County in 1973 which was followed by
extensions in 1975 and 1980.
Mr. Kinhal, applicant, gave a brief presentation and indicated
she was in concurrence with the Staff report recommendations.
On motion of Cm. Barnes, seconded by Cm. Raley, voice vote found
unanimous approval to close the public hearing.
Cm. Raley indicated that a minor adjustment to Condition #4 in
the Draft Resolution for this item should be made to make it
reflect the expressed intent of the Commission regarding child-
abuse informational counseling programs.
On motion of Cm. Barnes, seconded by Cm. Raley, voice vote found
4-0 in favor of adopting Resolution No. 85-045 amended to reflect
the adjustment requested by Cm. Raley.

APPLICATION TO ALLOW THE CONTINUED OPERATION OF
A PRESCHOOL AT 7890 OXBOW LANE

7.2 PA 85-065 Eagle's Nest Christian Fellowship Conditional Use
Permit for operation of a church and ministry center at 6700
Sierra Lane.
Cm. Alexander opened the public hearing and called for the Staff
report.

Mr. Gailey advised the Commission that the applicant, Mr. Gary
West, had called that afternoon and indicated they were
considering requesting a withderawl of the application. Mr. West
indicated that an alternate site for their facility was being
considered. To keep their options open, Mr. West requested the
item be continued to the meeting of October 7th.
On motion of Cm. Petty, seconded by Cm. Raley, voice vote found
4-0 in favor of continuing the item to the Planning Commission
meeting of October 7, 1985.

NEW BUSINESS
8.1 Appeal of City Staff's determination regarding days and
hours of construction activity for the Kaufman and Broad
Silvergate Highlands single family residential project.
In acknowledgement of the presence of individuals in the audience
in attendence to speak on Item 8.1, it was the consensus decision
of the Commission to alter the agenda order and consider Item 8.1
prior to the public hearing for Item 7.3 PA 84-077 Zoning
Ordinance Amendment Regarding Sign Regulations.
Mr. Gailey briefly summarized the information contained in the
Staff report for this item and indicated that Staff's
recommendation was that the request to allow work to occur on
Saturday's at the Silvergate Highlands project not be approved.
Mr. Ron Grudzinski, of the firm of Kaufman and Broad, made his
presentation to the Commission and listed the following items he
felt should be considered by the Commission;
1. The process of site development will involve a change
to status-quo and a short term inconvenience to the neighbors.
2. Their development is'in keeping with the approvals
granted to date.
3. Use of Saturdays will speed up the construction time-
frame for the project and allow a recouping of lost time
resulting from ground water problems encountered on the site
during the early phases of development.
4. The Staff really has no option but to stay with
existing policy, which would prohibit weekend work.
5. Kaufman and Broad could accept the four restrictions
for weekend work outlined in the Staff report, if the Commission
saw merit in the request.

The matter was opened up for comment from members of the
audience.
Mr. Charles Menchel, Ladera Court, commented on previous problems
related to this site, specifically mentioning dust and
construction activity earlier than the 7:30 a.m. time limit or
later than the 5:30 p.m. time limit.
Ms. Mary Jane Hyde, Mancini Court, advised the Commission roeeCtd
problems with dust and the lack of the "target-date" for p j
completion.
Mr. Gordon Bower, Estrelia Court, recommended the request be '
denied based on Kaufman and Broad's poor track record as regards
violations to the conditions governing construction activity and
due to their unwillingness to follow through with committments
made to neighboring property owners. Mr. Bowen questioned why
extra help couldn't be hired for the Monday to Friday
construction period to accomplish the same end result the weekend
work would provide.
Mr. John Walford, Estrelia Court, indicated a concern that the
operators were not willing to work with the neighbors and be open
about what they were doing. He stated that there are implicit
developer responsibilities and obligations tied into the
development of a project adjoining existing residences.
Ms. Georgia Menchen commented on dust problems existing at this
site and about construction noise on weekends from hand held
tools being as much an imposition on the neighbors as heavy
equipment.
Mr. Thomas Duda commented on grading behind his lot and concerns
he has about the provision of drainage to carry this work through
the winter months.
In response to Cm. Raley's question, Mr. Grundzinski indicated
the completion date for paving of public streets is October l,
1985.
Discussion continued about the use of water trucks to control
grading, the length of time to complete the construction, and the
types of craftsmen Kaufman and Broad would like to have on the
site if Saturday work was allowed.
In rebuttal to the comments raised, Mr. Grudzinski indicated the
restriction on Saturday was not an ordinance restriction, but a
policy established over time by the City Council. He indicated
that other work in the City is occuring on Saturdays.
The letter from Francis Mulson regarding this item was summarized
for the record. Mr. Gailey advised that the Planning Department
had received three phone calls from neighbors voicing objections
to the proposed Saturday construction.

Commissioners Raley and Barnes voiced concerns about any work on
weekends. Cm. Petty indicated he could see benefits from
speeding up the total construction period by allowing Saturday
work.
On motion of Cm. Raley, seconded by Cm. Barnes, voice vote found
3- 1(Cm. Petty dissenting) to deny the appeal by Kaufman and
Broad of Staff's determilnation regarding days and hours of
construction activity at the Silvergate Highlands project.

7.3 PA 84-077 Zoning Ordinance Amendment Regarding Sign
Regulations (continued from Planning Commission meetings of May
6, May 20, June 3, July l, July 5, July 18 and August 5, 1985).
Cm. Alexander opened the public hearing and called for the Staff
report.
Mr. Gailey presented the Staff report beginning with a summary of
the most recent, major modifications contained within the
"working copy" of the sign regulations, which covered Sections 1 ~
through 7 of the draft regulations.
These major modifications were indicated to include;
- revisions to the Definitions Section to reflect the
revised method of calculating allowable aggregate signage.
- revisions to Section 4 dealing with wall mounted signs
(plugging in new method of calculating allowable aggregate
signage) and freestanding signs (to include parcels 1.5 acres and
greater in size among those parcels who can request freestanding
signs from 20' to 35' in height through the Conditional Use
Permit process).
- revisions to Section 7 regarding the Administrative
Conditional Use Permit (ACUP) and the Conditional Use Permit
processes for temporary signs.
The Commission reaffirmed their consensus position that
freestanding signs be tiered into the following two categories;
1) 20' maximum city wide, and 2) 20' to 35' range through the
Conditional Use Permit process for all parcels four acres in size
or greater and single-use parcels 1.5 acres in size or greater.
The Commission expressed a desire to retain the ACUP process for
grand opening temporary signs (up to 30 consecutive days of
signage within 60 days of a bonafide grand opening).
Discussion continued into the remaining portions of the draft
regulations, commencing with Section 8- Enforcement and
Penalties. Mr. Gailey underscored the three year amortization
period with the option of requesting three additonal years for
modification or elimination of non-conforming signs.

The Commission indicated a desire to have the ordinance
explicitly prohibit billboard signs.
Discussion on Section 9- Amortization-Non-Conforming Signs and
Section 10-Amendment and Repeal. Severability was limited to
brief overviews of the contents of the respective sections.
Following a brief discussion between the Commission and Staff, it
was determined that Staff would return to the Commission meeting
of September 3, 1985, with a completed "Working Copy" covering
Sections 1 through 10 and a first draft of support graphics. The
Commission meeting of September 17, 1985, would be used for
finalization of the Commission's review of the draft sign
regulations.

OTHER BUSINESS
Mr. Gailey advised the Commission of the actions taken by the
City Council at their hearing of August 12, 1985 (Hatfield,
Veach, Rafanelli and Nahas Parcel Map/park location and Bedford
Properties Rezoning).
PLANNING COMMISSIONER'S CONCERNS
Cm. Raley inquired as to the status of the Sawmill sign.
Cm. Raley filed a zoning complaint involving exterior storage of
video games on the front yard of a residential property on the
west side of Hansen Drive south east of Amarillo. A second
complaint was issued involving the dilapidated sign at the top of
Dillon Way visible from I-580.
Cm. Barnes commented on problems on noticing sent with incorrect
zip codes,
