Regular Meeting - November 21, 1983
A regular meeting of the City of Dublin Planning Commission was
held on Monday, November 21, 1983, in the Meeting Room, Dublin
Library. The meeting was cailed to order at 7:30 p.m. by Cm.
Vonheeder, Vice-Chairman.

PRESENT: Commissioners Alexander, Vonheeder, Petty, Mack, and
Laurence L. Tong, Planning Director.
ABSENT: Commissioner Tenery

Cm. Vonheeder led the Commission, Staff, and those present in the
pledge of allegiance to the flag.

MINUTES OF PREVIOUS MEETING
The minutes of the regular meeting of November 7, 1983, were
approved as written.

PUBLIC HEARING
PA 83-059 BUSICK PROPERTIES
CONDITIONAL USE PERMIT
Mr. Tong introduced the item, which was an application for a
Conditional Use Permit to allow an outdoor storage yard, and to
allow materials to be stacked higher than six feet in the yard.
He noted that other applicants in the Scarlett Court area had

been granted Conditional Use Permits for outdoor storage, along
with improved landscaping and architectural building treatments,
and it was Staff's recommendation to approve the Conditional Use
Permit with the conditions of approval contained in the draft
resolution.
The applicant was not in attendance, at the time, and there were
no comments from the audience. The public hearing was closed for
Commission discussion.
Cm. Petty questioned whether or not this was the first business
which was required to landscape, as a result of an application.
Mr. Tong responded that all recent applicants in this area have
been required to provide a minimum of 20 feet of landscaping,
while this applicant was being required to provide only a 10-foot
buffer, which may be reduced to 5 feet, if a 5-foot sidewalk is
provided.
During the discussion, the applicant (Ms. Doreen Green) arrived
and wished to comment on the conditions of approval. The public
hearing was reopened, and the applicant presented to the
Commissioners a letter, along with photos of the property, and
requested that the Conditional Use Permit be granted without any
of the conditions of approval set forth by Staff.
It was clarified that Ms. Green objected to all five of the
conditions of approval.
After the public hearing was closed, it was ascertained that the
conditions of approval for this application were less than those
of other applicants in that area, and that other applicants have
already begun complying, after recent approvals.
The question of exact distance between the existing fence, in
relation to required landscaping, was brought up, and there
appeared to be no exact measurement available at this time. Ms.
Green stated she would not object to a continuance to allow her
to have the area surveyed.
Cm. Alexander made the motion that an accurate survey of the area
in question be made before the Commission rendered a decision on
the application, thereby continuing the action to a later date.
Cm. Mack seconded the motion, and it was carried by unanimous
vote of the Commissioners present.

PA 83-068 RESURRECTION CHURCH CHZLD CARE CENTER
CONDITIONAL USE PERMIT
Mr. Tong explained the application for a Conditional Use Permit
to allow an additional child care facility at the Lutheran Church
of the Resurrection, in order to double the attendance capacity

~ at the site. He noted that Staff recommended that the Planning
Commission approve the Conditional Use Permit subject to the
conditions of approval as drafted.
Elaine Skloot, representing the Church, was on hand to address
the Planning Commission briefly, noting that any changes to the
facility would be interior al~terations only.
Elizabeth Schmitt, present in the audience, encouraged approval
of the application.
After the close of the public hearing, and a brief discussion,
Cm..Alexander moved for approval of the resolution approving the
Conditional Use Permit. Cm. Mack offered a second to the motion,
and it carried with unanimous vote of the Commissioners present.

APPROVING PA 83-068 LUTHERAN CHURCH OF THE RESURRECTION
CONDITIONAL USE PERMIT TO ALLOW THE CONTINUED OPERATION OF A
DAYCARE FACILITY IN A PLANNED DEVELOPMENT DISTRICT

NEW BUSINESS
Cm_ Alexander c~ueried Staff regarding the "locked fence blocking
the pedestrian walkway at Payless".
Mr. Tong responded that a Conditional Use Permit was approved 5-6
years ago, by Alameda County, to enclose the area for a nur_sery.
He assured the Commission that the owner had been contacted for
compliance with the conditions of approval of that application.
Cm. Vonheeder questioned Staff, and a discussion ensued,
regarding the differences between various types of outdoor sales
which require an Administrative Conditional Use Permit; a
Conditional Use Permit; or no permit at all.
Cm. Vonheeder requested Staff to provide the Commissioners with a
sample of the application for various types of permits, to
determine whether or not the form is easy to understand and to
comply with. Mr. Tong noted that all requirements on the
application are necessary and realistic, and agreed to provide a
sample application.

Cm. Alexander requested a discussion regarding enforcement of no
parking in fire lanes. Mr. Tong stated that the District Fire
Department is working on the issue, since the Ordinance adopted
by the City does not address it.
Cm. Petty asked when the next General Plan meeting would take
place, and Mr. Tong advised the Commission that Working Paper 3
had arrived and suggested a special meeting for its review.
November 29, 1983, was selected for the meeting, which wi11 be
held at the Dublin Library, at 7:30 p.m. The item was continued
until the November 29th meeting.

OTHER BUSINESS
The question of the debris collecting around the Good Will drop-
off point was discussed. It was noted that this type of facility
; did not require a Conditional Use Permit, and was allowed as an
accessory use. Maintenance concerns could be reviewed on a case-
by-case basis.
Mr. Tong informed the Commissioners that the City Council
approved the H&H Development, and K&S Development, applications,
as recommended by the Commission.
He further noted that LAFCO held a meeting on November 17, 1983,
regarding Dublin's sphere of influence, and continued the matter
to December 15, 1983. The City Council maintained its original
position regarding the area involved.

There being no further business, the meeting was continued at
8:30 p.m. until 7:30 p.m., November 29, 1983, at the Dublin '
Library.
