HomeMy WebLinkAboutPC Minutes 08-15-1983 • ! _ Regular Meeting - August 15, 1983 A regular meeting of the City of Dublin Planning Commission was held on Monday, August 15, 1983, in the Meeting Room, Dublin Library. The meeting was called to order at 7:30 p.m. by Cm. Tenery, Chairman. * * * * ROLL CALL PRESENT: Commissioners Alexander, Mack, Vonheeder, Petty, Tenery and Laurence L. Tong, Planning Director. * * * ~ PLEDGE OF ALLEGIANCE Cm. Tenery led the Commission, Staff and those present in the pledge of allegiance to the flag. * ~ * * MINUTES OF PREVIOUS MEETING The minutes of the regular meetings of July 18, and August l, 1983, were approved as written. * * * ~ ~ f ~ ~ ~ ~ ~ _ ~ . ~ ~ ORAL COMMUNICATION None * * * * WRITTEN COMMUNICATION None * * * * UNFINISHED BUSINESS None * * * * PUBLIC HEARING PA 83-037 PET MEDICAL SERVICE CONDITIONAL USE PERMIT Mr. Tong introduced the item, explaining that the applicant wished to operate a series of low-cost pet vaccination clinics. Staff's recommendation was to approve the Conditional Use Permit subject to conditions. David McClun, D.V.M., applicant, was present in the audience to explain the function and purpose of the vaccination clinic service. William R. Evans, D.V.M., of the Parkway Veterinary Clinic, was also present and pointed out that for a relatively small application fee, an out-of-town business would be allowed to come into the City, while established veterinarians, who support local schools, businesses, etc., are subject to local taxes and restrictions. He suggested that if Conditional Use Permits for this type of service were approved, they should be subject to a higher tax or fee. During the discussion that followed Cm. Alexander expressed concern over the need for the frequency of clinics during the eight month period. There were also questions posed to both veterinarians present regarding price comparisons for the vaccination services, and number of pets vaccinated at each clinic. The Commissioners were also concerned about supporting Dublin's local businesses. Cm. Alexander made the motion to approve the Conditional Use Permit, with the stipulations that: l) clinics be held only in September, 1983, and January, and May, 1984; 2) add Condition 8: ~ • Issue a list of owners of pets vaccinated at clinic sessions to local animal control; and, 3) add Condition 9: Notify owners when new vaccination due. The motion died for lack of a second. Cm. Petty motioned, with Cm. Alexander's second, approve the Conditional Use Permit, with the addition of the above mentioned Conditions 8, and 9, but allowing the four clinics proposed by the applicant. Cm. Alexander, again, stated that he was not in favor of allowing as many as four clinics within an eight month period, while Cm. Petty stated that, in his opinion, it should be left to the businessman's discretion. Cm. Tenery mentioned that none of the local veterinarians have offered a low cost service of this type. Mack, Alexander, Vonheeder Mr. Tong informed the applicant of appeal procedures. * * * * PA 83-040 TRI-VALLEY CHURCH OF GOD CONDITIONAL USE PERMIT Mr. Tong explained the applicant's intention to conduct a school and church using some of the buildings on the Fallon School site. He recommended approval of the Conditional Use Permit subject to conditions of approval. Mr. Raymond Cooper, Associate Pastor, appeared for the applicant and pointed out that there appeared to be more parking available on and near the site than Staff might be aware of. He also questioned the church's obligation for landscaping and tree planting, and requested that the number of students permitted be increased to 120. Arthur Kraus, a Larkdale Ave. resident, was present and objected to the use of the site as another school and church. A question was posed by Mr. John Collins as to whether the play field would be closed to the public. Mr. Cooper assured the Commission that the field would remain open to the public, under the terms of the lease. The parking situation was of major concern, and Staff suggested the addition of the following statement to Condition 5: "There shall be no parking in any of the residential areas." ~ ~ ~ There was also a concensus of opinion that Item 10, regarding the planting of trees on the site, should be struck from the Conditions of Approval. Cm. Vonheeder made the motion, with Cm. Petty's second, to approve the Conditional Use Permit, with the deletion of Item 10; changing the maximum number of students to 120, in Item l~ and adding the suggested statement to Item 5, regarding parking. The motion passed by unanimous vote of the Commission. * * * * PA 83-043 KALEIDOSCOPE CENTER CONDITIONAL USE PERMIT Mr. Tong explained that this Conditonal Use Permit was much like that of Tri-Valley Church of God, in that Kaleidoscope Center applied for use of a portion of the Fallon School site, but that neither use would in any way interfere with the other. Ms. Evelyn King, Executive Director of Kaleidoscope Center was present to discuss the proposal with the Commissioners. The same question arose regarding the obligation of the Kaleidoscope Center to plant trees (Conditions of Approval, Item 10). Additionally, Ms. King queried the Commissioners as to whether the limitation of the number of children on the premises to 5O would exclude the possibility of inviting other disabled youth groups to visit the center. It was ascertained that the limit of 50 children referred to the number of enrolled students only. Cm. Vonheeder made the motion to approve the Conditional Use Permit, with the deletion of Item 10; adding the sentence: "There shall be no parking in any of the residential areas" to Item 5; and rewording Item 1 to read: "Number of children on the premesis at any one time, on a regular basis, shall not exceed 50." The motion was seconded by Cm. Alexander and passed by unanimous vote of the Commissioners. * * * * NEW BUSINESS PA 83-045 HERITAGE COMMONS MODIFICATION OF 1497th ZONING UNIT Mr. Tong introduced the item, explaining that the applicant wished to modify a portion of the general provisions of the 1497th Zoning Unit. He noted that the applicant requested a finding that the proposed modification be considered minor. Staff, however, recommended that the Commission determine that the proposed modification would materially change the approved ~ , Cm. Tenery noted that there appeared to be no hazard from the artillery range located at Camp Parks.
