HomeMy WebLinkAbout09-22-1998 PC MinutesA regular meeting of the City of Dublin Planning Commission was held on Tuesday, September 22, 1998, in the Dublin Civic Center City Council Chambers. The meeting was called to order at 7:00 p.m. by Chairperson Jennings. ROLL CALL Present: Commissioners, Jennings, Johnson, Hughes, Musser, and Oravetz; Eddie Peabody Jr., Community Development Director; Dennis Carrington, Senior Planner; Jeff Ram, Senior Planner; Anne Kinney, Assistant Planner; Michael Porto, Planning Consultant; and Gaylene Burkett, Recording Secretary. PLEDGE OF ALLEGIANCE TO THE FLAG Cm. Jennings led the Commission, Staff, and those present in the pledge of allegiance to the flag. The minutes from the August 11, 1998 meeting were approved as submitted. ADDITIONS OR REVISIONS TO THE AGENDA - None ORAL COMMUNICATIONS - None WRITTEN COMMUNICATIONS - None PUBLIC HEARING 8.1 PA 98-052, Zoning Ordinance Amendment to Chapter 8.136, Appeals. Proposed amendment to the appeals procedure. Cm. Jennings opened the public hearing and asked for the staff report. Dennis Carrington, Senior Planner, presented the staff report. He gave a brief description on the reasons for the proposed amendment to the appeals procedure. Dennis stated 5 things that would change. Under processing of appeals there is a strikeout underlined paragraph which shows the differences. Staffproposed if the matter is not heard within 45 or action taken within 75 days of action .......... similar page to page 8 of ordinance. Mr. Peabody explained what there was the need to do this. Cm. Hughes asked if there was any presidence for this. Mr. Peabody stated this was very commmon. When we changed the ordinance in 1996, this section was not clear. Cm. Hughes asked if any other city had this cituiation. johnson called San Ramon and they have a system where the Council member can bring up an item, but cannot vote, and he did not see that here. Cm. Johnson felt that ifa Council brings up an appeal, they should not be able to vote on it. Planning Commission Meeting 78 September 22, 1998 Mr. Peabody stated we had talked with the city attorney, and in mos tcities, Council can call something up and the presumption ofbisas is not there. Cm. Johnson did not have an objection of them caling some item up, but felt it was not fair to have them vote on it. Cm. Oravetz asked if the Planning Commission does not approve it, what is the next step. Mr. Peabody stated they would have to deny or modify the request, it will go on to City Council anyway. Cm. Jennings asked if anyone wished to give public tesimoney on this. hearing none she asked if there were any questions for stff. musser felt eddie ws correct and most cities are like this. Cm. Hughes made a motion to to make a change to modify section 04062. He felt if the person brings up the appeal, they cannot vote on the appeal, motion to recommend adopotion with change, johnson 2nd. On motion by Cm. rh, seconded by Cm.dj , and with a vote of 3-2, with Jenings and musser opposing.the Planning Commission unanimously adopted RESOLUTION NO. 98- 8.2 PA 98-042, San Ramon Valley Shopping Center Planned Development Rezone. CONTINUED TO THE OCTOBER 13~ 1998 MEETING) johnson moved, oravetz 2nd. unaious to continue to next meeting (THIS ITEM HAS BEEN 8.3 PA 98-046, Morgan Stone's Lube 'N' Latte, Conditional Use Permit (CUP) and Site Development Review (SDR) for a 4, 344 square foot drive-through auto business providing oil changes, routine car maintenance and coffee bar service. The property is located at 7375 Amador Valley Boulevard, (APN 941-175-2 I-2). The property is zoned C-N Neighborhood Commercial Zoning District. Cm. Jennings opened the public hearing and asked for the staff report. Anne Kinney, Assistant Planner, presented the staff report. She gave a brief history of the project. She stated the project had gone through various She stated staff recommends aproval with conditions. Cm. Oravetz asked why the adjacent tenant was not interested in entering into a parking agreement. Morgan Stone, stated it came down to price. He offered $200 for 6 spaces, but he is waiting to see if additional spaces are required and will ask for a larger price. Cm. Jermings asked if people could come up and buy a latte without getting the lube servie. Mr. Morgan said not, it was for customer only. They aticipate 37-42 per day and the aerage is one hour. At the end of the Planning Commission Meeting 79 --Aagt~,, 1998 day, there will not be any cars left on the property. He had pictures of a shop in Antioch wich showed how the building looked out there. Cm. Oravetz asked what other services they provide. morgan stated that they do not advertise any thing but lube, it will be up the employee to make the sale and make the service, depending on their qualifiications. His services are longer and cost more. He said they get referrals from oil change only business because he can offer other services to the customer. Johsefphe destpeno, felt there is enough fast foods, and something more efficient. There was enough fast drive through place and did not fee that we need any more. Cm. Jennings closed public hearing. Cm. Oravetz said the task force has spoken alot about area. and he asked if any other folks have been looking at this property and what else can go there. He wants downtown dubllin to look like downtownn pleasanton or downtown danville. Mr. Peabody stated he had not spike with anyone on any other ideas. This site is very small, and not enough room for any size building. It is a tough site to put anything on unless it is a small use. That may be why it is sat vacant for so long. Cm. Hughes stated 3 of the 4 comers have always been automotive. He felt this looks better what is in that area. He like the concenpt. Cm. Johnson did not have a problem with the project. Cm. Jennings said there was a latte in the next parking lot. Cm. Hughes felt it would not impact the other latte business because it is a drive up, and the applicant answred the question about competition with oil changers. Cm. Jennings asked where would the cusomers go if the car was finished and they were not done with their latte. mr. morgan stated there are 8 bays and the customer does not want to hang around, and their car would sit in the bay until the customer would take it. Cm. Oravetz said it may fit in well, but we are trying to change the image of that area. Cm. Hughes had concerns if this project does not go through, it may become another service station. This is different from that and much better than the delapitated service station that was there. ms. stephanao asked if it is approved, why does it have to go 7 days per week. mr. morgan stated he is in the convenicne business, and people are willing to pay for better service. He wants to offer conveniance and have a comfortable atmophere for this customer. It is a conveniance location, he wants to just show the good side of the building. He wants it to be a good service to offer the entire valley. Mechanics can make up to $50,000 per year and the only noice would be a compressor inside the building and insulated. Cm. Jennings asked if it was a one way in and one way out. anne said yes. she talked about the adjoining property. fm shared Cm. Oravetz concerns. He felt we did not need another oil changer. He was concerned about the parking, he did not like the roll up doors, or improving the appearance of the use, it would be helpful. He liked the curved fasade on the comer. He was not sure this was the right use for dublun Planning Commission Meeting 80 ~Augu:t I~,, 1998 Duluca is the dentist next store, said parking was bad. He said he has two of his employees parking in the lot and there may be a problem for people to park and ifa patient takes a spot, there may be probje. He had a potential noice concern for a dental and chiropractic paitients. Cm. Hughes asked if the cars on the right hand side were on the property site. anne stated yes. Cm. Hughes says no matter what you have,, you are going to have at least 6 employees and parking will be a problem. Noise seems to be taken care of. It comes down to if this business is consistent with the area. It is not even part of the downtown. Cm. Oravetz stated the whole area is considered downtown, the citizens are not going to draw a line and say oil changes are in the downtown and this site not. johnson felt this was a higher type service and looks good and we do not have another use to go in there. How long to we wait. This is here now, on the edge of downtown, and it looks good. On motion by Cm. hughes, seconded by Cm. johnson and with a vote of 2-3,, the project is denied for lack of a majority vote., RESOLUTION NO. 98-38 8.4 PA # 98-035, Tassajara Meadows Planned Development (PD) Rezone, Site Development Review and Vesting Tentative Map. The property is located on the north side of Gleason Drive, west side of Tassajara Road, south of Casterson property (Alameda County Surplus Property Authority - Site 1); ASSESSOR PARCEL #: 986-0005-003- 01 (11.7 _+ acres) The proposed development is located within the Eastern Dublin Specific Plan area and involves a Planned Development Rezoning, a Vesting Tentative Map, and Site Development Review for 95 small-lot detached homes. Cm. Jennings asked for the staff report. Tasha Huston, project planner, gave a briefdesciption of the project. There was one minor change to the develoopment plan standards. It should change fromk 109 to 95 units alowed on the project. pat cashman, project director, of emerald glem development, this is the 9th project, and thre is 5-6 more. This one project touches the other He urged favoriable consideration. Jill Williams, AJKM, architects of the project. This is a continuation of the Casterson site. She explained some of the features of the project. em. Jennings asked about the driveways being 18'. It appears that the distance between the garage and street scene, it 18' enough. Mr. Peabody said a modern Lincoln Continental is 18'. It is a good length. Cm. Oravetz asked if they were private streets maintained by the homeowners association. jill said yes. mussers asked the street section width. Connie, McKay and Somps, said there ae two different street sections on this porject. 36 feet curb to curb, the loops are 30' curb to curb. Planning Commission Meeting 81 -:arz~l~:~, 1998 Cm. Oravetz asked if it would be two separate homeotnwers associates john wong from msision peaks home said the set up is for two homeowners, but when all the owners move in, the goal is to have one. tasha said the whole development is Tassajara Meadows with a unit 1 and unnit 2 so they feel comfortable as a whole community. johnson asked something about parking. Mr. Peabody stated that we spend an enormous amount of time on this site. john wong said the cc&r excludes anyother other than cars park in the garage includingn boats. Cm. Jennings asked where other projects were, fremeont and san jose, and milpitas. Cm. Oravetz asked if landscaping will be installed. john said front yard would be landscaped by the builder. Cm. Jennings askedifther was club house or pool. connie said there was passive open space, but no active recreation. Cm. Jennings asked if we saw anything like this at our last field trip. tashsa said the Belvadee in Pleasanton as the closest. Also Stoneridge place and the Villa's, but they were higher density and not full driveways. Cm. Jennings asked if the street names hae been names. Mr. Peabody said no, the street names have to be submitted to the post office and other cites for approval. public heaqring was closed. On motion by Cm. Oraetz, seconded by Cm. Hughes, with change to page one exhibit a-2, and with a vote of 5-0, the Planning Commission unanimously adopted RESOLUTION NO. 98- Mr. Peabody briefly went over the upcoming schedule for the Planning Commission. He stated that that the field trip had been changed to October 10, 1998. We will be heading downn to San Jose. If you cannot make it, please let Gaylene know. Cm. Johnson asked of purple pipe is being required in all developments. Mr. Peabody stated to parks and schools and site Cm. Johnson asked who was paying for it Planning Commission Meeting 82 August 11, 1998 eddie said the developer was paying in the development and zone 7 in the infrastructure. Maria, you can put the fish story in if you want to. did wonders abut the cost of the water. There was a descrepency in the cost. He thought she said is was cheaper. I need to check to see what she said. gaylene went over the new format, of the staff report. Cm. Jennings felt it was easier and thanked staff. Cm. Johnson asked abut church meetings in neighborhood and if the same t6raffic issues apply. Mr. Peabody stated no, it is different.
