Since this item was noticed as a Public Hearing item for August 20, 1990 Planning Commission meeting, Staff recommends the Commission open the Public Hearing and accept any public testimony. The use, if permitted under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improvements in the area, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clause or performance standards established for the district in which it is to be located, in that conditions have been applied to insure conformance with the Zoning Ordinance. - 1 - - 03 - BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve Conditional Use Permit PA 90-053 as shown by materials labeled "Exhibit A" stamped approved and on file with the Dublin Planning Department, subject to the following conditions. CONDITIONS OF APPROVAL Unless otherwise specified, the following conditions shall be complied with prior to establishment of use. Each item is subject to review and approval of the Planning Director unless otherwise specified. 1) PA 90-053 is approved for the placement of a 4 foot x 8 foot directional tract sign on the vacant lot on the east side of San Ramon Road, north of Dublin Boulevard and the Chevron Service Station (APN 941-305-34). The use shall generally conform to the plan submitted with PA 90-053, dated received June 29, 1990, Exhibit A, on file with the Dublin Planning Department and subject to conditions of approval. 2) The sign shall have a maximum single-faced area of 32 square feet (a double faced sign with a maximum area of 32 square feet on each sign face may be used) and a maximum height of 12 feet. 3) The tract sign shall not obstruct the visibility of motorists, pedestrians or cyclists. Any relocation of the sign shall be subject to review and approval by the Planning Director prior to being moved. 4) This approval shall remain in effect until August 30, 1992, or until the last lot/unit is sold, whichever occurs first. 5) The Applicant shall remove said sign and the entire sign support structure upon expiration of this Conditional Use Permit approval. 6) In satisfying Condition #6 of PA 88-058, the Applicant posted a security deposit with the City of Dublin on August 16, 1988 in the amount of $500.00 to secure the faithful performance of Condition #5 (removal of sign). Said security deposit shall guarantee that these funds will be available and that the instrument of credit will remain effective until September 30, 1992, at which time the security deposit will be returned to the Applicant. 7) This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. APPLICABLE REGULATIONS: Section 8-87.60 A) requires the approval of a Conditional Use Permit for a Directional Tract Sign in any district. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. ENVIRONMENTAL REVIEW: This project has been found to be Categorically Exempt under Section 15301, Class 1(g) of the California Environmental Guidelines (CEQA). NOTIFICATION: Public Notice of the August 6, 1990, hearin was in the local newspaper, mailed to adjacent g publishedn propert public buildings. y owners, and posted in -2- W 19 • ANALYSIS: The Applicant is requesting renewal of a Conditional Use Permit (PA 88-058) to allow one Directional Tract Sign for Kildara residential development project on the currently undeveloped parcel located on the east side of San Ramon Road, north of Dublin Boulevard and the Chevron service station. The existing sign is a 10 foot tall, single faced sign with a total of 32 square feet (4 feet x 8 feet) of sign area identifying the name of the subdivision and directions for reaching the development. The sign is perpendicular to San Ramon Road with a 5 foot setback from the south side property line. The proposed sign is set back approximately 25 feet from the front property line. Also existing on this site is a Directional Tract sign for the Torrey Pines development. This sign, which was posted by another sign company, is illegal as there has not been an application filed, nor a Conditional Use Permit approved. Kildara estimates that their model home complex will be in use for approximately one year. The resolution grants a two year time period for the Conditional Use Permit, which is standard for this type of permit. On August 18, 1988, the Applicant posted a security deposit in the amount of $1,000.00 with the City of Dublin in order to guarantee the removal of both this sign and a similar Kildara sign approved under PA 88-059. The $500.00 portion of the deposit intended for the sign being considered with this application is still being held by the City and will continue to apply to this sign until the signs removal. This application has been reviewed by other departments, and applicable conditions of approval are included in the resolution to address their concerns. The undeveloped lot has been used for the storage of construction materials and has supported other Directional Tract Signs in the past. The proposed sign is consistent with the City's Zoning Ordinance in all aspects (size, height, location and sign content). Staff recommends approval of the Conditional Use Permit to continue this use. ANALYSIS: On May 18, 1987, the Planning Commission approved PA 87-019, which (per Conditions of Approval #34) allowed the use of a 18' x 23' raised concrete pad within the parking lot area of 6044 Dougherty Road, occupied by Dublin Kawasaki, to display motorcycles for sale. This approval expired May 28, 1990. On July 17, 1989, the Planning Commission approved a request to establish a 6,244 square foot auto brokerage use within an existing auto center located at 6032 Dougherty Road, and to allow the use of five on-site parking spaces to store and display automobiles for sale. This approval (PA 89-072) expires on July 26, 1992. On May 23, 1990, the Applicant submitted a Conditional Use Permit request for the combined renewal of PA 87-019 and PA 89-072 as a single Conditional Use Permit to continue use of exterior storage, display and sale of motorcycles, jet skis and new automobiles. The hours of operation for the outdoor display of the motorcycles and jet skis are from 8:30 a.m. to 6:00 p.m., and the outdoor display of a maximum of five (5) new cars occurs on a continuous basis (24-hours a day). The operation of the exterior storage and display of automobiles (PA 89-072) has not changed from the previously approved Conditional Use Permit. However, the operation of the exterior storage of motorcycles has changed from the previous approval. Condition of Approval #34 states that with the exception of authorized motorcycle display, all demonstrations, displays, services, and other activities associated with the new structure shall be conducted entirely within an enclosed structure. Any additional car or motorcycle sales involving exterior display shall be subject to approval of a separate Conditional Use permit. During Staff's review of the site, it was noted that a large area directly behind Dublin Kawasaki is being used to store vehicles to be worked on (see Staff Study, Attachment #3). The use of this area is in conflict with the previous Conditional Use Permit approval in that the area was not designated for outdoor storage or parking of motorcycles or other items. Moreover, Dougherty Regional Fire Authority expressed concern with this practice and the absence of a "no parking fire lane" (as required by the California Vehicle Code) on the north and west sides of Building B, where Dublin Kawasaki is located. Dougherty Regional Fire Authority indicates that the outdoor storage in the rear of the building may occur, provided the minimum "no parking" fire lane is maintained to the satisfaction of Dougherty Regional Fire Authority. A condition is included in the Draft Resolution requiring review and approval of the fire lane and storage/parking area by the Planning Department and the Dougherty Regional Fire Authority. During Staff's review of the site, it was noted the pavement areas in front of Buildings B and C are cracked (see Staff Study, Attachment #3). The Public Works Department had determined that this - 3 - 03 evidence of pavement failure is occurring at drainage area low points where new and old pavement meet. The Applicant indicates that they are in the process of repairing the failed pavement area. The application has been reviewed by other departments and agencies and applicable conditions are included in the Resolution. In the past three years, the Applicant has operated in compliance with the previous Conditional Use Permit requirements with exception of the storage/parking area behind the Kawasaki dealer. There is no record of any zoning violation complaints. The proposed use is consistent with the City's General Plan and Zoning Ordinance. Staff recommends approval of the Conditional Use Permit subject to the conditions included in the draft resolutions of approval . RECOMMENDATION: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimoney from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt resolution approving PA 90-040 , or give Staff and Applicant direction and continue the matter. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: A. The use is required to serve a public need in that it provides a wider range of vehicle sales services to the residents of the City. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 90-040 Amador Automotive Center EXHiBIT Conditional Use Permit as generally shown on the attached plan (Exhibit A) dated received July 12, 1990. CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. 1. PA 90-040 Conditional Use Permit approval is for a) the use of five (5) on-site parking spaces to display and store automobiles for sale, b) to allow the exterior storage, display and sale of motorcycles and jet skis within an 18' x 23' raised concrete pad within the parking lot area at the northeast corner of Building B, and c) for the use of an exterior storage/parking area in the rear of Building B as generally indicated on the plan labeled Exhibit A dated received July 12, 1990. 2. No more than five (5) automobiles shall be stored or displayed outside on the site at any time. The exterior storage and display of the vehicles shall be limited to the location indicated on the plan labeled Exhibit A dated received July 12, 1990. 3. The exterior display and storage of motorcycles and jet skis for sale located in front of Building B shall occur between 8:30 a.m. and 6:00 p.m. with the exception of periodic promotional events, whereby display may continue until 9:00 p.m. The temporary storage/parking area located behind Building B (indicated on the plan labeled Exhibit A dated received July 12, 1990) shall be used to store/park motorcycles and jet skis that are dropped off for service, and shall occur between 8:30 a.m. and 6:30 p.m. only. 4. In the event the Planning Director finds that the outdoor storage and display of vehicles cause parking availability problems, the Applicant will be notified by the Planning Director that the exterior storage and display of vehicles on this site must cease immediately. The Applicant, upon notification by the Staff, shall immediately cease such activity. Any additional outdoor storage and display of vehicles will have to be considered by the Planning Commission through the Conditional Use Permit Process. 5. The exterior display and storage of automobiles shall be limited to new cars only. No used automobiles shall be stored and displayed outside of the building at any time. 6. Signs must comply with the standards established by the Sign Program established for this site. 7. No signs are to be placed on this site designating the use of any parking spaces solely for this auto brokerage facility. 9. All vehicle repair, maintenance and cleaning activities are to occur within the enclosed building. These activities shall not be carried on outside of the building at any time. 10. With the exception of authorized automobile, motorcycle and jet ski display, all demonstrations, displays, services, and other activities associated with the sale and services at the motorcycle dealership and the auto brokerage shall be conducted within an enclosed structure. 11. No loudspeakers or amplified music shall be permitted outside the enclosed building. 12. The Applicant shall maintain on a continuous basis an unobstructed fire lane on the north and west sides of Building B as required by the Dougherty Regional Fire Authority. The Applicant shall submit a fire lane striping plan for review and approval by the Dublin Planning Department and Dougherty Regional Fire Authority. The Applicant shall comply with Fire Department requirements within 15 days (September 14, 1990) of the effective date of this approval. 13. This approval shall supersede the previous Conditional Use Permit approval for PA 89-072. 14. On an annual basis, this Conditional Use Permit shall be subject to Zoning Investigator review and determination as to compliance with the Conditions of Approval. 15. This approval shall be null and void in the event the approved use ceases to operate for a continuous one year period. 16. This Conditional Use Permit shall be void if any of the terms or conditions of the permit are violated. Any violation of the terms or conditions of the permit shall be subject to citation.
