PA 88-016: On May 20, 1988, the Planning Director approved a Site Development Review request for an on-site freestanding sign to identify Kaufman & Broad's administrative offices. APPLICABLE REGULATIONS: Section 8-87.10(w) of the Dublin Sign Regulations defines a Special Easement Sign as "a business sign located off-site from the premises. The sign has been designed to advertise where said premises are located on a parcel of land without direct access or frontage on an improved public right- of-way and where the two premises involved are interconnected by a traversable vehicular roadway which is subject to a non-revocable, non-exclusive recorded vehicular access easement." Section 8-87.60 states that special easement signs can be considered through the Conditional Use Permit process. Section 8-94.0 of the Dublin Zoning Ordinance states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: This project has been found to be Categorically Exempt from CEQA under Section 15311, Class 11(a) of the California Environmental Quality Act Guidelines NOTIFICATION: Public Notice of the June 6, 1988, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. Because this item was continued to the June 20, 1988 hearing, no further public noticing was required. ANALYSIS: This application was continued from the Planning Commission meeting of June 6, 1988 in order to give the Applicant (Kaufman & Broad) time to provide legal evidence of an easement serving the sites in question. Staff gave the -2- Applicant until June 10, 1988 to provide this information. To this date, the Applicant has not provided any evidence of such easement. Because of this, Staff is once again recommending that the Planning Commission continue this application to the next regularly scheduled meeting (July 5, 1988) in order to give the Applicant time to provide the requested information. If Staff has not received either a title report, a property profile or a recorded deed (showing the easement) by 5:00 p.m. on June 24, 1988, Staff will recommend that this Conditional Use Permit request be denied at the July 5th hearing. Staff will immediately thereafter take the appropriate measures to have this illegal sign removed. The Applicant has been made aware of the above dates and the resulting consequences. RECOMMENDATION: Staff recommends that the Planning Commission continue this item to the next regularly scheduled meeting of July 5, 1988 in order to give the Applicant an opportunity to provide evidence of the existence of a non- revocable, non-exclusive recorded access easement serving the two sites in question. ANALYSIS: This application involves a request from Kaufman & Broad for a Conditional Use Permit for a Special Easement Sign. The sign is presently located off the subject site, on the property located at 6375 Clark Avenue. 6375 Clark Avenue fronts directly on the street, while the Kaufman & Broad -2- n n site is located directly behind (south) of this site (see Attachment 1). This sign was identified through the City's sign survey as an illegal sign. The Applicant is attempting to legalize the sign through this Conditional Use Permit process. Special easement signs are designed to advertise businesses without direct access or frontage on an improved right-of-way. Said sign must be located on a portion of a traversable vehicular roadway which is subject to a non-revocable, non-exclusive recorded access easement. The properties involved must be interconnected by this easement. At this time, Kaufman & Broad has not been able to provide legal evidence of the existence of an easement serving the subject sites. Staff has made Kaufman & Broad aware that they must provide evidence of such easement (by providing either a title report, a property profile, or a recorded deed showing the easement) prior to a decision being made on this application. If there is an easement, Staff may recommend conditional approval of the request. There is one potential issue involved with approving this sign. Kaufman and Broad was recently granted approval of a Site Development Review request for a freestanding sign to be located on the property they occupy. The sign regulations only allow one freestanding sign to identify a site. Kaufman and Broad will have to determine which sign they would like to keep. The other sign would be required to be removed as a condition of approval of this project. If there is no easement, Staff would recommend that this application be denied and the sign be removed from the site located at 6375 Clark Avenue. Staff recommends that the Planning Commission continue this application to the meeting of June 20, 1988, in order to give Kaufman & Broad an opportunity to provide the appropriate documents. These documents should be submitted to Staff no later than 5:00 p.m. on June 10, 1988, in order to make the June 20th hearing date. RECOMMENDATION: Staff recommends that the Planning Commission continue this item to the next regularly scheduled meeting of June 20, 1988 in order to give the Applicant the opportunity to provide evidence of the existence of a non- revocable, non-exclusive recorded access easement serving the two sites in question. Section 8-95.3 states that "The Planning Director, upon receipt of an application for Site Development Review, shall make such investigations as are necessary to determine whether or not the proposed Use or Structure conforms or may be conditioned to conform fully to the regulations for the District as herein set forth. The Planning Director may request reports and recommendations from the County Surveyor, Building Official and Health Officer, Public Works Department, other offices of the County of Alameda, or any other interested public agencies regarding matters within their jurisdiction which may be affected by the proposed use or structure." Section 8-95.7 states "Wherever a plan for the development of a Building Site has been the subject of Site Development Review as hereinabove specified and has been given final approval the use of the Building Site thereafter shall be subject to compliance with the plan in conformance to all details specified thereon and subject to all the conditions set forth in the action of approval." On April 15, 1988, the Planning Director approved the request. On May 2, 1988, the Applicant appealed the decision to the Planning Commission. On May 13, 1988, Staff mailed a letter to the Applicant detailing additional information that would have to be submitted by May 27, 1988 in order to make this application complete and in order for the Planning Commission to consider the request. This included mailing labels to meet the legal advertising requirements, 8 1/2" x 11" transparency reductions of all plans for overhead projection and 8 1/2" x 11" black and white reductions of each plan. To this date, that information has not been submitted. Consequently, Staff recommends that this application be continued to the next regularly scheduled Planning Commission meeting of June 20, 1988 in order to give the Applicant the opportunity to provide these documents. The preliminary landscape plan should indicate the general plant pallet that is proposed including a description of the type of plants, their rate of rewth size in 3-5 years, mature size, and container size at time of planting. PA 87-005: On February 17, 1987, the Planning Commission approved Conditional Use Permit for a Directional Tract Sign (Vista Green) for Diamond Signs PA 87-006: On February 17, 1987, the Planning Commission approved Conditional Use Permit for Directional Tract Sign (Coral Gate) for Diamond Signs APPLICABLE REGULATIONS: Section 8-87.60a) of City's Zoning Ordinance requires approval of a Conditional Use Permit for a Directional Tract Sign in any district. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: Categorically exempt, Class 11, Section 15311 NOTIFICATION: Public Notice of the June 20, 1988, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant, Diamond Signs, is requesting approval of a Conditional Use Permit to allow one Directional Tract Sign for Kildara Development on the currently undeveloped parcel located on the east side of San Ramon Road, North of Dublin Boulevard and the Chevron Service Station. The Applicant proposes a 10 foot tall single faced sign with a total of 32 square feet (4 foot x 8 foot) of sign area identifying the name of the subdivision and directions for reaching it. The sign will be perpendicular to San Ramon Road with a 5 foot setback from the south side property line. The proposed sign will be set back approximately 25 feet from the front property line. -2- The undeveloped lot is currently used for storage of construction materials and has supported Directional Tract Signs in the past. An Administrative Conditional Use Permit application has been submitted for a temporary sales office and model home complex for Kildara. A condition is included in the Draft Resolution of Approval requiring establishment of the sales office or model home complex prior to erection of the proposed sign. The proposed sign is consistent with the City's Zoning Ordinance in all aspects (size, height, location and sign content) . APPLICABLE REGULATIONS: Section 8-87.60(a) requires approval of a Conditional Use Permit for an off- site Directional Tract Sign in any district. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ANALYSIS: The Applicant, Diamond Signs, is requesting approval of a Conditional Use Permit to allow one Directional Tract Sign for the Hacienda Heights Housing Development. The Applicant proposes to locate the sign on the parcel at 11700 Dublin Boulevard on the northeast corner of Dublin Boulevard and Hansen Drive. The Applicant proposes a 10 foot tall single faced sign with a total of 32 square feet (4 foot x 8 foot) of sign area identifying the name of the subdivision and direction for reaching the development. The parcel for the proposed location of the sign is currently being graded for the previously approved office development (PA 85-045) and has supported directional tract signs in the past. The temporary sales office trailer for Hacienda Heights was approved June 8, 1988. PA 86-029: On April 17, 1986, the Zoning Administrator approved an Administrative Conditional Use Permit for 3 days of temporary promotional displays. PA 86-039: On April 25, 1986, the Zoning Administrator approved an Administrative Conditional Use Permit for 9 days of temporary promotional displays. PA 86-040: On June 2, 1986, the Planning Commission approved a Conditional Use Permit for up to 60 days of temporary promotional displays. PA 87-082: On June 15, 1987, the Planning Commission approved a Conditional Use Permit for up to 60 days of temporary promotional displays. PA 87-083: On June 15, 1987, the Zoning Administrator approved an Administrative Conditional Use Permit for up to 30 days of temporary promotional displays. APPLICABLE REGULATIONS: Section 8-94.0 states, in part, that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 states, in part, that the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: California Environmental Quality Act Guidelines, Categorically Exempt, Class 11, Section 15311, minor accessories to an existing business. NOTIFICATION: Public Notice of the June 20, 1988, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The City's Sign Regulations formalize the Conditional Use Permit (CUP) and Administrative Conditional Use Permit (ACUP) processes utilized to consider requests for use of temporary promotional advertising displays. -2- n The Sign Regulations establish a CUP process for consideration of requests for the use of 60 days (cumulative total) of temporary promotional advertising displays in a 12-month period. That approval can be secured in addition to an approval for the use of 30 days (cumulative total) of temporary promotional advertising display under the ACUP process. The subject car dealership secured approvals in 1986 for two ACUP requests authorizing a total of 12 days of promotional display and for a CUP request which authorized a total of 60 additional days of promotional display. In 1987 one ACUP request was approved for 30 days of promotional display and one CUP approved which allowed a total of 60 additional days of promotional displays. Concurrent with the subject application, the Applicant is also processing an ACUP application which requests approval for use of temporary promotional advertising displays for a cumulative period of 30 days over the next 12 month period (PA 87-062). That application has been approved and establishes an effective date of June 21, 1988. It includes a condition that coordinates the display days with any CUP to avoid overlapping dates. As has been required by other 30-day and 60-day approvals, Staff recommends that the standardized notification form be utilized (see Background Attachment #4) and that the Applicant be required to provide Staff a minimum 4-day pre- notification of all proposed promotional events, indicating the types of displays to be utilized, and the length of their respective use. In general, no known problems have arisen from previous approvals and resulting promotional displays. RECOMMENDATION: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt Resolution regarding Conditional Use Permit. ACTION: Staff recommends the Planning Commission adopt the attached Resolution (Exhibit "A") approving Conditional Use Permit Application PA 88-061. Chart Summarizing Previous ACUP and CUP requests for Temporary Promotional Signage -3- RESOLUTION NO. 88 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 88-061 CROSSROADS TOYOTA-PONTIAC CAR DEALERSHIP TEMPORARY PROMOTIONAL SIGNS - 60-DAY TIME FRAME CONDITIONAL USE PERMIT, 6450 DUBLIN COURT WHEREAS, Crossroads Toyota-Pontiac Car Dealership, requests approval of a Conditional Use Permit application to allow use of temporary promotional advertising displays for a cumulative period of up to 60 days within a 12-month period at 6450 Dublin Court, more specifically described as APN 941-1400-07; and WHEREAS, the adopted City of Dublin Sign Ordinance requires approval of a Conditional Use Permit to establish use of temporary promotional advertising displays when used for periods that cumulatively run from 31 to 60 days in a 12-month period; and WHEREAS, the Planning Commission did hold a public hearing on said application on June 20, 1988; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the Planning Commission finds that the Conditional Use Permit will not have a significant environmental impact; and WHEREAS, a Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above set forth; and WHEREAS, the proposed land use, if conditionally approved, will be appropriate for the subject property in terms of being compatible to existing land uses in the area and will not overburden public services; NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission finds: A. The use serves the public need by providing use of temporary promotional advertising displays in conjunction with special promotional events at an existing commercial facility (Crossroads Toyota Pontiac Car Dealership). B. The use will be properly related to other land uses and transportation and service facilities in the vicinity. C. The use will not adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare, or injurious to property or improvements in the area. D. The use will not be contrary to the specific intent clause or performance standards established for the district in which it is to be located. E. The approval of the Conditional Use Permit will be consistent with the policies set forth within the Dublin General Plan. BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve PA 88-061 as generally depicted by the materials from the June 20, 1988, Planning Commission Staff Report labeled Attachments 2, 3, and 4, on file with the Dublin Planning Department, subject to the following Conditions: 1. This approval is for the erection and use of temporary promotional advertising displays such as: use of roof-mounted cold-air balloons, use of pennants, banners, helium balloons, car signs and searchlights at the Crossroads Toyota - Pontiac Car Dealership, located at 6450 Dublin Court. 2. All temporary promotional advertising displays established in accordance with this permit shall be located, erected and maintained in a manner so as not to create a visual or physical hazard for either pedestrians or vehicles. 3. The temporary promotional advertising displays cited in Condition #1, or similar displays, may be used for a maximum cumulative period of 60 days within the 12-month period running from June 30, 1988, to June 29, 1989, and shall be subject to the following restrictions on their respective periods of use. A. No temporary promotional advertising displays may be displayed for a period exceeding 14 consecutive days. B. Searchlights may be utilized for a maximum of 12 days, with no more than 3 consecutive days of use. C. Cable-anchored helium, or other gaseous balloons, may be utilized for a maximum of 60 days, with no more than 7 consecutive days of use. When used over weekend periods (i.e., used on a Friday, Saturday and/or Sunday), balloons may be used no more frequently than 2 consecutive weekends. D. Roof-mounted, cold-air balloons may be utilized for a maximum of 60 days, with no more than 7 consecutive days of use. When used over weekend periods (i.e., used on a Friday, Saturday and/or Sunday), balloons may be used no more frequently than 2 consecutive weekends. E. The regulations outlined in this Condition which control frequency of use of specific types of promotional displays shall apply jointly to the 60-day CUP approval and any ACUP approval (such as PA 88-062) granted to the Applicant for this site for additional temporary promotional advertising displays. 4. The Applicant shall provide written notice to the City of Dublin Planning Department a minimum of four calendar days prior to each promotional event where temporary promotional advertising displays are used. Said written notice shall indicate the dates of use of each respective type of temporary promotional advertising display to be utilized. Written notice shall be in the form supplied by the City (attached). A master summary of the dates of use of each respective type of temporary promotional advertising display shall be maintained at all times on the subject premises and shall be available at all times during business hours for review by City of Dublin Staff. Any displays utilized on non-pre-authorized days shall be counted against the length of this permit on a two-day assessment for each one day of non-pre- authorized display and may result in revocation of the permit. 5. Prior to the first use of any temporary special promotional advertising display, the Applicant shall prepare and submit a site plan detailing the general location of temporary promotional advertising displays proposed for use under this permit. This site plan depiction of the location of the respective types of displays shall be subject to review and approval by the Planning Director. This plan may be modified or supplemented, if desired, by the Applicant by submittal of a revised plan for review and approval by the Planning Director. -2- n 6. Approval for temporary use of tents in conjunction with special promotional events is not granted by this Permit, but must be secured by a separate, subsequent Administrative Conditional Use Permit for each event where they are utilized. 7. At any time during the effectiveness of this approval, the approval shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Subsequent to the Planning Commission's review, the City Council adopted the Five-Year Capital Improvement Program for the period 1986 through 1991. As is typical with most Capital Improvement Programs, as needs and conditions change during the year, revisions must be considered for incorporation into the adopted Capital Improvement Program. Staff has prepared a new 1988-1993 Capital Improvemennt Program. Within this program, there are several carry-over projects and some new projects, which Staff will review with the Planning Commission. It would be appropriate for the Planning Commission to consider this new program as being in conformance to the General Plan and its objections.
