ADJOURNMENT (Over for Procedures Summary) el DUBLIN PLANNING COMMISSION PROCEDURES SUMMARY WELCOME to the Dublin Planning Commission meeting. The Planning Commission is made up of five Dublin residents who have volunteered their services to the community. They were appointed by the Dublin City Council. The Planning Commission encourages and appreciates participation by Dublin residents. Regular meetings of the Planning Commission are held on the first and third Mondays of each month in the Dublin Library Meeting Room, 7606 Amador Valley Boulevard, Dublin. TIME: Planning Commission meetings begin at 7:00 p.m. No new public hearing item will begin after 10:30 p.m., and the meetings will be adjourned by 11:00 p.m., except under unusual circumstances where the Commission votes to hear the item or to extend the meeting for 30-minute increments. ITEMS NOT ON THE AGENDA: No action shall be taken on any item not appearing on the posted agenda unless: 1) the Planning Commission determines by majority vote that an emergency situation exists, as defined in the Government Code 2) the Planning Commission determines by a two-thirds vote, or by a unanimous vote if only three members are present, that the need to take action arose after the agenda was posted; or 3) the item was included in a posted agenda for a prior meeting held within five (5) calendar days and was continued to the current meeting. PUBLIC COMMENTS UNDER ORAL COMMUNICATIONS: Any citizen desiring to speak on an item not scheduled on the agenda may do so under Oral Communications at the beginning of the meeting. After receiving recognition from the Chairperson, please state your name and address, then proceed with your comments. When an item not on the agenda is raised by a member of the public, the matter shall be deemed automatically referred to Staff unless the Planning Commission determines to take action as outlined in the section above entitled ITEMS NOT ON THE AGENDA. PUBLIC COMMENTS ON A HEARING ITEM: On a public hearing or other scheduled item, the Chairperson will ask the audience for its comments, first from those in favor, then from those in opposition. After receiving recognition from the Chairperson, please state your name and address, then proceed with your comments. The Planning Commission wants to hear all citizen concerns. Each new speaker is asked to be brief, add new information, and not repeat points which previous speakers have made. The Planning Commission is particularly interested in the specific reasons why the speaker is for or against an item. Applause and other demonstrations are prohibited during public hearings. Such demonstrations tend to intimidate those in the audience who may have valid but opposing viewpoints. The Chairperson maintains the discretion to request the use of Speaker Slips and to limit comments. Anyone who does not want to speak may write comments on the Speaker Slip and turn it into the Planning Commission while the public hearing is still open. File PA 88-051 ZONING HISTORY: The original 135+ acre holding was rezoned from an A, Agricultural District, to the R-1-B-5, Single Family Residential-Combining District, and the C-N, Neighborhood Business District, by Zoning Unit 638, approved by the Alameda County Board of Supervisors on December 5, 1964. The zoning designation R-1-B-5 was subsequently relettered to an R-1-B-E designation. On April 15, 1985, the Planning Commission granted approval for a four- parcel minor subdivision under Tentative Parcel Map 4575. The parcel split was requested to facilitate a purchase option agreement the Applicant (Rafanelli & Nahas Real Estate Development) had with the original property owner. On March 24, 1986, the City Council granted approval for the PD, Planned Development District and Tentative Map applications for the 1,165-unit Villages at Willow Creek project (PA 85-041.1 and .2). There are seven residential Villages under separate applications and in various stages. APPLICABLE REGULATIONS: Section 8-102.0 of the Zoning Ordinance states that an appeal may be taken to the City Council within ten (10) days after the date of any order made by the Planning Commission, the Planning Director or the Zoning Administrator pursuant to Sections 8-31.18, 8-90.3, 8-91.1, 8-92.0, 8-93.2, 8-94.1, or 8- 96.10. The appeal may be taken by any property owner or other person aggrieved or by an officer, department, board or commission affected by the order within said ten (10) day period, by filing with the Planning Director a Notice of Appeal specifying the grounds for such appeal. Filing such notice shall stay all proceedings in furtherance of the order appealed from. ENVIRONMENTAL REVIEW A Notice of Determination will be filed indicating that this project will not have a significant effect on the environment. The mitigated Negative Declaration used and adopted by the City for the original project approval (for PA 85-041 and Tract 5511) will apply to PA 88-051. This project should not have a significant effect on the environment if the mitigation measures are applied. NOTIFICATION: Public Notice of the September 19, 1988, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: On August 11, 1988, the Planning Director conditionally approved a Site Development Review application from JL Construction Co. to allow the construction of a 204 unit multi-family residential apartment/condominium complex (Village 5). On August 19, 1988, the Applicant appealed the Planning Director's decision to the Planning Commission. After numerous meetings between Staff and the Applicant concerning the appeal, the issues of concern were clarified and solutions were identified. Consequently, on September 12, 1988, Staff received a letter from the Applicant requesting that their appeal request be withdrawn. Staff recommends that the Planning Commission accept the Applicant's appeal withdrawal request. A revised Appealable Action Letter will be sent to the Applicant showing conditions of approval in line with the agreements reached by Staff and the Applicant. -2- RECOMMENDATION: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Accept Applicant's withdrawal request for PA 88-051, or give Staff and Applicant direction and continue the matter. ACTION: Staff recommends that the Planning Commission accept the Applicant's request to withdraw the Appeal of PA 88-051. Constructions appeal, subject to certain agreed conditions, to the Planning Commission for items numbered 41 and 43 in the "Conditions of Approval". These conditions deal with compact car parking and private vehicular accessway dimensions on the subject site. Thanks to your efforts along with those of Mr. Larry Tong and Mr. Lee Thompson it should be possible to comply with the road width guidelines, with the following exceptions. It appears as though we may have very limited space at one roadway which has garages on one side and open park- ing on the other. The guidelines require a 32' width for this condition, however, we can only achieve a maximum of 30' width in this area. The withdrawal of this appeal is, in part, subject to J.L. Construction receiving the benefit of a variance from 32' to 30' in this area of the site. To further comply with the drive width requirement, J.L. Construction may need to adjust the storm sewer easement width approximately 2' to accomo- date the realignment of one major buidling. Lastly, J.L. Construction withdraws this appeal conditioned upon the variance of 16' in lieu of 17' depth required for compact car parking stalls defined in the guidelines. On May 15, 1986, a member of the Dublin City Council appealed the decision of the Planning Commission. On May 29, 1986, the Applicant withdrew the Application. PA 88-023: On April 28, 1988, the Dublin Planning Director approved a Site Development Review request to remodel portions of the exterior facade of the existing Liquor Barn. On May 2, 1988 the Applicant appealed the Planning Director's action to the Planning Commission. On June 28, 1988, the applicant withdrew the appeal. On April 5, 1988, the Planning Commission accepted withdrawal of the appeal. APPLICABLE REGULATIONS: Section 8-61.0 of the Zoning Ordinance, as amended by Ordinance 81-81, requires that a Conditional Use Permit be obtained from the Planning Commission for the operation of Recycling Centers which would collect, sort and temporarily store glass, metals and other reusable materials (it does not allow for processing activities to occur). Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. -2- ENVIRONMENTAL REVIEW: Categorically Exempt, Section 15303, Class 3(e) and Section 15311, Class 11 - Installation of new accessory structures and placement of minor structures accessory to existing commercial facilities. NOTIFICATION: Public Notice of the September 6, 1988, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: State Assembly Bill 2020, the California Beverage Container Recycling and Litter Reduction Act, was signed into law in the Fall of 1986. The California State Department of conservation is responsible for the administration of the recycling program. The Law requires supermarkets having two million dollars or more in sales per year to provide outlets for consumers to redeem approved recyclable materials. These redemption outlets must be located within a 1/2 mile radius of the supermarket having such sales. The establishment of a small collection facility, such as the proposed 20/20 operation, is one accepted method that can be used to satisfy AB 2020. Reverse vending machines are another acceptable method. The supermarket may also purchase back the containers if a collection facility or reverse vending machine is not used. The City Zoning Ordinance complies with AB 2020 by establishing a provision allowing consideration of recycling centers as conditional uses in any zoning district. The Applicant is requesting approval of a Conditional Use Permit to operate a Recycle Collection Center in the parking lot area of the Pak'n Save Shopping Center. The Applicant's request complies with the City adopted ordinance relating to recycling centers. The request is to comply with State Bill 2020 and the use is not anticipated to create any special problems for the existing commercial tenants at the shopping center. The use will consist of up to five igloos and one kiosk. The igloos and kiosk have been located at this site since June 1988. The proposed operation would occupy approximately two-three parking spaces. The structures consist of one grey with blue trim kiosk for the operator and four igloos of red, green, blue and white. A fifth yellow igloo may be added in the future to accommodate newspaper recycling. The location at the Pak'n Save (next to Liquor Barn) does not hinder traffic circulation and is placed in underutilized parking area, however, Staff recommends that the units remain in their existing location rather than being placed in the handicap parking as shown by the Applicant. Ample convenient parking is available in the center and within the vicinity of the main entrys of the sites uses. The location is away from public streets and screened by parking lot landscaping, convenient and visible for customers and is not a hindrance to traffic circulation. The Applicant's proposal has been reviewed by the applicable public agencies. Conditions of approval have been included in the draft Resolution. RECOMMENDATION: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt Resolution approving Conditional Use Permit, or give Staff and Applicant direction and continue the matter. ACTION: Staff recommends the Planning Commission adopt the attached Resolution approving Conditional Use Permit application PA 88-078. -3- ATTACHMENTS: Exhibit A: Resolution approving Conditional Use Permit PA 88-044 Background Attachments Attachment 1: Location Map Attachment 2: Area Plan Attachment 3: Site Plan Attachment 4: Elevations Attachment 5: Applicant's Written Statement Attachment 6: Recycling Permits (Resolution 26-86) J • '`. 4- RESOLUTION NO. 88 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 88-078 20/20 RECYCLE CENTERS CONDITIONAL USE PERMIT TO OPERATE A REDEMPTION CENTER IN THE PARKING LOT AREA OF THE PAK'N SAVE SHOPPING CENTER WHEREAS, Barbara Saperia, representing 20/20 Recycle Centers, filed an application for a Conditional Use Permit to allow the operation of a recycling redemption center at the parking lot near Pak'n Save, 6633 Dublin Boulevard; and WHEREAS, the adopted City of Dublin Zoning Ordinance, as amended, provides for the operation of recycling centers, through the Conditional Use Permit process; and WHEREAS, the Planning Commission held a public hearing on said application on September 19, 1988; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the Staff Report was submitted recommending that the Conditional Use Permit application be approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above setforth; and WHEREAS, the proposed land use, if conditionally approved, is appropriate for the subject property in terms of being compatible to existing land uses in the area and will adversely affect public services; NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission finds: a) Use of the supermarket store parking lot area of this portion of the Pak'n Save Shopping Center serves the public need by providing recycling collection/redemption center for the community. b) The use, as conditioned by this Resolution, will be properly related to other land uses, and transportation and service facilities in the vicinity, and will not be in conflict with existing commercial uses in the Pak'n Save Shopping Center; c) The use will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detri- mental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; d) The use will not be contrary to the specific intent clauses or performance standards established for the zoning district in which it is to be located, as the proposed use will be compatible with adjoining retail uses and will serve to promote additional vehicular and pedestrian traffic through the Pak'n Save Shopping Center; e) The approval of the Conditional Use Permit is consistent with the Dublin General Plan; BE IT FURTHER RESOLVED THAT THE Planning Commission does hereby conditionally approve said application as shown by materials labeled Exhibit B and stamped approved on file with the Dublin Planning Department, subject to the following conditions: -1- d n CONDITIONS OF APPROVAL All Conditions of Approval shall be complied with prior to the issuance of a building permit or establishment of proposed land use activity and shall be subject to Planning Department approval. 1. This approval is for glass, aluninum, plastic beverages and newspaper recycling containers which will be located in the parking lot of the shopping center at 6633 Dublin Boulevard and depicted on the site plan labeled Staff Alternative, (Attachment 2). 2. The maximum number of parking spaces to be used for the recycling center shall be limited to three. 3. The Applicant shall obtain an annual Recycling Permit and Recycling Transporter Permit for each site as required by Resolution 26-86 (Attachment 6). 4. Additional 24" box evergreen screening trees and five gallon shrubs shall be provided in the existing landscape planter adjacent to the recycling containers. Details to be worked out with Staff. 5. All recyclable materials shall be stored inside the containers. Containers shall be of weatherproof and fire retardant design and materials. 6. The containers shall be emptied only during the hours of 8:00 a.m. and 5:00 p.m. 7. The Applicant/Operator (possibly in conjunction with the Property Owner) shall submit a maintenance plan and program to carry out that plan to ensure that at a minimum, the sites litter is picked up on a daily basis and the landscape screening is maintained. 8. The Applicant shall take all necessary precautions to ensure litter and materials are controlled and that the bins are maintained in an attractive and functionally operative manner. 9. The Applicant shall control activity so as not to create a nuisance to the existing businesses or shoppers. 10. A solid, enclosed receptacle shall be provided for the receipt of recyclable materials when igloos are unattended or locked. Details to be worked out with Staff. 11. Each site shall be allowed directional and identification signs. Signs shall not exceed eight (8) square feet and shall not contain advertising messages. 12. A minimum of one 40 gallon all-weather trash receptacle shall be provided in each collection area. 13. Containers shall be clearly marked to identify the type of material to be deposited and a notice will be displayed stating that no material shall be left outside the recycling containers. 14. Kiosk shall have a notice identifying the name and telephone number of the facility operator and the hours of operation. 15. Our centers are Small Collection Facilities as outlined in the Model Zoning Ordinance prepared by the Division of Recycling. - Our centers are approximately 300 square feet, typically two (2) parking spaces. - Each center will have five (5) "igloo" storage containers and one (1) manned kiosk. Each igloo will be approximately 3.0 - 4.0 cubic yards; two (2) 8" x 16" holes, and is 5'6" in height. - A staff person will be on site 30 hours a week to purchase materials. We hope to have a fifth igloo for recycling newspaper sometime in the near future. We have one Site Operator per location who works Wednesday, Thursday, Friday, and Sunday, 11:00 to 5:00, and Saturday from 8:30 to 5:00. The attendant is responsible for issuing scrip, which is redeemable at the Market for either cash or toward grocery purchases. The attendant is also responsible for keeping the igloos and surrounding areas clean. If then is excessive debris or overflow, it is their responsibility to contact the Regional office and see that it is picked up. We have a Crew Chief who is responsible for 10 to 15 stores and visits each site every day to make sure that everything is being handled properly. The igloos are emptied once a week ( or more often if needed) . A 40 ft. truck with a crane pulls into a space next to the igloos . The driver stabilizes the truck and unfolds the crane. He attaches a hook at the end of the crane onto the center eye of the igloo, which pulls on a tensioning device that keeps the door closed. The igloo is lifted off of the lot up over the truck onto one of three compartments (depending on material type) . The compartment door opens and the materials fall into the truck. The door closes and the igloo is returned to its proper spot. The driver then cleans any debris that may have spilt during the emptying process. SIGNAGE Signage consists of one *2 ' x 4 ' metal sign. It is generally attached to an already existing nearby light standard, or it can be fixed atop a 3" diameter pole, which with the sign will be 12 ' in height. U.2.C$ File PA 88-079 On November 20, 1987, the Dublin Planning Director granted approval of an Administrative Conditional Use Permit request for two newspaper recycling bins in the parking lot of the shopping center. APPLICABLE REGULATIONS: Section 8-61.0 of the Zoning Ordinance, as amended by Ordinance 81-81, requires that a Conditional Use Permit be obtained from the Planning Commission for the operation of Recycling Centers which would collect, sort and temporarily store glass, metals and other reusable materials (it does not allow for processing activities to occur). Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: Categorically Exempt, Section 15303, Class 3(e) and Section 15311, Class 11 - Installation of new accessory structures and placement of minor structures accessory to existing commercial facilities. NOTIFICATION: Public Notice of the September 6, 1988, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: State Assembly Bill 2020, the California Beverage Container Recycling and Litter Reduction Act, was signed into law in the Fall of 1986. The California State Department of conservation is responsible for the administration of the recycling program. The Law requires supermarkets having two million dollars or more in sales per year to provide outlets for consumers to redeem approved recyclable materials. These redemption outlets must be located within a 1/2 mile radius of the supermarket having such sales. The establishment of a small collection facility, such as the proposed 20/20 operation, is one accepted method that can be used to satisfy AB 2020. Reverse vending machines are another acceptable method. The supermarket may also purchase back the containers if a collection facility or reverse vending machine is not used. The City Zoning Ordinance complies with AB 2020 by establishing a provision allowing consideration of recycling centers as conditional uses in any zoning district. -2- The Applicant is requesting approval of a Conditional Use Permit to operate a Recycle Collection Center in the parking lot area of the San Ramon Village Shopping Center near Lucky. The Applicant's request complies with the City adopted ordinance relating to recycling centers. The request is to comply with State Bill 2020 and the use is not anticipated to create any special problems for the existing commercial tenants at the shopping center. The use will consist of up to five igloos and one kiosk. The igloos and kiosk have been located at this site since June 1988. The proposed operation would occupy approximately two-three parking spaces. The structures consist of one grey with blue trim kiosk for the operator and four igloos of red, green, blue and white. A fifth yellow igloo may be added in the future to accommodate newspaper recycling. The state law does allow local government agencies the discreation to regulate the appearance, including landscaping and signing of recycling facilities and equipment. Staff has obtained information from other cities as to what their architectural/screening requirements have been. Some cities have required solid screened areas, others regulate the exterior color of the containers. Staff believes that with placement next to landscape planters and added trees placed in these areas the desired level of screening could occur with minimal inconvenience to the Applicant. Staff has reviewed the Applicant's proposed location and feels that an alternative location adjacent to the Shell Car Wash would provide for better screening, parking, and traffic circulation. The Applicant's proposal has been reviewed by the applicable public agencies. Conditions of approval have been included in the draft Resolution. RECOMMENDATION: FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Close public hearing and deliberate. 5) Adopt Resolution approving Conditional Use Permit, or give Staff and Applicant direction and continue the matter. RESOLUTION NO. 88 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 88-079 20/20 RECYCLE CENTER CONDITIONAL USE PERMIT TO OPERATE A REDEMPTION CENTER IN THE PARKING LOT AREA OF THE SAN RAMON VILLAGE SHOPPING CENTER WHEREAS, Barbara Saperia representing 20/20 Recycle Center filed an application for a Conditional Use Permit to allow the operation of a recycling redemption center at the parking lot near Lucky, 8909 San Ramon Road; and WHEREAS, the adopted City of Dublin Zoning Ordinance, as amended, provides for the operation of recycling centers through the Conditional Use Permit process; and WHEREAS, the Planning Commission held a public hearing on said application on September 19, 1988; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the Staff Report was submitted recommending that the Conditional Use Permit application be approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above setforth; and WHEREAS, the proposed land use, if conditionally approved, is appropriate for the subject property in terms of being compatible to existing land uses in the area and will not adversely affect public services; NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission finds: a) Use of the supermarket store parking lot areas of this portion of the San Ramon Village Shopping Center serves the public need by providing recycling collection/redemption center for the community. b) The use, as conditioned by this Resolution, will be properly related to other land uses, and transportation and service facilities in the vicinity, and will not be in conflict with existing commercial uses in the San Ramon Village Shopping Center; c) The use will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detri- mental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; d) The use will not be contrary to the specific intent clauses or performance standards established for the zoning district in which it is to be located, as the proposed use will be compatible with adjoining retail uses and will serve to promote additional vehicular and pedestrian traffic through the San Ramon Village Shopping Center; e) The approval of the Conditional Use Permit is consistent with the Dublin General Plan; BE IT FURTHER RESOLVED THAT THE Planning Commission does hereby conditionally approve said application as shown by materials labeled Attachment 2, 3 and 4 and stamped approved on file with the Dublin Planning Department, subject to the following conditions: -1- n r'1 CONDITIONS OF APPROVAL All Conditions of Approval shall be complied with prior to the issuance of a building permit or establishment of proposed land use activity and shall be subject to Planning Department approval. 1. This approval is for glass, aluninum, plastic beverages and newspaper recycling containers which will be located in the parking lot of the shopping center at 8909 San Ramon Road and depicted on the site plan labeled Staff Alternative, (Attachment 2). 2. The maximum number of parking spaces to be used for the recycling center shall be limited to three. 3. The Applicant shall obtain an annual Recycling Permit and Recycling Transporter Permit for each site as required by Resolution 26-86 (Attachment 6). 4. Additional 24" box evergreen screening trees and five gallon shrubs shall be provided in the existing landscape planter adjacent to the recycling containers. Details to be worked out with Staff. 5. All recyclable materials shall be stored inside the containers. Containers shall be of weatherproof and fire retardant design and materials. 6. The containers shall be emptied only during the hours of 8:00 a.m. and 5:00 p.m. 7. The Applicant/Operator (possibly in conjunction with the Property Owner) shall submit a maintenance plan and program to carry out that plan to ensure that at a minimum, the sites litter is picked up on a daily basis and the landscape screening is maintained. 8. The Applicant shall take all necessary precautions to ensure litter and materials are controlled and that the bins are maintained in an attractive and functionally operative manner. 9. The Applicant shall control activity so as not to create a nuisance to the existing businesses or shoppers. 10. A solid, enclosed receptacle shall be provided for the receipt of recyclable materials when igloos are unattended or locked. Details to be worked out with Staff. 11. Each site shall be allowed directional and identification signs. Signs shall not exceed eight (8) square feet and shall not contain advertising messages. 12. A minimum of one 40 gallon all-weather trash receptacle shall be provided in each collection area. 13. Containers shall be clearly marked to identify the type of material to be deposited and a notice will be displayed stating that no material shall be left outside the recycling containers. 14. Kiosk shall have a notice identifying the name and telephone number of the facility operator and the hours of operation. 15. The supermarket which contracts for the placement, construction and operation of the recycling facility shall be responsible for ensuring that the premises surrounding such facility are maintained free of litter, recyclable materials, and other debris. 16. The supermarket for which the recycling facility is located shall post, in a convenient, visible location within the supermarket, entrances and exits, the location of the recycling facility. 17. The Applicant shall submit evidence to the Planning Director that appropriate state licenses, permits or certificates have been obtained. -2- r'1 18. The Applicant has 60 days in which to bring the site into conformance with these project conditions. 19. This permit shall be valid for one year expiring on September 28, 1989. The approval shall be reviewed by the Planning Commission to evaluate the overall conditions of operation, including adequacy of the method of screening. 20. Our centers are Small Collection Facilities as outlined in the Model Zoning Ordinance prepared by the Division of Recycling . - Our centers are approximately 300 square feet, typically two ( 2) parking spaces. - Each center will have five ( 5) "igloo" storage containers and one (1) manned kiosk. Each igloo will be approximately 3 .0 - 4.0 cubic yards; two (2) 8" x 16" holes, and is 5 ' 6" in height . - A staff person will be on site 30 hours a week to purchase materials. The containers will remain on site for donation of materials on a voluntary basis. - Over 50,000 of these igloo units are deployed throughout Europe, and have become the standard for collecting , storing, and trans- porting recyclable materials. - Colors of each igloo will be standardized and have graphics to identify each type of material redeemed. We hope to have a fifth igloo for recycling newspaper sometime in the near future. We have one Site Operator per location who works Wednesday, Thursday, Friday, and Sunday, 11:00 to 5:00, and Saturday from 8:30 to 5:00. The attendant is responsible for issuing scrip, which is redeemable at the Market for either cash or toward grocery purchases. The attendant is also responsible for keeping the igloos and surrounding areas clean. If ther is excessive debris or overflow, it is their responsibility to contact the Regional office and see that it is picked up. We have a Crew Chief whc is responsible for 10 to 15 stores and visits each site every day to make sure that everything is being handled properly. The igloos are emptied once a week ( or more often if needed). A 40 ft. truck with a crane pulls into a space next to the igloos. The driver stabilizes the truck and unfolds the crane. He attaches a hook at the end of the crane onto the center eye of the igloo, which pulls on a tensioning device that keeps the door closed. The igloo is lifted off of the lot up over the truck onto one of three compartments (depending on material type). The compartment door opens and the materials fall into the truck. The door closes and the igloo is returned to its proper spot. The driver then cleans any debris that may have spilt during the emptying process. SIGNAGE Signage consists of one 2' x 4' metal sign. It is generally attached to an already existing nearby light standard, or it can be fixed atop a 3" diameter pole, which with the sign will be 12' in height. RECkY.ED. (J �//1 ) Owner File PA 88-080 n In January, 1971, the Board of Supervisors also granted Building Code variances to the developers of the center to allow 1)buildings to be closer to the property lines than was allowed by the Building Code; 2) that these buildings could have openings in them (for doors and windows) that were closer to the property lines than allowed; and, 3) that covered walkways could connect the buildings, where the Building Code required fire separations which would not have allowed connected walkways. On March 28, 1983, the Dublin City Council granted approval of the same Building Code variances mentioned above as well as a 105 space Parking Variance (PA 82-013). On February 18, 1986, the Dublin Planning Director approved an Administrative Conditional Use Permit allowing a Boy Scout Troop to locate a newspaper collection bin in the parking lot area of Dublin Plaza Shopping Center near Albertson's, (this permit has expired and the Applicant is currently in the process of completing an application submittal to consider continuation of this operation). One June 27, 1988, the Dublin City Council approved a Site Development Review request for a 6,300+ square foot building addition. APPLICABLE REGULATIONS: Section 8-61.0 of the Zoning Ordinance as amended by Ordinance 81-81 requires that a Conditional Use Permit be obtained that a Conditional Use Permit be obtained from the Planning Commission for the operation of recycling centers which would collect, sort and temporarily store glass, metals and other reusable materials. (It does not allow for processing activities to occur). Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: Categorically exempt Section 15303 Class 3(e) and Section 15311 Class 11. Installation of new accessory structures and placement of minor structures accessory to existing commercial facilities. -2- NOTIFICATION: Public Notice of the September 6, 1988, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: State Assembly Bill 2020, the California Beverage Container Recycling and Litter Reduction Act, was signed into law in the Fall of 1986. The California State Department of Conservation is responsible for the administration of the recycling program. The law requires supermarkets having two million dollars or more in sales per year to provide outlets for consumers to redeem approved recyclable materials. These redemption outlets must be located within a 1/2 mile radius of the supermarket having such sales. The establishment of a small collection facility, such as the proposed 20/20 operation, in one accepted method that can be used to satisfy Assembly Bill 2020. Reverse vending machines are another acceptable method. The supermarket may also purchase back the containers if a collection facility or reverse vending machine is not used. The City Zoning Ordinance complies with Assembly Bill 2020 by establishing a provision allowing consideration of recycling centers as conditional uses in any zoning district. The Applicant is requesting approval of a Conditional Use Permit to operate a Recycle Collection Center at the Dublin Plaza Shopping Center parking lot near Albertson's. The Applicant's request complies with the City adopted ordinance relating to recycling centers. The request is to comply with State Bill 2020 and the use is not anticipated to create any special problems for the existing commercial tenants at the shopping center. The use will consist of up to five igloos and one kiosk. The igloos and kiosk have been located at this site since June, 1988. The proposed operation would occupy approximately two-three parking spaces. The structures consist of one grey with blue trim kiosk for the operator and four igloos of red, green, blue and white. A fifth yellow igloo may be added in the future to accommodate newspaper recycling. Staff has reviewed the Applicant's proposed location and feels that an alternative location adjacent to the large shopping center sign would provide for better screening, parking and traffic circulation. The State law does allow local government agencies the discretion to regulate the appearance, including landscaping and signing of recycling facilities and equipment. Staff has obtained information from other cities as to what their architectural/screening requirements have been. Some cities have required solid screened areas, others regulate the exterior color of the containers. Staff believes that with placement next to landscape planters and added trees placed in these areas the desired level of screening could occur with minimal inconvenience and initial cost to the Applicant. The Applicant's proposal has been reviewed by the applicable public agencies and conditions of approval have been included in the Resolution of Approval. The Applicant shall take all necessary precautions to ensure litter and materials are controlled and that the bins are maintained in an attractive and functionally operative manner. 8. The Applicant shall control activity so as not to create a nuisance to the existing businesses or shoppers. 9. A solid, enclosed receptacle shall be provided for the receipt of recyclable materials when igloos are unattended or locked. Details to be worked out with Staff. 10. Each site shall be allowed directional and identification signs. Signs shall not exceed eight (8) square feet and shall not contain advertising messages. 11. A minimum of one 40 gallon all-weather trash receptacle shall be provided in each collection area. 12. Containers shall be clearly marked to identify the type of material to be deposited and a notice will be displayed stating that no material shall be left outside the recycling containers. 13. Kiosk shall have a notice identifying the name and telephone number of the facility operator and the hours of operation. 14. The supermarket which contracts for the placement, construction and operation of the recycling facility shall be responsible for ensuring that the premises surrounding such facility are maintained free of litter, recyclable materials, and other debris. 15. The supermarket for which the recycling facility is located shall post, in a convenient, visible location within the supermarket, entrances and exits, the location of the recycling facility. 16. The Applicant shall submit evidence to the Planning Director that appropriate state licenses, permits or certificates have been obtained. 17. The Applicant has 60 days in which to bring the site into conformance with these project conditions. -2- 18. This permit shall be valid for one year expiring on September 28, 1989. We hope to have a fifth igloo for recycling newspaper sometime in the near future. We have one Site Operator per location who works Wednesday, Thursday, Friday, and Sunday, 11 :00 to 5:00, and Saturday from 8:30 to 5:00 . The attendant is responsible for issuing scrip, which is redeemable at the Market for either cash or toward grocery purchases. The attendant is also responsible for keeping the igloos and surrounding areas clean. If then is excessive debris or overflow, it is their responsibility to contact the Regional office and see that it is picked up. We have a Crew Chief who is responsible for 10 to 15 stores and visits each site every day to make sure that everything is being handled properly. The igloos are emptied once a week ( or more often if needed ) . A 40 ft. truck with a crane pulls into a space next to the igloos. The driver stabilizes the truck and unfolds the crane. He attaches a hook at the end of the crane onto the center eye of the igloo, which pulls on a tensioning device that keeps the door closed. The igloo is lifted off of the lot up over the truck onto one of three compartments (depending on material type) . The compartment door opens and the materials fall into the truck. The door closes and the igloo is returned to its proper spot. The driver then cleans any debris that may have spilt during the emptying process. SIGNAGE Signage consists of one '2 ' x 4' metal sign. It is generally attached to an already existing nearby light standard, or it can be fixed atop a 3" diameter pole, which with the sign will be 12 ' in height . At the August 1, 1988 regularly scheduled Planning Commission Meeting, the Commission established August 20th for a field trip to the Hansen Hill Ranch site and August 23rd and 24th for Study Sessions. The two Study Sessions were conducted in a non-decision making workshop format, in which the Commission discussed project issues and accepted comments from Staff, the Applicant and the public. The focus of the discussions were on 1) where to develop (including discussion of environmental constraints and General Plan goals and policies), and 2) how much to develop (including discussions of land use designations and density -2- n ranges). Items of concern identified by members of the public presented at the Study Sessions and discussed by the Applicant, Staff and the Commission included: 1. Location and proximity of the roadway accessing the site from Silvergate to the adjacent units located on Winding Trail Lane; 2. Removal of oak trees; 3. Dust generated during construction; 4. Traffic and air pollution generated by projected related traffic; 5. Maintenance of open space areas; and 6. Density and size of the development. At the September 6, 1988 Planning Commission meeting under Commissioner's concerns, the Commission requested additional information concerning 1) soil conditions in Area 3 (in the northwestern portion of the site); 2) insurance protection for hillside property owners in the event of occurrence of landslides; and 3) location of the roadway accessed off Silvergate. 1. Area 3 Soil Conditions: The Preliminary Geotechnical Investigation prepared for the Applicant by Harding Lawson Associates indicates a deep landslide zone within Area 3 (northern portion of the site). The report provides recommendations indicating avoidance of deeper landslide zones is a matter of "economics rather than feasibility" of the mitigation methods discussed in the report (see Attachment 21, page 10 and 11 of Preliminary Geotechnical Investigation). The report further states that "to reduce the future slope stability hazard, it would be preferable to apply corrective measures to the deeper landslide zones and thereby permit development in those areas". The report does not specifically address whether correction of the landslides are necessary if no development is proposed in the vicinity of the landslide. However, the Public Works Director indicates that typically if development does not occur within the immediate vicinity either above or below the landslide area, it is not necessary to correct the landslide. The Public Works Director indicated that a landslide can exist indefinitely within open space areas without being corrected. 2. Can the City require property owners in hillside developments to obtain an insurance policy to cover landslides: The City Attorney's office indicates the City could, as a condition of approval of the subdivision, require such a policy if commercially available. If such a condition was required, a minimum cover amount based on the purchase price would be appropriate. Staff contacted a local insurance agent concerning availability of such a policy. It appears that a policy does not exist to cover landslides or mudslides as a soils or geology report would be necessary for each lot. 3. Location of the northern access roadway from Silvergate Drive: This item is a specific development issue which will be established through the Tentative Map and Planned Development stage of the project review process. At the Study Session, the Applicant had expressed an interest in working with the residence of Winding Trail Lane on their concerns with the location of this roadway. Other issues discussed at the Study Session included Density, Density Transfer and Existing Zoning: Density: The issue of net versus gross density range was discussed in the August 1, 1988 Staff Report. In brief, for General Plan purposes density measurements are based upon gross residential acreage. Areas included in calculating the gross residential acreage include residential land use designation, roadways within the land use designation and one half the width of abutting roadways to the land use (see Attachment 22). Open space acreage is not included when calculating density. The Applicant's table (see Attachment 23) presented at the July 18th Planning Commission meeting which provides a density comparison of existing development in the City does not correctly calculate density for General Plan purposes as the calculations include acreage of land designated as open space in the General Plan. This density is inconsistent with the City's General Plan Development policies for residential sites (see Attachment 24, Table 1 General Plan). The patio homes are in the general location of Area 7 identified in Figure 4 of the City's General Plan (see Attachment 25). The approximate density ranges determined through the residential development policies for potential residential development in the primary planning area of the project site are as follows: Site No. Approximate Density Range 5 6-8 DU/Acres 6 1-2.8 DU/Acres 7 1-3.3 DU/Acres Attachment 26 provides examples of typical lot dimensions for existing developments with density ranges within the .5 - 2.8 DU/Acre range. Attachment 27 provides examples of existing development with a density range similar to the 3.2 DU/Acre, the proposed for the site. Transfer of Density: This issue was discussed on page 7 of the July 18th Staff Report and page 4 of the August 1st Staff Report. The transfer of density does not apply to land which the General Plan designates as open space (see Attachment 2, 7/18/88 Staff Report, for policy 7.3B). Implementation of this policy would occur during the review and approval of the Planned Development and Tentative Map phase of the application process. The Applicant has noted they have a legal concern with this policy. Staff has indicated that legal concerns should be submitted in writing to the Planning Department in order for Staff to obtain an opinion from the City Attorney. Existing Zoning: Staff as verified with the Alameda County Planning Department that the Hansen Hill Ranch site is zoned A (Agricultural). County Zoning permits one unit per 100 acres within the A District. Under the existing Alameda County Zoning, the Hansen Hill Ranch site would be permitted one residential unit. Discussion of the EIR, General Plan policies, development constraints and difference in the Staff recommendation and the Applicant's proposal are contained in the staff reports from the previous meetings of July 18, August 1, and the August 23 and 24, Study Sessions. Recommendation Staff recommends the Planning Commission continue the Hansen Hill Project PA 87-045 to the October 3, 1988 Planning Commission Meeting and direct Staff to prepare a Resolution incorporating the Planning Commission's recommendations on the following items: 1. Adequacy and completeness of the Final EIR. 2. Land Use Designation - Staff recommends three General Plan land use designations for the Hansen Hill Ranch site, as generally depicted in Attachment 6: -5- � n a. Open Space/Stream Corridor b. Low Density Single-Family Residential (.5 - 2.8 D.U./Acre) c. Medium Density Residential (6.1 - 8 D.U/Acre) 3. Amend General Plan to incorporate entire Hansen Hill Ranch project within the primary planning area. 4. Amend General Plan to delete Areas 5, 6 and 7 from Table I and Figure 4 of the General Plan. 5. Amend General Plan policy and map with regard to Hansen Drive extension. 6. Amend General Plan to include alternate roadway serving Hansen Hill Ranch site (Valley Christian Center access road) and designate as a collector street. 7. Amend General Plan to include policy establishing level of service D as maximum level of service acceptable. 8. Amend General Plan to include policies requiring fire protection buffer zone around perimeter of residential development which interface with open space lands. RECOMMENDATIONS FORMAT: 1) Open public hearing and hear Staff presentation. 2) Take testimony from Applicant and the public. 3) Question Staff, Applicant and the public. 4) Deliberate 5) Give Staff direction and continue the matter to the October 3, 1988 Planning Commission Meeting. Landsliding, including shallow earthflows, localized deeper seated sliding and possible debris flows. 2. The potential for strong earthquake shaking and the potential for _ seismically-induced landsliding involving the natural soils or fills placed on the steeper slopes. 3. Expansive clayey surface soils which can experience volume changes with changes in moisture content and consequently cause damage to foundations or slabs and pavements, unless properly treated. 4. A general potential for slope erosion and instability in weak sur- face soils or deeply weathered bedrock. -1 All of these hazards or geotechnically related problems are subject to effective mitigation using methods found to be satisfactory for similar pro- jects and site conditions. Our assessment of the hazards and our recommended mitigation measures are presented in the following paragraphs. A. Landslidinq Our investigation has shown that the upper area of the site proposed for residential development is underlain by bedrock at relatively shallow depth. In that area, landslides that would be significant to the development are --.1 essentially absent. In the lower portions of the site, including the chan- nel of Martin Canyon Creek and its small tributary drainages, soil deposits 7 are generally more extensive and larger landslides exist; however, except v for two of these landslides, they are shallow, generally less than 10 feet. _ Based upon our experience, we believe that all of the landslide hazards 10 d i�M zC a `} ENT �;ati�°( Alsou. t a Harding Lawson Associates within the site can be effectively mitigated through measures found to be satisfactory in other similar projects. Mitigation would generally consist of excavation of the unstable landslide debris materials, benching into firm materials below the landslide shear plane, placement of subdrain blankets, _--] and reconstruction of the slopes to the desired grades using the excavated materials in a well compacted fill. Avoidance of the deeper landslide zones would be a question of economics rather than feasibility of this mitigation method. In order to reduce the future slope stability hazard, it would be preferable to apply corrective measures to the deeper landslide zones and thereby permit development in those areas. JB. Debris Flows A debris flow hazard is not clearly indicated by the visible site condi- tions. In comparison to the visible landslide areas which are representa- tive of a relatively slow moving landslide condition, debris flows are rela- tively fast moving soils and debris in a semi-liquid state. They originate on relatively steep slopes and generally involve more sandy soils than those which occur on-site. Debris flow paths are generally limited to established drainages, such as the small ravines tributary to Martin Canyon Creek. Con- ceivably, the existing channels in those ravines may have been eroded in --+ part by debris flows, although they are not typical of persistent debris flow channels in which the channel bottom and sides are usually stripped of vegetation and expose bedrock. The 1983 aerial photographs reveal debris 11 1.8 GENERAL PLAN MAP The General Plan Map for the Primary Planning Area proposes an arrangement of land uses and a circulation system to serve those uses at full development - expected to occur within 10 years. Because so little land remains uncommitted, boundaries between uses are exact. However, deviations in road alignments or open space configurations, and request for approval of churches or other semi-public facilities typically appropriate to the adjoining uses are not to be considered inconsistent with the General Plan. Both the map and the text should be consulted to determine consistency or inconsistency; the text shall govern. 1.8.1 Land Use Classification The following descriptions are intended to aid interpretations of the General Plan map legends. Density Measurements Density measurements for general plan purposes are based upon gross residential acreage and is calculated as follows: Gross residential acreage (GRA) shall be determined by calculating the area of the site and by adding one-half of the area of abutting streets, provided that the street width used for calculation shall not be less than 25 feet or more than 50 feet. Public or private streets within the boundaries of the site, as well as streets abutting the site, are calculated within the gross acreage total. Gross acreage, rather than net acreage, is used as a General Plan density measurement in order to account for situations in which larger multiple family and Planned Development residential projects include much vehicular circulation area that is not public right-of-way;- In such cases, the project site area would be larger than on smaller, conventional sites that rely mainly on dedicated streets for access. If allowable densities were calculated on the site area or net acreage basis, the larger projects would have higher "effective" densities than the smaller sites.
