A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF FINAL MAP TRACT NO. 5131
WHEREAS, the Final Map of Tract No. 5131 in the
incorporated territory of the City of Dublin; State of California
has been presented to this City Council for approval, all in
accordance with the provisions of the Subdivision Map Act of the
State of California and the Ordinance Code of the County of
Alameda, as adopted by the City of Dublin; and
WHEREAS, the Developer, JMH, Inc., has executed and
filed with the City of Dublin a contract to improve Tract No. 5131
in accordance with the Final Map of said Tract No. 5131, the Tract
Improvement Plans and the specifications attached thereto; and
WHEREAS, said contract is secured by a bond in the
amount of $697,000 which, by its terms, is made to inure to the
City of Dublin conditioned upon the performance of said contract;
and
WHEREAS, said contract is secured by a bond in the
amount of $348,500 which, by its terms, is made to inure to the
benefit of laborers and materialmen upon such work and
improvements, conditioned upon the payment of such laborers and
materialmen for labor performed or material furnished under the
terms of said contract.
NOW, THEREFORE, BE IT RESOLVED that said contract and
bonds be and they are hereby approved; and
BE IT FURTHER RESOLVED that the Final Map of Tract No.
5131 be and the same is hereby approved; and that those parcels of
land, as offered for dedication for public use in conformity with
the terms of the offer of dedication, be and they are hereby
accepted; and that the Clerk of this City Council be and is hereby
directed to transmit said map to Chicago Title Company who will,
in turn, deliver to the County Recorder for filing and
concurrently deliver to the City the following monies and
documents:

$25,000 for traffic signal contribution
$25,000 inspection deposit
$133,551 for in lieu park dedication
performance bond of $697,000
Labor and Materials Bond of $348,500
PASSED, APPROVED AND ADOPTED this 10th day of
December, 1984.
