0?1 7A__ CALL TO ORDER/ROLL CALL
A regular meeting of the City of Dublin Planning Commission was held on Tuesday, February
10, 2009, in the City Council Chambers located at 100 Civic Plaza. Chair Wehrenberg called the
meeting to order at 7:00 p.m.
Present: Chair Wehrenberg; Vice Chair King; Commissioners Schaub, Brown, and Swalwell; Jeff
Baker, Acting Planning Manager; Laura Karaboghosian, Associate Planner; and Debra LeClair,
Recording Secretary.
Absent: None
ADDITIONS OR REVISIONS TO THE AGENDA - NONE
MINUTES OF PREVIOUS MEETINGS - On a motion by m. Swalwell, seconded by Cm.
King the minutes of the January 27, 2009 meeting were approved.
Cm. Brown suggested that acronyms be spelled out in the minutes and also asked to have a
legend of regular Planning terms given to the new Commissioners. Jeff Baker, Acting Planning
Manager agreed.

PUBLIC HEARINGS -
8.1 PA 08-042 The Well Christian Community Church Conditional Use Permit to
expand an existing Place of Worship, minor modification of the hours of operation
and a parking reduction for shared parking and off-site parking within the Light
Industrial Zoning District.
Laura Karaboghosian, Associate Planner presented the project: as outlined in the Staff Report.
Cm. Brown stated that in the 2005 CUP the traffic engineer calculated the parking with three
tenant vehicles applied to the formula. He asked if the traffic engineer had confirmed that
number is still current. Ms. Karaboghosian answered the calculation was not reviewed by the
current traffic engineer. She stated that Staff confirmed the number was still accurate.
Cm. Brown asked if it was confirmed that the tenants at the location of the off-site parking still
do not operate on Sundays. Ms. Karaboghosian answered they do not operate on Sundays. Jeff

Baker, Acting Planning Manager mentioned there is an updated list of tenants which was
compared to the list submitted in 2005 and it is consistent. lie also mentioned that the City
Traffic Engineer did review the parking analysis for the current: application and agreed with the
findings of the parking analysis, including the three on-site vehicles.
Cm. Brown asked if the accessible concrete walkway mentioned in Conditions of Approval 27 &
28 of the 2005 action, are still in compliance. Mr. Baker answered yes; they were inspected prior
to occupancy for the 2005 permit, they still exist and are in compliance.
Cm. Brown asked how the maximum occupancy of 123 mentioned in Condition of Approval #6
of the current application, is tracked and what would be the consequences if they exceed that.
Mr. Baker answered that it would typically be handled throw h Code Enforcement action. If a
complaint was received regarding parking then an inspection, with a physical count, would be
done.
Cm. Brown asked if there is a branch in the Police Department that would verify Conditions of
Approval #22-24. Mr. Baker answered yes the Community Safety Officer from Dublin Police
Services reviews the plans for building permits and they would inspect the project before the
permit was finaled.
Cm. King stated that the chart on Page 6 of the Staff Report was asking for a reduction in
available parking but the number requested was more than ;he required number, therefore it
was not a reduction. Mr. Baker answered that the parking calculation for the church exceeds
the available on-site parking. The proposal includes a request for a parking reduction for
shared parking on-site and the use of off-site parking to meet the peak parking demands for the
church. Cm. King asked if the parking reduction is a change i1 the required parking ratios. Mr.
Baker answered yes. He continued that the parking study established a higher parking
requirement than what the Zoning Ordinance requires for the church.
Cm. King asked if Staff is satisfied that the surrounding uses will not conflict with activities on
the weekend. Mr. Baker answered Staff evaluated the use and found that there are only two
businesses that operate on Saturday at various hours with minimal parking required and there
is enough parking to support the uses, plus what is being Proposed. Cm. King asked what
other businesses uses are open on Saturday. Ms. Karaboghosian answered a video repair use;
open from 9:00am to 4:00pm and a photography studio open from 10:00am to 2:00pm, July
through November.
Chair Wehrenberg asked if all tenants within 300 feet were notified and if there are any
complaints. Ms. Karaboghosian answered that a notice wa:i sent to all property owners and
tenants within 300' of the project site and there have been no complaints since the establishment
of the Well Church in 2003 and no comments from the public since the notices were sent out.
Chair Wehrenberg opened the public hearing.
Napoleon Kaufman, Pastor of the Well Church, spoke in favor of the project and thanked the
Commission for their support.

Chair Wehrenberg asked if the participants of the youth ministries are of driving age. Pastor
Kaufman answered there is a combination of high school students, some of which drive and
junior high students who are dropped off by parents. He continued that generally the age range
is from 11 to 18 years old.
Chair Wehrenberg asked about an agreement for the church to provide two parking attendants
at the off-site parking area. Pastor Kaufman answered that on Sunday mornings they provide
parking attendants to ensure attendees are parking in the correct way and that traffic is flowing
properly. He stated the attendants, considered "ushers", are there to serve in the parking lot.
Chair Wehrenberg closed the public hearing.
Cm. Schaub stated he was in support of the project. He waned to have a discussion with the
Commission regarding how shared parking is referred to in the Ordinance as a "reduction". He
felt that shared parking is not necessarily a parking reduction, but rather a different way of
looking at parking. He suggested the Commission discuss ways to change the wording in the
Ordinance to eliminate confusion with the use of the words "parking reduction", and to also
find words, tools and a framework by which the Commission reviews parking the same way
every time.
Cm. King agreed with Cm. Schaub regarding the Parking Ordinance and was in support of the
project.
Cm. Swalwell commended Staff and congratulated the Well Church on the work that they do
and being a great part of the community. He felt the Church's productive relationship with
Staff is beneficial and encouraged the relationship in the future.
Chair Wehrenberg stated she was in support of the project. She felt that with no complaints and
the support of the community the church is good for Dublin.
Chair Wehrenberg responded to Cm. Schaub's comments about shared parking and felt that the
shared parking is a case by case issue.
On a motion by Cm. Swalwell and seconded by Cm. Brown, on a vote of 5-0, the Planning
Commission approved:

10.1 Brief INFORMATION ONLY reports from the Planning Commission and/or Staff,
including Committee Reports and Reports by the Planning Commission related to
meetings attended at City Expense (AB 1234).
10.2 Mr. Baker informed the Commission that the Environmental Impact Reports (EIR) for the
Nielsen and the Arroyo Vista projects are available for public. He stated that there is a 45
day public comment period which ends March 20th and March 22nd respectively.
