HomeMy WebLinkAboutReso 105-84 DubBlSanRamonRd RESOLUTION NO. 105 - 84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AGREEMENT WITH SHELL OIL COMPANY REGARDING MODIFICATION OF SOUTHWEST CORNER OF DUBLIN BOULEVARD AND SAN RAMON ROAD WHEREAS, the Dublin City Council has approved the installation of a driveway on San Ramon Road to the Shell Oil Station subject to certain conditions; and WHEREAS, this agreement includes the Shell Oil Company's installation of the subject driveway and improvement modifications to the intersection corner and closure of the driveway should the driveway become a traffic accident problem. NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council does hereby approve the document entitled "Agreement - Dublin Shell Station Driveway" and does hereby authorize the Mayor to sign the agrement on behalf of the City of Dublin. AYES; and AJayo~z Srtyde~z NOES: None ~d - City Clerk~k AGREEMENT DUBLIN SHELL STATION DRIVEWAY The following outlines those conditions of approval imposed on Shell Oil Company, here- inafter referred to as the OWNER, by the City of Dublin, California, hereinafter referred to as the CITY, for construction of a new curb cut and driveway at the OWNER's proper- ty located at II ~8~? Dublin Boulevard, Dublin, California ~?b,568. A sketch of the proposed improvements is provided in Attachment A. Condition I: The proposed driveway will meet all appropriate CITY design stan- dards. The new driveway will be a maximum of 35 feet wide and will be located as far from the adjacent intersection as is practical. Condition 2: if creation of the new driveway results in a significant increase in ac- cidents at the intersection, the CITY may require that the driveway be closed. Closure of the driveway would include removal of the curb cut and installation of raised curbing and sidewalk. Other intersection revisions including elimination of the free right-turn lane and modification of the traffic signal at the intersection of San Ramon Road and Dublin Boulevard are included in the proposed driveway project. These revisions would remain and would not be affected by any driveway closure hereafter ordered by CITY. Condition 3: The OWNER agrees to pay all reasonable costs associated with the driveway project. These include engineering and design, construction, permits~ and coordination with Caltrans. Owner reserves the right to terminate the project if project costs are considered excessive. Condition 4: The CITY agrees to obtain access rights from the State of California as required by the project. The CITY agrees to keep the OWNER informed of all discussions with the State of California (CALTRANS) regarding this project. The CITY shall require from the OWNER written acceptance of the terms of the acuisition of access rights prior to their purchase. Costs for purchase of these rights will be reimbursed by the OWNER to CITY. Condition 5: The OWNER shall reserve the right to terminate the project prior to start of construction. The OWNER shall also reserve the right to close the driveway without a request from the CITY.
