in the Dublin Civic Center City Council Chambers. Chairperson Johnson called the meeting to order at
7:00 p.m.

Assistant City Attorney; Andy Byde, Senior Planner and Maria Carrasco, Recording Secretary.
Absent: Cm. Jennings and Cm. Nassar

Cm. Johnson led the Commission, Staff, and those present in the pledge of allegiance to the flag.
The minutes from the September 25, 2001 meeting were continued to October 9, 2001 due to lack of
quorum to approve those minutes.

West Dublin BART Specific Plan Amendment for Crown Chevrolet and Enea Plaza Properties
(Modification of Traffic Mitigation Measures)
Jeri Ram presented the staff report. She explained that on June 26, 2001, the Planning Commission
adopted a Resolution recommending City Council approval for Specific Plan Amendments to change the

Floor Area Ratio (FAR) to 1.00 for the Crown Chevrolet and Enea Properties; to revise the Land Use
Concept map to reflect the projected uses; and include the Enea and office properties at the end of
Amador Plaza Road in the planning area boundaries of the Specific Plan.
She stated that in evaluating the amendment request, the traffic consultant did not include the approved
Schaefer Ranch Project. When that project was added into the traffic study, it was determined that an
additional northbound left-turn lane at the intersection of Dublin Boulevard and San Ramon Road be
included in the Specific Plan Amendment for traffic to operate at an acceptable level of service.
Staff indicated that based on the economic and traffic studies prepared for the project, and FAR of 1.00 is
acceptable for the subject properties. In addition to this revision, changes to FAR's for other properties
shown as Retail/Office and Commercial B in the planning area should be recommended to provide
consistency in the Plan and provide similar properties with the same development potential
opportunities; and a third north bound left turn lane at Dublin Boulevard and San Ramon Road should
be added to the Plan.
Staff recommends that the Planning Commission adopt a Resolution recommending the City Council
approve the amendments to the West Dublin BART Specific Plan changing the FAR to 1.00 on the subject
properties and other properties designated as Retail/Office and Commercial B, amend Traffic Mitigation
Measures, Specific Plan Table 5 and appropriate Maps as shown in attached Exhibits A through G. She
concluded her presentation and asked if anyone had any questions or comments.
Cm. Johnson asked the Planning Commission if they had any questions or comments; hearing none he
closed the public hearing and asked for a motion.
On motion by Cm. Fasulkey, seconded by Cm. Musser, by a vote of 3-0-2, with Cm. Jennings and Nassar
absent, the Planning Commission adopted

PA 00-025 East Dublin Properties Prezone (Planned Development/Stage 1 Development Plan)
and Annexation/Detachment application request Prezone (Planned Development/Stage 1
Development Plan) for the purpose of facilitating annexation of approximately 1,120 acres of
unincorporated area of Alameda County land to the City of Dublin; the proposed annexation
would result in attachment to and detachment from various service districts. The proposed
prezoning would provide zoning for various land uses including commercial, industrial and

residential development, parks, schools, open space and other uses located adjacent to the City
of Dublin eastern city limits, immediately north of Interstate 580 and east of Fallon Road.
Cm. Johnson asked for the staff report.
Andy Byde stated the application request is for a Prezone (Planned Development/Stage I Development
Plan) and pre-annexation for the purpose of facilitating annexation of approximately 1,120 acres of
unincorporated area of Alameda County land to the City of Dublin. The proposed annexation would
result in attachment to and detachment from various service districts. The proposed prezoning would
provide zoning for various land uses including commercial, industrial and residential development,
parks, schools, open space and other uses located adjacent to the City of Dublin eastern city limits,
immediately north of Interstate 580 and east of Fallon Road.
The area would require detachment from Livermore Area Recreation and Park District and attachment
to the City of Dublin and the Dublin San Ramon Service District (DSRSD) and executing a Pre-
Annexation Agreement. In 1993 the City of Dublin analyzed developing and annexing portions of the
area east of the current boundary at that the time, as a result of those efforts the City of Dublin adopted
an Eastern Dublin Environmental Impact Report. Approximately 472 acres of the Project area are
included within the City's Eastern Dublin Specific Plan boundary, while the remainder is within the 1993
Eastern Dublin General Plan Amendment area. The entire Project area is located within the City of
Dublin's General Plan Planning Area and Sphere of Influence. He stated that the comment period was
between July 31, 2001 and ended Sept. 14, 2001. The City received comment letters from various agencies
and individuals, which are included in the packets. Those comment letters and responses to comments
will be included in the final EIR.
Before any development can occur, a Stage II Development Plan would need to be submitted and
approved. This project does not provide any entitlements for development. The sphere of influence line
was established in 1983 by LAFCO and identified the areas to be served by Dublin. This area is also
within DSRSD service area. DSRSD has indicated adequate capacity for water, recycled water and sewer
for the project. The proposed area is included in Livermore Area Recreaflon and Park District (LARPD)
service area. The City is requesting detachment from LARPD. The City of Dublin has a Parks and
Community Service Department, which will serve the area. Staff recommends that the Planning
Commission open the public hearing and adopt the resoluflons recommending City Council approval
for the project. He concluded his presentation and asked if there were any questions.
Cm. Johnson opened the public hearing.
Ted Fairfield stated that he is working with the East Dublin property owners for last year and half for
the project. He stated that Mr. Byde did a good job summarizing the project issues. The property has
been determined by LAFCO in Dublin's sphere of influence. The proposed project complies with the
City of Dublin General Plan, East Dublin Specific Plan and DSRSD's Service Area Plan. He explained
that a Stage I Planned Development is nothing more than a Prezoning vehicle that qualifies annexing the
area to the City. A Plan Development Prezone is required by LAFCO for approval. He stated that they
concur with the staff report and recommend the Commission's approval.

T. W. Starkweather, E. Dublin Property Owner strongly endorses the comments of Andy Byde and Ted
Fairfield. He stated he is very excited about the project and the new employment opportunities it may
bring to the City.
Cm. Johnson asked if there were any other comments or questions; hearing none he closed the public
hearing.
Cm. Musser asked if DSRSD would adequately serve water and sewer for the area.
Mr. Byde responded yes. DSRSD's Master Plan and their water service analysis have indicated adequate
water and sewer could serve the area.
Cm. Musser asked for clarification on whether there are any significant differences with the proposed
plan and the original DSRSD plan.
Mr. Byde stated there aren't any differences; the plans are the same.
Cm. Musser asked if it is appropriate to forward the project to the City Council without the Commission
reviewing Staff's response to corrwnent letters.
Kit Faubion responded yes it is appropriate. She explained that the Planning Commission is required to
consider the Draft Environmental Impact Report (EIR). Included in the Agenda Packets are copies of the
Draft Environmental Impact Report Volume I & II, as well as the comment letters received by the City.
The City Council is required to review the entire EIR package including Staff's response to comments.
Cm. Fasulkey asked how the sphere of influence boundary was established.
Mr. Byde stated LAFCO defined the sphere of influence boundary in 1983. He stated he couldn't answer
how LAFCO concluded to that specific boundary line. In the late 80's and early 90's there was much
discussion and debate between Livermore and Dublin on the Doolan Canyon area and which City
would have control. LAFCO decided to leave the area alone as open space between the two cities.
Cm. Johnson asked if any other members of the audience wished to speak on the project; hearing none
he asked for a motion.
On motion by Cm. Musser seconded by Cm. Fasulkey, by a vote of the Planning Commission
