HomeMy WebLinkAboutItem 5.2 Certificate of Rejection – Offer of Dedication for Parcel 8 of the Final Map of Tract 8563, Francis Ranch, Croak Property Agenda Item 5.2 STAFF REPORT CITY COUNCIL Page 1 of 3 DATE: May 19, 2026 TO: Honorable Mayor and City Councilmembers FROM: Colleen Tribby, City Manager SUBJECT: Certificate of Rejection – Offer of Dedication for Parcel 8 of the Final Map of Tract 8563, Francis Ranch, Croak Property Prepared by: Vatsal Patel, Assistant Public Works Director/City Engineer EXECUTIVE SUMMARY: The City Council will consider approving a Certificate of Rejection of the Offer of Dedication for Parcel 8 of Final Map of Tract 8563, Francis Ranch, Croak Property, which was previously accepted by the City subject to the completion of improvements. This action corrects the record and ensures that the City only accepts the parcel solely intended for the purposes of a public park. STAFF RECOMMENDATION: Adopt the Resolution Authorizing the City Engineer to Execute the Certificate of Rejection for Parcel 8 of Final Map of Tract 8563, Francis Ranch, Croak Property and Authorizing the City Clerk to Record a Certified Copy of the Resolution in the Office of the County Recorder. FINANCIAL IMPACT: None. DESCRIPTION: Francis Ranch, formerly East Ranch, is a six-neighborhood residential development located north of Interstate 580, east of Fallon Road and the Jordan Ranch development, south of the Positano development, and adjacent to the City’s eastern boundary. 30 Page 2 of 3 Final Map for Tract 8563 and Dedication of Neighborhood Park Parcel Tract 8563, recorded on December 26, 2023, is a large lot map that created neighborhoods for purposes of financing and/or sale of individual neighborhoods to builders, with the intent that subsequent neighborhood maps would be recorded to create individual lots. Tract 8563 dedicated Parcel 8 (Property) to the City for the purpose of a public park, which will be the future Wild Wind Neighborhood Park as shown in Figure 1. The City accepted the Property subject to the completion of improvements. As of this report, the improvements have not been completed or accepted by the City. Figure 1. Parcel 8 from Final Map for Tract 8563 Changes to Neighborhood Park Parcel As development proceeded, the Developer and the City determined that a portion of the Property would be improved with a privately maintained stormwater feature (swale). As a result, the Property was split into two parcels: Parcels B and C. Parcel B is the portion of the Property that will be developed for the future Wild Wind Neighborhood Park. Parcel C is the portion of the Property along Croak Road that will be developed with the swale. The homeowners association will own and maintain the swale. Final Map for Tract 8650, Neighborhood 6 With the recordation of Tract 8650 on June 27, 2025, the Developer offered Parcel B for dedication for public park purposes, and the City accepted it subject to the proposed park improvements. Upon the completion of the park improvements, the City intends to accept them, at which time the City will own Parcel B. 31 Page 3 of 3 Figure 2. Parcels B and C from Final Map for Tract 8650, Neighborhood 6 Certificate of Rejection The Certificate of Rejection is intended to clarify for the official records that the City rejects the dedication of the Property of Tract 8563 in its entirety and that the City has accepted Developer’s offer of dedication for Parcel B of Tract 8650, subject to the completion of the park improvements. The Certificate further makes clear that the City is not accepting or maintaining Parcel C of Tract 8650 or the swale. STRATEGIC PLAN INITIATIVE: None. NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council authorizes the City Engineer to execute the Certificate of Rejection for Parcel 8, attached hereto as Exhibit A, and make any necessary, non-substantive changes to carry out the intent of this Resolution. RECITAL This is to certify that the interest in real property conveyed by the Final Map for Tract 8563 (“Tract 8563”), filed for record on December 26, 2023, in Book 371 of Maps at Pages 12 through 22, inclusive, in the Official Records of the County of Alameda, State of California, from Arroyo Cap IV-3, LLC, a Delaware limited liability company (“Developer”), for an Offer of Dedication for the uses of and purposes of a public park (Parcel 8 of Tract 8563) (the “Property”) to the City of Dublin, a governmental agency, is hereby rejected by the City Engineer, on behalf of the Dublin City Council pursuant to authority conferred by Resolution No. 24-87 of the Dublin City Council, adopted on April 13, 1987. For clarity, the following background is provided. Tract 8563 was a large lot map that created various neighborhoods for purposes of financing and/or sales of individual neighborhoods to builders, with the intention being that subsequent neighborhood maps would be recorded creating the individual lots. The City accepted the Property, future Wild Wind Neighborhood Park, subject to improvement. Presently, the improvements have not yet been completed and accepted by the City. Subsequently, the Developer and the City determined that a portion of the Property would be improved with a stormwater feature (the “Swale”) that would be privately maintained because it could not be incorporated as useable parkland. Therefore, Final Map for Tract 8650, Francis Ranch, Neighborhood 6, Croak Property (“Tract 8650”), filed for record on June 27, 2025, in Book 373 of Maps at Pages 78 through 84, inclusive, in the Official Records of the County of 35 Alameda, State of California, from the Developer, for an Offer of Dedication for the uses of and purposes of a public park (Parcel B of Tract 8650). Parcel B of Tract 8650 (“Parcel B”) is the portion of the Property that is to be developed for the future Wild Wind Neighborhood Park. Parcel C of Tract 8650 is the portion of the Property along Croak Road that is to be developed with Swale. The City accepted Parcel B subject to improvement, and the City intends to accept the proposed park improvements to be constructed on Parcel B, at which point the City will own Parcel B pursuant to the dedication and acceptance subject to improvement of Parcel B. Parcel C was reserved by the Developer for future dedication to the homeowners association, which the Developer and City intend will be responsible for accepting and maintaining the Swale. Although the City’s subsequent approval of Tract 8650 may have superseded the dedication and acceptance subject to improvement of the Property, this certificate is intended to clarify that the City is rejecting the dedication of the Property in its entirety, relying on the dedication and acceptance subject to improvement of Parcel B, and disclaiming any intention to accept or maintain Parcel C or the improvements thereon. NOW, THEREFORE, PURSUANT TO THE AUTHORITY OF GOVERNMENT CODE SECTION 27281, AND CITY COUNCIL RESOLUTION NO. 24-87 (ADOPTED APRIL 13, 1987), THE CITY HEREBY CERTIFIES: The interest in the Property conveyed by Tract 8563, from Grantor to the City is hereby rejected by the undersigned officer on behalf of the City, and the City hereby consents to recordation thereof by its duly authorized officer.
