Hills
Background
On January 13, 2013, City Council adopted Ordinance No. 01-13 to rezone
the Moller Ranch Property to Planned Development (PD) Zoning District and
adopted a Stage 1 and Stage 2 Development Plan for the area. Section 4.4
of the PD development regulations allow the maximum height of a front
courtyard wall to be a 30 inch maximum (solid wall) or 42 inch maximum
(transparent fence).
In addition, the subdivision map Tract 8102 requires that properties in this
development have an 8 foot wide Public Service Easement (PSE) behind the
sidewalk. The PSE is to be kept open and free of buildings and structures.
Proposal
On February 24, 2026, the applicant and property owner of 7398 Rosamond
Hills Court (Lot 26 of Tract 8102), submitted a request for a Minor
Amendment to Ordinance No. 01-13, Section 4.4 (Development
Regulations/Architectural Standards). The request was to allow an existing
front yard courtyard wall with a total height of 6 feet 10 inches (consisting
of a 5 foot 4 inch solid portion and an 18 inch transparent portion) on Lot
26.
Minor Amendment to a Planned Development (PD) Zoning District
A minor amendment to an adopted PD may be approved administratively
by the Community Development Director upon a finding that the
amendment substantially complies with and does not materially change
the provisions or intent of the adopted PD Zoning District Ordinance for the
site (DMC 8.32.080).
The proposed wall exceeds the standard maximum height of 30 inches for
a solid wall or 42 inches for a transparent fence within the front yard
courtyard. According to the applicant, the purpose of the proposed wall is
to create usable space for a family member with special needs. Due to the
topography of the parcel, the retaining wall is necessary for the patio to be
flush with the existing front porch. In accordance with the California building code, a guard rail is
required for a patio wall above 30 inches.
Approval
The Community Development Director finds that the proposed Minor Amendment to PD Zoning
District Ordinance 01-13 is in substantial compliance with and does not materially change the
provisions or intent of PD Zoning District Ordinance 01-13. The Director hereby approves a Minor
Amendment to PD Zoning District Ordinance 01-13 to allow the height of the retaining wall on Lot
26 to be a maximum height of 6 feet 10 inches (consisting of a 5 foot 4 inch solid portion and an 18
inch transparent portion).
Note: While the retaining wall is built outside the PSE, the stairs and located within. As stated in the
attached acknowledgment dated December 11, 2025, any removal and replacement or repair of
said patio or any other improvements, such as landscaping or irrigation, to allow full use of the PSE
shall be the sole responsibility of the Lot 26 property owners.

Dear Andy,
We, Chaitanya Vuppala and Anantha Srikrishnan, owners of Lot 26 of Tract 8102, hereby
acknowledge the existing 8-foot wide Public Service Easement (PSE) along the easterly property
boundary and the restrictions within the PSE set forth on the recorded final map for Tract 8102.
Such restrictions include, but are not limited to, said PSE to be kept open and free from buildings
and structures of any kind, with the sole exception of public service facilities, and all public
utilities holding a valid franchise from the City shall have the right to use the public service
easement in accordance with the terms of the franchise.
We also acknowledge that approval of construction of patio and landscaping improvements at
Lot 26 over and across the existing PSE at the easterly property line shall not exclude full use of
the PSE by those having rights as stated above and noted on the final map for Tract 8102 and
Chapter 7.04 Encroachments of the Dublin Municipal Code, and any removal and replacement or
repair of said patio or any other improvements, such as landscaping or irrigation, to allow full use
of the PSE shall be the sole responsibility of us as Lot 26 property owners.
