HomeMy WebLinkAboutPC Reso 83-001 PA 83-008 Subdivision Directional Sign- Diamond Signs, Inc /m /'S RESOLUTION NO. 83-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING CONDITIONAL USE PERMIT CONCERNING PA 83-008 SUBDIVISION DIRECTIONAL SIGN - DIAMOND SIGNS, INC. WHEREAS, Rcbert Nielsen (Property Owner) and Diamond Signs (Applicant) have filed an application for a Conditional Use Permit PA 83-008 to allow the use of a 4'x 6' subdivision directional sign at the westerly end of Silvegate Drive (APN 941- 100-7-29); and WHEREAS, the Planning Commission did hold a public hearing on April 18, 1983; and WHEREAS, proper notice of said public hearing has been given; and WHEREAS, the subject Conditional Use Permit has been reviewed in accordance with the California Environmental Quality Act and has been found Categorically Exempt; and WHEREAS, the Planning Commission did hear and consider all reports recommendations and testimony related to the PA 83-008 Conditional Use application; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission finds that: a) The use is required by the public need as a program of effective sign directing prospective home buyers to the property is in public need. b) The use will be properly related to other land uses and transportation and service facilities in the vicinity as the signs are well located with respect to adjoining land uses and major circulation corridors and would require no services. c) The use, if permitted, under all the circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood. d) The use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located. BE IT FURTHER RESOLVED that the Planning Commission hereby conditionally approves said application shown in materials listed as Exhibit "B" on file with the Dublin Planning Department subject to the following conditions: 1. A $1,000 (One Thousand Dollars) cash bond shall be deposited with the Alameda County Building Official within 14 days to guarantee compliance with this permit and removal of the sign upon termination. Any time or expense incurred by Staff to achieve compliance or removal shall be charged against the deposit. Should said deposit not be posted within 14 days, the existing sign shall be removed immediately. 2. This permit shall expire on April 18, 1984, and shall remain revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. 3. The directional tract signs related to the "Canyon Creeks" subdivision at: 1) Silvergate Drive/Castilian Road; and at 2) Silvergate Drive/San Ramon Road shall be brought into compliance with the approved plans within 14 days. If the signs are not in conformance thereafter, the Building Inspection Department shall have the signs removed at the applicant's expense. PASSED, APPROVED AND ADOPTED this 18th day of April, 1983.
