HomeMy WebLinkAboutPC Reso 83-010 PA 83-043Kaleidoscope Center - to establish educational program at Fallon school r1 /1 RESOLUTION NO. 83-010 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 83-043, KALEIDOSCOPE CENTER, A CONDITIONAL USE PERMIT APPLICATION TO ALLOW THE ESTABLISHMENT OF THE EDUCATIONAL PROGRAM AT THE FALLON SCHOOL WHEREAS, Kaleidoscope Center has filed an application for a Conditional Use Permit (PA 83-043) to allow the operation of an educational program for up to 44 developmentally disabled youths between the ages of 3 and 21 in an R-1 (Single Family Residential) District, at 7425 Larkdale Ave., Dublin CA (APN 941-181-27-1); and, WHEREAS, the Planning Commission did hold a public hearing on said application on August 15, 1983; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, a Pre-Hearing Staff Analysis was submitted recommending the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony as hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a) The use is required to serve a public need and provide additional educational training for developmentally disabled youth; b) The use will be properly related to other land uses and transportation and service facilities in the vicinity as daytime and early evening activities will be commensurate with present use of properties in the neighborhood; c) The use, if permitted, under all the circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; d) The use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located, as a school with limited impacts, is consistent with the character of the residential district; BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve said application as shown by materials labelled Exhibit "A", on file with the Dublin Planning Department, subject to the following conditions: 1) Number of children on the premises at any one time, on a regular basis,shall not exceed 50. 2) All school activities will be restricted to occur between the hours of 7:00 a.m. and 10:00 p.m. 3) No outside activities may take place before 8:00 a.m. or after the hour of 8:30 p.m. (.1 n 4) Evidence shall be provided to, and be approved by the City Planning Department that guarantees that the school grounds, and related building, will be maintained in a normal fashion, with debris and weeds being cleaned up, landscaping kept healthy, and buildings cleaned and repaired. 5) Should off-site parking be required, it shall not block residential driveways nor interfere with the normal flow of traffic. There shall be no parking in any of the residential areas. 6) School noise shall be controlled so as not to create a nuisance to the adjoining residential neighborhood. 7) Any identification signing shall be approved by the Dublin Planning Department. 8) This approval shall remain in effect for two years. During the effective period of this permit, the permit may be revoked for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. 9) Any requirements of the DSRSD Fire Department shall be complied with.
