A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 83-041, SCOTSMAN MANUFACTURING CORPORATION, A
CONDITIONAL USE PERMIT APPLICATION TO ALLOW THE STORAGE OF MOBILE
OFFICES AND THE CONSTRUCTION OF ADMINISTRATIVE OFFICES
IN AN M-1 (LIGHT INDUSTRIAL) DISTRICT
WHEREAS, Creegan & D'Angelo has filed an application for
a Conditional Use Permit and Site Development Review (PA 83-041)
to allow storage of mobile offices and a 2,800-square-foot
administrative office, on 7.5 acres, in an M-1 (Light Industrial)
District, located at 6085 Scarlett Court (APN 941-550-25;
941-550-19-4; and 941-550-19-5; and,
WHEREAS, the Planning Commission did hold a public
hearing on said application on September 6, 1983; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
Quality Act and has been found to be categorically exempt; and
WHEREAS, a Pre-Hearing Staff Analysis was submitted
recommending the application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony as hereinabove set
forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
a) The use is required by the public need for
temporary offices and the provision of related employment;
b) The use will be properly related to other land uses
and transportation and service facilities in the vicinity and it
will be commensurate with present use of properties in the
neighborhood;
c) The use, if permitted, under all the circumstances
and conditions of this particular case, will not materially affect
adversely the health or safety of persons residing or working in
the vicinity, or be materially detrimental to the public welfare
or injurious to property or improvements in the neighborhood, as
all applicable regulations will be met;
d) The use will not be contrary to the specific intent
clauses or performance standards established for the District in
which it is to be located, as it will have limited impacts, and is
consistent with the character of other developments in the area;
BE IT FURTHER RESOLVED that the Planning Commission does
hereby conditionally approve said application as shown by
materials labelled Exhibit "A", on file with the Dublin Planning
Department, subject to the following conditions:

1. Install the frontage improvements as required by the City
Engineer, as outlined in his letter to the Planning Director,
dated August 31, 1983.
2. Comply with the Fire Department requirements, as stated in
its letter to the Planning Director, dated August 26, 1983.
3. Should building and grading permits not be acquired within 60
days, the mobile offices, then on the site, shall be removed
to an acceptable location.
4. This permit shall terminate three years from the effective
date of this Resolution, on September 16, 1986. During the
effective time period, the permit shall be subject to
revocation for cause, in accordance with Section 8-90.3 of
the Dublin Zoning Ordinance.
5. The requirements of the Building Department regarding
Building Code compliance, and Title 24 handicapped access
requirements, shall be met.
Because of the schematic nature of the landscape plan, the
following design standards shall be used:
6. Prior to the issuance of building permits, a final landscape
plan and automatic irrigation plan shall be approved by the
Dublin Planning Department. Said plans shall show the street
trees to be 15-gallon Sycamore, or a similar fast-growing
canopy tree. The internal landscaped areas shall use the
plant pallet, as shown, utilizing 15-gallon trees, and at
least 75% of the shrubs shall be 5-gallon shrubs. Ground
cover may be planted from flats. The two westerly pine trees
shall be saved and protected from damage during the site's
development.
7. Comply with Dublin Standard Site Development Review
requirements (attached).
8. All exterior night lights shall be no higher than 18 feet and
shall contain lenses or shields so that the light source will
not be visible from Highway 580, and so that the lights will
not shine onto adjacent property.
9. A Dublin Landscape and Irrigation Maintenance Agreement shall
be signed by the property owner prior to issuance of building
permits.
10. All landscaping shall be installed prior to occupancy of the
building. If the weather prohibits installation at that
time, a cash deposit, or bond, shall be posted with the City,
equal to the cost of the landscaping and irrigation, plus
25%, to assure that the landscaping will be installed in a
timely manner.
11. Dust shall be controlled during the construction phase of the
project.
12. The colors on the exterior of the proposed office and wall
shall be approved by the Dublin Planning Department prior to
issuance of building permits.
13. The site shall be maintained and kept in a state of good
repair. All mobile offices shall be stored so as to present
an orderly appearance from Highway 580.
14. When any use changes on the property owned or controlled by
Scotsman Manufacturing Corporation, that use shall be
reviewed by the Dublin Planning Department to assure
conformance to the Zoning Ordinance and other related
development requirements.
