RESOLUTION NO. 83-19
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 83-053, PACIFIC TELEPHONE AND TELEGRAPH, A
CONDITIONAL USE PERMIT APPLICATION TO ALLOW THE CONTINUED USE OF
AN OUTDOOR STORAGE YARD IN A LIGHT MANUFACTURING DISTRICT
WHEREAS, Pacific Telephone and Telegraph has filed an
application for a Conditional Use Permit to allow the continued
use of an outdoor equipment and supply storage yard in an M-1
(Light Manufacturing) District, located at 6400 Sierra Ct.,
Dublin, California (APN 941-205-1-34); and,
WHEREAS, the Planning Commission did hold a public
hearing on said application on October 3, 1983; and,
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and,
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
Quality Act and has been found to be categorically exempt; and,
WHEREAS, a Pre-Hearing Staff Analysis was submitted
recommending the application be conditionally approved; and,
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony as hereinabove set
forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
1) The project is required by the public need for construction,
installation, and repair of telephone facilities in the area;
2) The project is properly situated in relation to other light
industrial uses in the vicinity;
3) The project, as conditioned, will not have substantial adverse
effects on the health or safety of persons in the vicinity, or be
substantially detrimental to the public welfare, or injurious to
property or improvements;
4) The use will not be contrary to the specific intent of the
district to provide for and encourage light industrial uses in
suitable area; and,
BE IT FURTHER RESOLVED THAT the Planning Commission does
hereby approve the Conditional Use Permit application of Pacific
Telephone and Telegraph, subject to the following conditions:
1) Any damaged or missing wooden slats in the existing chain link
fence and gates on the northern, eastern, and western sides of the
project area, shall be replaced;
2) The existing paving shall be maintained in a clean, dust-free
manner;
3) The project shall remain in compliance with the approved plans
and materials on file with the Dublin Planning Department;
4) This permit shall terminate and end October 3, 1984. During
the effective time period, the permit shall be subject to
revocation for cause in accordance with Section 8-90.3 of the
Dublin Zoning Ordinance;

5) At, or before, the time of expiration the storage yard shall
be cleared of all equipment, vehicles, and supplies, and the chain
link fence shall be removed. The site shall then be patched and
restriped, as shown on Exhibit "A" of C-3550, so as to serve its
original parking lot purpose.
