A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 83-057 HERITAGE COMMONS
A CONDITIONAL USE PERMIT FOR NEELEY/LOFRANO ARCHITECTS
TO ALLOW MINOR MODIFICATIONS TO A
PLANNED DEVELOPMENT DISTRICT (1497th Z.U.)
WHEREAS, Neeley/Lofrano Architects have filed for a
Conditional Use Permit (PA 83-057) to allow unit type, size, and
mix, as well as architecture and site plan changes, to be made to
Phase I of the Heritage Commons Planned Development District,
located on the south side of Amador Valley Blvd., just south of
Stagecoach Road (APN 941-2765-1; 941-2765-2; 941-2765-3; and 941-
2765-4); and,
WHEREAS, the Planning Commission did hold a public
hearing on said application on October 17, 1983; and,
WHEREAS, proper notice of said public heraing was given
in all respects as required by law; and,
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
quality Act, and the Negative Declaration that was prepared for
initial zoning action (1497th Z.U.) was found acceptable; and,
WHEREAS, a Pre-Hearing Staff Analysis was submitted
recommending the applicaton be conditionally approved; and,
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony as hereinabove set
forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
a) The proposed changes are minor in nature, thereby
allowing this application to be processed as a Conditional Use
Permit application;
b) The use, as modified, will be properly related to
other land uses, and transportation and service facilities, in the
vicinity;
c) The changes proposed, under the circumstances and
conditions of this particular case, will not materially affect
adversely the health or safety of persons residing or working in
the vicinity, or be materially detrimental to the public welfare
or injurious to property or improvements in the neighborhood, as
all applicable regulations will be met;
d) The changes proposed will not be contrary to the
specific intent clauses or performance standards established for
the District in which it is to be located, and they are consistent
with the character of the residential district;
BE IT FURTHER RESOLVED THAT the Planning Commission does
hereby conditionally approve said application as shown by
materials labelled Exhibit "A", on file with the Dublin Planning
Department, subject to the following conditions:

GENERAL PROVISIONS
1. All Conditions of Approval for the 1497th Zoning Unit shall be
complied with, except as modified by the Conditions of Approval
for this application.
2. Comply with the plans, dated 9/28/83, and contained in Exhibit
"A" on file with the Dublin Planning Department (PA 83-057).
3. No further construction can occur until:
a. revised grading, improvement, condominium, and building
permit plans have been approved by the respective City
departments. These plans shall be consistent with the information
contained in Exhibit "A" (PA 83-057) and current City codes and
ordinances;
b. prior to issuance of building permits, Site Development
Review approval shall be obtained from Staff. This approval shall
implement these General Provisions and assure that the
architecture, landscape architecture, site plan, exterior
lighting, and security details provide for an attractive, safe,
and functional development, consistent with 1497th Z.U. approval,
as modified by these General Provisions;
c. revised Covenants, Conditions, and Restrictions shall be
approved by the City to assure that they are consistent with this
approval.
4. The revised plans shall comply with:
a. City of Dublin Residential Condominium Development
Guidelines;
b. City of Dublin Site Development Review Standard
Conditions;
c. City of Dublin Police Services Standard Residential
Security Requirements.
5. Revised plans shall contain information on project signing,
postal service, trash collection, guest parking, signage and
restrictions, street lighting, recreation center design, project
directories and addressing relative to unit identification by
police and fire personnel, and handicapped access (Title 24
provisions).
6. Garage setbacks from private streets shall be either 10 ft. or
less or 19 ft. or more, and automatic garage door openers shall be
provided for all units. Garages shall be at least 20 feet deep.
7. New building permits shall be issued by the City of Dublin.
The applicant may apply for a refund from Alameda County. (It is
advised that if the applicants do not apply for the new permits
prior to December 31, 1983, new State Energy Conservation
requirements will need to be met.)
