RESOLUTION NO. 83-28
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING VARIANCES RELATED TO TENTATIVE MAP 5179
CONCERNING PA 83-048 BEDFORD PROPERTIES
WHEREAS, Bedford Properties wishes to subdivide a 29.6-acre parcel
containing four existing buildings into five separate lots so that each
building will be on its own lot; and,
WHEREAS, due to existing zoning boundaries, existing lot lines,
and existing building locations, it would be extremely difficult to
subdivide the land without the requested variances; and,
WHEREAS, the proposed subdivision will enable a more economic
development of the subject property; and,
WHEREAS, the Planning Commission finds that:
1. There are special circumstances, including the site's existing building
locations, zoning boundaries, and existing lot lines, that make it
extremely difficult to subdivide the land in a reasonable and economic
manner, without the granting of a side and rear yard variance for Lot
C, and an effective lot frontage variance for Lot E.
2. The granting of the variances will not be a special privilege, which is
inconsistent with the limitations upon other properties in the vicinity
and zone, given that adequate access, parking, and circulation is
available, and the adjacent future and existing uses on neighboring
properties should not be constrained by the granting of the variance.
3. The granting of the variance will not be detrimental to persons or
property in the area or to the public welfare.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
grants the following variances as shown on Exhibit "A" on file with the
Dublin Planning Department :
1. Lot C - North side yard 6 feet, where 10 feet is normally required.
2. Lot C - West rear yard, 2 feet, where 20 feet is normally required.
3. Lot E - Effective lot frontage 121 feet, where 361 feet is typically
required.
