HomeMy WebLinkAboutPC Reso 83-032 PA 83-060 Parkway Baptist Church to situate 55' trailer n L, n RESOLUTION NO. 83-32 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 83-080 PARKWAY BAPTIST CHURCH REQUEST FOR A CONDITIONAL USE PERMIT TO SITUATE A 55' TRAILER AT 7485 VILLAGE PARKWAY WHEREAS, the Planning Commission did hold a public hearing on said application on December 5, 1983; and, WHEREAS, proper notice of said public hearing was given in all respects as required by law; and, WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and, WHEREAS, a Staff Report was submitted recommending the application be conditionally approved; and, WHEREAS, the Planning Commission did hear and consider all said reports, recommendations, and testimony as hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a. The trailer is required by the public need to provide parochial classrooms; b. The use will be properly related to other land uses, and transportation and service facilities in the vicinity, as daytime and early evening activities will be commensurate with present use of properties in the neighborhood; c. The use, if permitted, under all the circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; d. The use will not be contrary to the specific intent clauses for performance standards established for the District in which it is to be located, as a school and church, with limited impacts, is consistent with the character of the residential district; BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve said application as shown by materials labelled Exhibit "A", on file with the Dublin Planning Department, subject to the following conditions: 1. The use of the trailer shall be for educational and religious activities only. 2. All religious and educational activities shall be restricted to occur between the hours of 7:00 a.m. to 9:00 p.m. 3. All activities shall be controlled so as not to create a nuisance to the adjoining residential area. 4. The trailer shall be removed from the lot on or before 12/5/84. DP 83-20 5. The applicant shall comply with all requirements of the Dublin Building Department, including handicapped accessibility requirements. 6. The applicant shall submit a landscape plan to Staff for the dirt area immediately adjacent to the southernmost building. Said landscape plan, which must be approved by Staff, shall include a mixture of grass, shrubs, and trees. A permanent irrigation system does not need to be installed if the applicant insures that the landscaping will be maintained in an acceptable manner. 7. The following conditions shall be complied with as directed by the DSRSD Fire Department: a. The occupant load shall not exceed 27 persons; a sign stating such shall be posted within the trailer. b. One, 2AIOBC fire extinguisher shall be installed and maintained within the trailer. c. A fire alarm system shall be installed in connection with the existing alarm system. d. Exit signs shall be posted over each door. e. No smoking shall be allowed in the trailer; a sign stating such shall be posted within the trailer.
