HomeMy WebLinkAboutPC Reso 84-007 PA 84-001 Valley Datsun request to establish new and used car dealership �_ f1 RESOLUTION NO. 84-07 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 84-001 VALLEY DATSUN REQUEST FOR A CONDITIONAL USE PERMIT TO ESTABLISH A NEW AND USED CAR DEALERSHIP AT 6015 SCARLETT COURT WHEREAS, John Ferreri, representing Valley Datsun, filed an application for a Conditional Use Permit to establish a new and used car dealership at 6015 Scarlett Court; and, WHEREAS, the Planning Commission did hold a public hearing on said application on February 6, 1984; and, WHEREAS, proper notice of said public hearing was given in all respects as required by law; and, WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and, WHEREAS, a Staff Report was submitted recommending the application be conditionally approved; and, WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony as hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a. The use is required by the public need; b. The use will be properly related to other land uses, and transportation and service facilities in the vicinity; c. The use, if permitted, under all the circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; d. The use will not be contrary to the specific intent clauses for performance standards established for the District in which it is to be located. BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve said application as shown by materials labelled Exhibit "A", on file with the Dublin Planning Department, subject to the following conditions: 1. The applicant shall file a Site Development Review application with Staff. The plans for said application shall contain considerably more detail with respect to landscaping, parking, building elevations, and circulation than the existing plans. 2. The applicant shall install complete frontage improvements along Scarlett Court, including, but not limited to curb and gutters, sidewalk, street paving, and street lights. 3. The applicant shall install the storm drainage improvements as required in the Deferred Improvement Agreement with ACFCD and as directed by the City Engineer. DP 83-20 4 . The architecture of the new buildings shall match the architecture of the existing building. 5 . The large maintenance building and modular office may have to be removed. If the structures are left on the property, they shall be remodeled to reflect the architecure of the existing building. 6 . The existing trees shall be maintained. 7 . The finished floor elevation of the new buildings shall be a minimum of 330 feet above the M.S .L. 8 . The applicant shall comply with the requirements of DSRSD as indicated in the attached letter. 9 . A merger of the two parcels shall be required. 10 . A solid wall or fence shall be constructed along the north property line which separates the proposed commercial use from the existing contractor ' s offices . 11 . Additional requirements may be imposed during the Site Development Review process . 12 . This approval shall expire in two years, unless building permits are secured for the proposed improvements . 13 . This approval is valid for five years, until February 6, 1989 , unless extended by the Planning Commission at a public hearing. During the effective time period, the permit shall be subject to revocation for cause in accordance with Section 8-90 . 3 of the Zoning Ordinance.
