J / \ I� RESOLUTION NO. 84-36 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 84-029, MICHAEL NOHR'S REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE AN RV CENTER AT 6451 SCARLETT COURT WHEREAS, the Planning Commission did hold a public hearing on said application on July 16, 1984; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application is categorically exempt in accordance with the provisions of the California Environmental Quality Act; and WHEREAS, a Staff Report was submitted recommending the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony as hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a) The use is required by the public need to provide a Recreational Vehicle Center; b) The use will be properly related to other land uses and transportation and service facilities in the vicinity as daytime and early evening activities will be commensurate with present use of properties in the area; c) The use, if permitted, under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the area, as all applicable regulations will be met; d) The use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located, as an RV Center, with limited impacts, is consistent with the character of the commercial/industrial district; BE IT FURTHER RESOLVED that the Dublin Planning Commission does hereby approve said application with the following conditions: 1) Said application shall conform with Exhibit "B" on file in the Dublin Planning Department with the following revisions: a) A circulation plan with appropriate signing and striping shall be submitted to the Dublin Planning Department within 30 days. DP 83-20 b) The landscaping strip shall be extended along the east and north property lines. A final landscape plan shall be prepared, subject to review and approval of the Dublin Planning Department. The landscape plan shall include a greater density of planting than the existing plan. All landscaping shall be provided with an automatic irrigation system. c) Two street lights shall be installed with the location and design approved by the City Engineer prior to installation. d) The illegal roof sign on top of the existing building shall be removed and all other signage shall conform with the Zoning Ordinance within 30 days. e) A screening fence shall be erected from where the fence terminates on the west property line to the front property line. Said fence shall be approved by the Planning Department prior to installation. f) If the existing perimeter fence is damaged or removed it shall be replaced as directed by the Dublin Planning Department. g) The applicant shall submit a written agreement and faithful performance and warranty bond for the required improvements within 30 days and complete the improvements within 180 days. h) This approval shall remain in effect until 7/16/87 and shall be revocable for cause in accordance with Section 8.94.7 PASSED, APPROVED AND ADOPTED this 16th day of July, 1984.
