A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING A CONDITIONAL USE PERMIT CONCERNING PA 84-038,
AUTOMATION ELECTRONICS CORPORATION
WHEREAS, Automation Electronics Corporation filed a
Conditional Use Permit and Site Development Review application
for a Phase I , three-story building ( 40, 000 sq.ft . ; total :
100, 000 sq. ft . ) to be utilized for office and light
manufacturing uses on the south side of Dublin Boulevard, across
from of Silvergate Drive APN 941-1570-2-2 ; and
WHEREAS, the Planned Development applicable to the site
which was approved by the Alameda County Board of Supervisors on
7/10/80 , allows, subject to a Conditional Use Permit, light
manufacturing as an incidental use to the principal office use;
and
WHEREAS, the Planning Commission did hold a public
hearing on said application on August 6, 1984 ; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, a Negative Declaration with mitigation
measures has been prepared in accordance with the provisions of
the California Environmental Quality Act ; and
WHEREAS, a Staff report was submitted recommending the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony as hereinabove
set forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that :
a) The use is required by the public need to provide
telecommunication equipment;
b) The use will be properly related to other land
uses and transportation and service facilities in the vicinity as
daytime activities will be commensurate with present use of
properties in the neighborhood;
c ) The use, if permitted, under all the circumstances
and conditions of this particular case, will not materially
affect adversely the health or safety of persons residing or
working in the vicinity, or be materially detrimental to the
public welfare or injurious to property or improvements in the
neighborhood, as all applicable regulations will be met;
d) The use will not be contrary to the specific
intent clauses or performance standards established for the
District in which it is to be located; and
e) The existing Planned Development is an appropriate
classification and is consistent with the proposed General Plan.
BE IT FURTHER RESOLVED that the Dublin Planning
Commission does hereby approve the Conditional Use Permit as
shown on plans labeled Exhibit "A" and materials on file with the
Dublin Planning Department the following conditions :
1) All manufacturing shall be conducted inside the
building;
2 ) Any noise or odors shall be controlled so as not
to create a nuisance to the adjacent residential
areas ;
3 ) No materials shall be stored outside the building;
4 ) No storage of hazardous materials shall be done
without the approval of the Building Official and
Fire Department;
5 ) The manufacturing shall be limited to electronic
component assembly operations which shall not
involve any noise or odor emissions, toxic
chemicals or wastes, air pollutants or water
pollutants .
6 ) No large trucks, forklifts or the like shall be
stored on the site;
7 ) The manufacturing area shall not exceed 25% of the
gross floor area of the entire building.
8 ) Site Development Review approval shall be gained
from the Cityof Dublin. Any modification of the
project design approved by the Site Development
Review shall supercede the project design on the
Conditional Use Permit application and shall be
considered as an approved modification of the
Conditional Use Permit project design.
9 ) This approval shall be valid until 8/6/87 and
shall be revocable for cause in accordance with
Section 8-94 . 7 of the Dublin Zoning Ordinance
PASSED, APPROVED AND ADOPTED on this 6th day of
August, 1984 .
