RESOLUTION NO. 84-41
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 84-045, MIKE WASECA'S CONDITIONAL USE PERMIT AND SITE
DEVELOPMENT REVIEW MODIFICATION TO ALLOW TRACTOR SALES AT 6797
DUBLIN BOULEVARD
WHEREAS, Mike Waseca filed a Conditional Use Permit and
Site Development Review Modification application to allow tractor
sales at 6797 Dublin Boulevard; and
WHEREAS, the Planning Commission did hold a public
hearing on said application on 8/20/84; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
Quality Act and has been found to be categorically exempt; and
WHEREAS, a Staff report was submitted recommending the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony as hereinabove set
forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
a) The use is required by the public need to provide
tractor sales and service;
b) The use will be properly related to other land uses
and transportation and service facilities in the vicinity as
daytime activities will be commensurate with present use of
properties in the commercial Zoning District;
c) The use, if permitted, under all the circumstances
and conditions of this particular case, will not materially affect
adversely the health or safety of persons residing or working in
the vicinity, or be materially detrimental to the public welfare
or injurious to property or improvements in the area as all
applicable regulations will be met;
d) The use will not be contrary to the specific intent
clauses or performance standards established for the District in
which it is to be located, as tractor sales and service, with
limited impacts, is consistent with the character of the
commercial district;
BE IT FURTHER RESOLVED that the Planning Commission does
hereby conditionally approve said application subject to the
following conditions:
1) No sales, storage, display or servicing of tractors
is to take place outside the building.
2) Demonstration of tractors is to be done at the
customer's home only.

3) Only minor repair and servicing of the tractors is
to be done at the site (minor repair is limited to oil changes,
warranty work and clutch or transmision adjustments), major
repairs and servicing is to be done elsewhere.
4) Should the two damaged trees not return to
normal vigor by 8/1/85, the property owner shall replace the
trees in kind within 60 days thereafter.
5) This approval is valid until 8/6/89, and shall be
revocable for cause in accordance with Section 8-90.3 of the
Dublin Zoning Ordinance.
