HomeMy WebLinkAboutPC Reso 84-051 PA 84-048.1 Shamrock Ford additional freestanding Sign RESOLUTION NO. 84-51 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 84-048.1 A REQUEST BY SHAMROCK FORD FOR A VARIANCE TO ERECT AN ADDITIONAL FREESTANDING SIGN AT 7499 DUBLIN BOULEVARD WHEREAS, Rich Robbins, representing Shamrock Ford, filed an application for a Variance to erect an additional freestanding sign at 7499 Dublin Boulevard; and WHEREAS, the Planning Commission did hold a public hearing on said application on 10/1/84 and 10/15/84; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the Staff Report was submitted recommending that the Planning Commission consider the draft resolution; and WHEREAS, the Planning Commission did hear and consider all said reports, recommedations and testimony as hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: 1) There are special circumstances, applicable to the property which would deprive the property of privileges enjoyed by other property in this vicinity under the identical zoning classification. FACTS: The property is a large site with substantial frontages on two separate streets. The property consists of approximately 6 acres of land with 438+ ft. of frontage on Amador Plaza Road and 472+ ft. of frontage on Dublin Boulevard. The Ford Motor Company has retained Site Control of the property since 1973. The Site Control is still effective and the applicant/property owner does not have the ability to subdivide the property. If the applicant/property owner was able to subdivide the property, he would be able to erect an additional freestanding sign, as allowed by the Zoning Ordinance. 2) The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone. FACTS: If the applicant/property owner did have Site Control, he would be able to subdivide the property and erect an additional freestanding sign which would be consistent with the Land Use regulations of other properties in the same vicinity and zone. DP 83-20 3) The granting of the application will not be detrimental to the persons or property in the neighborhood or to the public welfare. FACTS: The granting of the application as conditioned will not be detrimental to the public welfare. The application will allow for an attractive sign to be erected along the Amador Plaza Road street frontage and the sign will provide effective identification to assist the public in traveling directly to the site. 4) The requested variance as conditioned will not be inconsistent with the preliminary policy decisions of the Draft General Plan. 5) There is little or no probability that the variance will be detrimental to or interfere with the future General Plan should it ultimately be inconsistent with the future General Plan. BE IT FURTHER RESOLVED that the Dublin Planning Commission does hereby adopt said Variance application subject to the following conditions: 1) The height of the freestanding sign shall not exceed 20' and shall have the appropriate area dimensions (maximum 6' x 10' or equivalent, single faced or double faced); 2) The freestanding sign shall be located in a planter of appropriate dimensions; 3) The final sign details, including size, height, colors and location shall be approved by the Planning Department prior to installing the sign; and 4) The applicant shall provide documentation of Ford Motor Company's Site Control. 5) This approval shall be void unless the sign is installed by 10/15/85.
