HomeMy WebLinkAboutPC Reso 84-052 PA 84-068 Gary Burns application to allow reconditioned automobiles RESOLUTION NO. 84-52 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 84-068 GARY BURNS CONDITIONAL USE PERMIT AND SITE DEVELOPMENT REVIEW APPLICATION TO ALLOW THE SALE OF RECONDITIONED AUTOMOBILES AT 6787 DUBLIN BOULEVARD WHEREAS, Gary Burns filed a Conditional Use Permit and Site Development Review application to allow the sale of reconditioned automobiles at 6787 Dublin Boulevard; and WHEREAS, the Planning Commission did hold a public hearing on said application on November 19, 1984; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the Staff Report was submitted recommending the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony as hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a) The uses require by the public need to provide a place where one can find reconditioned automobiles b) The use will be properly related to other land uses and transportation and service facilities in the vicinity as daytime activities will be commensurate with the present use of properties in the commercial zoning district c) The use, if permitted under all of the circumstances and conditions of this particular case will not materially affect adversely the health or safety of persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improvements in the area as all applicable regulations will be met d) The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located as the sale of reconditioned automobiles with limited impact consistent with the character of the commercial e) The application will be consistent with the Draft General Plan f) Should the application ultimately be found to be inconsistent with the Draft General Plan, there is little or no probability that the use will be detrimental or interfere with the future General Plan. DP 83-20 n BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve said application subject to the following conditions: Said conditions shall be subject to the review and approval of the Dublin Planning Department. 1) The use shall conform with materials labeled Exhibit 1 and 2 on file with the Dublin Planning Department 2) The 8 parking spaces in front of the applicant's store which are to be utilized exclusively for his use shall be appropriately designated by interlocking pavers or a similar surface treatment to provide a clear distinction between the auto display area and parking lot 3) All signs shall conform to the Sign Program for this site 4) No cars shall be displayed elsewhere on this site other than the designated area 5) The design of the double glass entry doors and other modifications to the storefront shall be approved by the Planning Department 6) Comply with the applicable requirements of the building official and Dublin/San Ramon Services District Fire Department 7) The parking layout immediately to the west of the display area shall be revised so that the nine compact spaces are restriped to standard spaces (9' x 19' with 2' of overhang into the planter). Double striping shall be used. Striping details shall be approved by the Planning Department 8) Adequate security lighting shall be approved to the satisfaction of the Planning Director 9) This approval is valid until November 19, 1989 and shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance PASSED, APPROVED AND ADOPTED this 19th day of November, 1984.
