A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 84-065 ST. PHILIP LUTHERAN CHURCH CONDITIONAL USE
PERMIT. AN EXTENSION OF A CONDITIONAL USE PERMIT TO ALLOW THE
CONTINUED OPERATION OF A PRESCHOOL FOR 24 CHILDREN AT 8850 DAVONA
DRIVE, DUBLIN, CALIFORNIA
WHEREAS, Henry Aschbrenner, representing St. Philip
Lutheran Church filed an application for a Conditional Use Permit
to allow the continued operation of a preschool for a maximum of
24 children at 8850 Davona Drive; and
WHEREAS, the Planning Commission did hold a public
hearing on said application on November 19, 1984; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
Quality Act and has been found to be categorically exempt; and
WHEREAS, the Staff Report was submitted recommending
the application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony as here in above
set forth;
NOW, THEREFORE, SETT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
a) The use is required by the public need for preschool purposes
b) The use will be properly related to other land uses and
transportation and service facilities in the vicinity as
daytime activities will commence with present use of
properties in the neighborhood
c) The use if permitted under the circumstances and conditions
of this particular case will not materialy affect adversely
the health or safety of persons residing or working in the
vicinity or be materially detrimental to the public welfare
or injurious to property or improvements in the neighborhood
as all applicable regulations will be met.
d) The use will not be contrary to the specific intent clauses
for performance standards established for the district in
which it is located as a preschool with limited impacts is
consistent with the character of the residential district
e) The preschool will be consistent with the draft policies
in the Dublin General Plan
f) Should the use ultimately found to be inconsistent with the
Draft General Plan there is little or no probability that the
use will be detrimental or interfere with the future General
Plan.

BE IT FURTHER RESOLVED that the Planning Commission does
hereby conditionally approve said application subject to the
following conditions:
1) The number of children in the preschool shall not exceed
24
2) Preschool activities shall be limited between 7 a.m. and
6 p.m.
3) No outside activities shall take place before 8:00 a.m.
4) All loading and unloading shall occur upon the premises
and not in the adjacent residential area
5) Playground activity shall be controlled so as not to create
a nuisance to the adjoining residential neighborhood
6) Comply with the requirements of the Dublin/San Ramon Services
District Fire Department
7) Evidence shall be submitted that all the appropriate state
licenses and permits have been acquired.
8) This approval shall be valid until July 31, 1986 and is
revocable for cause in accordance with Section 8-90.3.
PASSED, APPROVED AND ADOPTED this 19th day of
November, 1984.
