HomeMy WebLinkAboutPC Reso 84-056 PA 84-051 Pak n save RESOLUTION NO. 84-56 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN MODIFYING PA 84-051, PLANNING DIRECTOR APPROVAL OF THE SITE DEVELOPMENT REVIEW FOR PAK 'N SAVE AND DENYING THE APPEAL BY ANGELO GASPARE, PROPERTY OWNER WHEREAS, John Sutti and Associates representing Pak 'N Save, filed an application for a Site Development Review for landscaping and exterior modifications to a site located at 6633 Dublin Boulevard; and WHEREAS, the Planning Director did approve said Site Development Review application on November 1, 1984; and WHEREAS, Angelo Gaspare, property owner, filed an appeal of said Planning Director's action on November 9, 1984; and WHEREAS, the Planning Commission did hear said appeal at a public hearing on 12/3/84; and WHEREAS, the Planning Commission did continue said public hearing to December 17, 1984; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with provisions of the California Environmental Quality Act and found to be categorically exempt; and WHEREAS, the Staff Report was submitted recommending that the appeal be denied; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony as herein above set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that; as herein modified: a) The Site Development Review, as approved by the Planning Director, is in the best interest of the City b) The Site Development Review, as approved by the Planning Director, will protect the public, health, safety and general welfare by promoting more efficient traffic circulation and by establishing a more attractive site c) The conditions imposed by the Planning Director on the Site Development Review are reasonable and appropriate and are needed to achieve a more efficient site from a traffic standpoint d) The approval of the Site Development Review will be consistent with the draft policies in the Dublin General Plan e) Should the Site Development Review ultimately be found to be inconsistent with the Draft General Plan, there is little or no probability that the use would be detrimental or interfere with the future General Plan DP 83-20 IN • BE IT FURTHER RESOLVED that the Planning Commission does hereby modify the Planning Director's approval of PA 84-051 and hereby denies the appeal of Angelo Gaspare subject to the following modified conditions of approval: Conditions of Approval Unless stated otherwise, all Conditions shall be complied with prior to issuance of building permits and shall be subject to the review and approval of the Planning Department. 1) Comply with the Site Development Review plans labeled Exhibit "A" on file with the Planning Department as amended by the following conditions. 2) Comply with the Standard Site Development Review and Commercial Security Building Requirements (attached). 3) Title 24 handicap access requirements shall be complied with (attached). 4) A landscape maintenance agreement shall be signed (attached). 5) Comply with the requirements of the Dublin San Ramon Services District. 6) Comply with the requirements of the Fire Department (see letter dated 9/6/84). 7) Dedicate right-of-way along Dublin Boulevard and Dougherty Road in conformance with the adopted plan lines for said streets. 8) The entrance adjacent to Dublin Court shall be redesigned for conformance with the future signalization project and more efficient traffic flow. 9) Provide one point of access (20' wide) to the westerly parcel. The property owner shall provide an agreement, subject to review and approval by the City Attorney, that assures that should access become available to the property to the west, the property owner shall enter into a reciprocal access agreement to allow vehicular circulation to occur between the two properties., The point of access shall be properly aligned as shown on Exhibit "D" Staff Supplement on file with the Planning Department. 10) Dedicate an easement for vehicle detector loops at the Dublin Boulevard exit at Dublin Court. 11) Install street trees along Dublin Boulevard, Dougherty Road and Sierra Lane. 12) The landscape strip adjacent to Dougherty Road shall be widened to 8'. 13) Additional trees or the equivalent shall be planted in enlarged planter areas along the front of the building in order to soften the appearance. 14) All landscaped areas shall be provided with an automatic irrigation system. 15) A final planting and irrigation plan shall be approved. 16) The surface area above the canopy shall have architectural treatment similiar to the existing exterior surface on the walls (scored stucco). 17) The painted red stripe on the building face shall be modified to be a physical improvement to the wall, which can be a reveal, tile insert, wood band or the equivalent. DP 83-20 r ., 18) A color and materials pallet shall be approved. 19) A sign program shall be as shown on Cal-Neon's plans dated 9/11/84, except that the exterior lights are not approved and the height shall not exceed 20'. The sign shall have a maximum area of 6' x 10' or equivalent on a single face, or each side if double faced. The free-standing sign shall be located in a planter of appropriate dimensions; the location shall be determined by the Planning Department. 20) The existing pylons within the parking lot shall be removed. 21) The exterior and interior improvements shall be installed prior to final inspection and occupancy. 22) This approval is valid until December 17, 1986. If substantial construction has not occurred by that date, this approval shall, be void. PASSED, APPROVED AND ADOPTED this 17th day of December, 1984.
