A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 84-079 PARKWAY BAPTIST CHURCH REQUEST FOR A
CONDITIONAL USE PERMIT TO ALLOW CONTINUED USE OF TWO EXISTING
TEMPORARY TRAILERS AT 7485 VILLAGE PARKWAY
WHEREAS, Don L. Lewis, representative of Parkway
Baptist Church filed an application for a Conditional Use Permit
for an extension of time of one year for use of two existing
trailers at 7485 Village Parkway; and
WHEREAS, the Planning Commission did hold public
hearings on said application on January 7, 1985, January 21, 1985,
and February 5, 1985; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and,
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
Quality Act and has been found to be categorically exempt; and,
WHEREAS, a Staff Report was submitted recommending the
application be conditionally approved; and,
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations, and testimony as hereinabove
set forth;
NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning
Commission does hereby find that:
a. The trailers are required by the public need to provide
space for use for education and religious activities and space for
use as a music library and private study;
b. The uses will be properly related to other land uses, and
transportation and service facilities in the vicinity, as daytime
and early evening activities will be commensurate with present use
of properties in the neighborhood;
c. The uses, will not materially adversely affect the health
or safety of persons residing or working in the vicinity, or be
materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood, as all applicable
regulations will be met;
d. The uses will not be contrary to the specific intent
clauses for performance standards established for the District in
which it is to be located, as a school and church, with limited
impacts, is consistent with the character of the residential
district;
e. The approval of the Conditional Use Permit will be
consistent with the draft policies in the Dublin General Plan;

f. Should the Conditional Use Permit be found to be
inconsistent with the Draft General Plan, there is little or no
probability that the use would be detrimental or interfere with
the future General Plan.
BE IT FURTHER RESOLVED that the Planning Commission does
hereby conditionally approve said application as shown by
materials labelled Exhibit "B" and Exhibit 2'C", on file with the
Dublin Planning Department, subject to the following conditions:
1. The use of Trailer #1 shall be for a music library and
private study. The use of the Trailer #2 shall be for educational
and religious activities. Any modifications to the use of either
trailer shall be subject to review and approval of the Planning
Director.
2. All activities conducted within Trailers #1 and #2 shall be
restricted to occur between the hours of 7:00 a.m. to 9:00 p.m.
only. No outside activities in proximity of the trailers may
occur before 8:00 a.m.
3. All activities shall be controlled so as not to create a
nuisance to the adjoining residential areas.
4. This Conditional Use Permit shall expire on and both trailers
shall be removed from the lot by July 21, 1985, unless the
Conditional Use Permit is extended as follows;
a. Prior to July 21, 1985, the applicant shall submit
complete Conditional Use Permit (CUP) and Site
Development Review (SDR) submittals to the Planning
Department (as determined complete by the Planning
Department Staff). If the required material is
submitted by that date, then PA 84-079, shall expire on
January 21, 1986.
b. Prior to January 21, 1986, the applicant shall submit
complete working drawings to the Building Inspection
Department along with an application for a building
permit. If the required material is submitted by that
date, then PA 84-079 shall expire on July 21, 1986.
5. The applicant shall comply with all requirements of the
Dublin Building Department, including handicapped accessibility
requirements. Within 30 days of the approval date of this permit,
a code inspection shall be arranged by the applicant through the
Building Inspection Department to determine what physical changes
must be made to conform to building code requirements. Any
changes required as a result of the code inspection shall be made
within 90 days of said inspection.
6. Within 30 days of the approval date of this permit, the
applicant shall submit a landscape and irrigation plan for a tree
and/or shrub planting program on the street side of the recently
planted lawn area for review and approval by the Planning
Director. Said landscaping and irrigation shall be installed
within 120 days of the approval date of this permit.
7. Within 30 days of the approval date of this permit, the
applicant shall submit plan detailing landscape and/or fence
screening proposed along the north side of the two trailers.
Plans are subject to review and approval by the Planning Director.
Said landscaping and/or fence screening shall be installed within
120 days of the approval date of this permit.

8 . Within 30 days of the approval date of this permit, the
applicant shall remove the debris that is presently located just
north of trailer #1 and shall keep the entire site free and clear
of any additional debris .
PASSED, APPROVED AND ADOPTED this 4th day of
February, 1985.
