A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 85-003 A CONDITIONAL USE PERMIT FOR THE LATTER DAY
SAINTS CHURCH TO ALLOW A 1,740 SQ. FT.
CLASSROOM AT 8203 VILLAGE PARKWAY
WHEREAS, David Rausch, representing of Latter-Day
Saints Church filed an application for a Conditional Use Permit
and Site Development Review to allow a 1,740 sq. ft. classroom at
8203 Village Parkway.
WHEREAS, the Planning Commission did hold public
hearings on said application on March 18, 1985; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and,
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
Quality Act and has been found to be categorically exempt; and,
WHEREAS, a Staff Report was submitted recommending the
application be conditionally approved; and,
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations, and testimony as hereinabove
set forth;
NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning
Commission does hereby find that:
a. The classroom is required by the public need to provide
space for religious activities and private study;
b. The use will be properly related to other land uses, and
transportation and service facilities in the vicinity, as daytime
and early evening activities will be commensurate with present use
of properties in the neighborhood;
c. The uses, will not materially adversely affect the
health or safety of persons residing or working in the vicinity,
or be materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood, as all applicable
regulations will be met;
d. The uses will not be contrary to the specific intent
clauses for performance standards established for the District in
which it is to be located, as a clasroom and church, with limited
impacts, is consistent with the character of the residential
district;
e. The use is consistent with the policies in the Dublin
General Plan.
BE IT FURTHER RESOLVED that the Planning
Commission does hereby conditionally approve said application as
shown by materials labelled Exhibit "C", on file with the Dublin
Planning Department, subject to the following conditions:
Unless otherwise specified, all conditions shall be complied with
prior to occupancy and shall be subject to the review and approval
of the Planning Department.
1. The classroom shall be used only for religious purposes or
private study and not as an elementary classroom.

2. The damaged sidewalk on Village Parkway shall be repaired as
directed by the City Engineer.
3. A drainage plan for the area around the classroom shall be
developed for the review and approval of the City Engineer.
4. Comply with the requirements of the Fire Department (see
attached letter dated 2/7/85.)
5. This Conditional Use Permit shall be bound by the conditions
of the Site Development Review.
6. This approval is valid until 3/18/90 and shall be revocable
for cause in accordance with Section 8-90.3 of the Dublin
Zoning Ordinance.

March, 1985.
