PA 85-047 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 85-056 ALDEN (APPLICANT)/BATTAGELLO (OWNER) LIMOSINE SALES, MANUFACTURING AND LEASING FOR OUTSIDE USE AT 6948 SIERRA COURT. WHEREAS, Alden (Applicant)/Battagello (Owner) request approval of a Conditional Use Permit to allow use of a portion of a 5,000 + sq. ft. tenant space of an existing structure located at 6948 Sierra Court for limousine sales, manufacturing and leasing for outside use, more specifically described as APN 941- 2756-05; and WHEREAS, the adopted City of Dublin Zoning Ordinance restricts the sales and/or leasing of limousenes in a M-1; Light Industrial District until a Conditional Use Permit is secured; and WHEREAS, the Planning Commission did hold a public hearing on said application on September 3, 1985; and WHEREAS, proper notice of said public hearing was given to all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the Planning Commission finds that the Conditional Use Permit will not have a significant environmental impact; and WHEREAS, the Staff report was submitted recommending that the Conditional Use Permit application be approved; and WHEREAS, the Planning Commission did hear and consider, all said reports, recommendations and testimony herein above setforth; and WHEREAS, the proposed land uses, if conditionally approved, are appropriate for the subject property in terms of being compatible to existing land uses in the area and will not overburden public services; Commission fi NOW nds:THEREFORE, BE IT RESOLVED THAT THE Planning a) Uses of the subject light industrial tenant space for limousine sales, manufacturing and leasing for outside use provide for the public need to provide a range of services not readily available in the City; b) The uses will be properly related to other land uses, and transportation and service facilities in the vicinity, as the proposed uses of the building are compatible when compared to the type and nature of operations typically found in light industrial areas and the light industrial uses currently in operation in the immediate vicinity; c) The uses will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the publc welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; • d) The uses will not be contrary to the specific intent clauses or performance standards established for the District in which they are to be located; e) The approval of the Conditional Use Permit will be consistent with the Dublin General Plan; BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve said Conditional Use Permit application as shown by materials labelled Exhibit B and Attachment 2, on file with the Dublin Planning Department, subject to the following conditions: 1. Operation of the proposed business shall be as generally as shown on the floor plan submitted with the application and dated received June 26, 1985, and as described by the applicant's written statements dated received by the Dublin Planning Department on June 10 and 21, 1985. Development shall be subject to final review and approval by the Planning Director prior to the issuance of a building permit or occupancy of the proposed tenant uses and shall be subject to the conditions listed below. 2. The permit is issued to the applicant, William Alden, only and shall not be transferable. 3. The permit shall be valid for a period of three (3) years, at which time the applicant may request an administrative extension for an additional three (3) years from the Zoning Administrator. The Zoning Administrator may grant the extension upon making a determination that the findings made as part of this Resolution remain applicable. Failure to establish the use within one year of the effective date of the permit will cause the permit to become null and void. 4. No loudspeakers or amplified music shall be permitted outside the enclosed building. All activities associated with the proposed use of this tenant space shall be conducted entirely within the subject tenant lease space including the parking and/or storage of cars. The trash enclosure located in the northwest corner of the site shall be removed within sixty days of the effective date of this permit. 5. A raised 4" to 6" concrete end-curb planter strip shall be installed along the northeast side of the newly established concrete walkway serving the subject tenant space. Sod shall be replanted in this area to provide a "finished" appearance. Landscaping and irrigation shall be established and maintained along the southwest side of this walkway (immediately adjoining the building). 6. All signs established at this site shall be subject to review and approval by the Planning Director as regards size, location, copy and construction materials and design. The proposed freestanding sign submitted with the application is expressly not approved. A modified Low Profile Freestanding Sign may be established in conjunction with this permit if it reflects the following design criteria; A. The sign cabinet for the subject Low Profile Freestanding Sign shall comply with the following; 1) Maximum single faced sign area - 24 square feet. 2) Maximum sign cabinet height - 6 feet 3) Maximum sign cabinet width - 6 feet 4) Copy for the sign shall provide possible future tenants, in this building, or the applicant shall document that the owner's approval has been secured that to indicate acknowledgement said freestanding sign constitutes the only allowable permanent freestanding sign to be established at this site. B. The overall project name and/or street address range shall be included on the Low Profile Freestanding Sign. The manner that this information is incorporated into the sign shall be subject to review and approval by the Planning Director. C. A new tenant sign program (wall and window signs) shall be developed for this project, and shall be subject to review and approval by the Planning Director. All project tenants shall observe the established tenant sign program. The existing wall mounted signage for the adjoining vacant tenant space shall be removed within sixty days of the effective date of this permit. D. The use and manner of sign lighting, either internal or external, of the new Low Profile Freestanding Sign and any wall signs shall be subject to review and approval by the Planning Director, prior to installation. E. Signage used on this site to indicate space available for lease shall not exceed a maximum area of 24 square feet single faced nor a maximum height of six feet. F. The "space available" freestanding sign and the Low Profile Freestanding Sign shall respectively observe minimum setbacks of ten feet from the front property line and from any adjoining driveway. 7. The applicant shall comply with all requirements of the Dublin Building Department. The active building permit (#85290) shall be modified to include work for the newly installed 10' X 10' roll-up door on the north elevation of the structure. The Saw-cut work for this roll-up door shall be modified to give a "finished" appearance matching the other roll-ups in the building. 8. Prior to the issuance of a building permit or occupancy of the proposed uses, the developer shall submit a letter documenting that the requirements of the DSRSD - Fire Department have been satisfied. 9. Development shall comply with the City of Dublin Police Services Standard Commercial Building Security Requirements. 10. Wheelstops, of a number, location and design approved by the Planning Department, shall be installed for parking for the entire project within sixty days of the effective date of this permit. The required handicapped parking spaces shall be upgraded as regards indentification to meet minimum State requirements. A revised parking plan for the parking in the northwest corner of the site shall be submitted for review and approval by the Planning Department within sixty days of the effective date of this permit. 11.
