RESOLUTION NO. 85-052
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 85-093 WONDERFUL WORLD OF LEARNING CONDITIONAL USE
PERMIT APPLICATION TO CONTINUE OPERATION OF A DAY CARE AND PRE-
SCHOOL CENTER AT 8010 HOLANDA LANE.
WHEREAS, Ramon Ortega filed an application for a
Conditional Use Permit to allow the continued operation of a day
care and pre-school center for a maximum of 34 children; and
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
Quality Act and a Negative Declaration has been adopted (Planning
Commission Resolution No. B5-051 ) for this project as it will
have no significant effect on the environment; and
WHEREAS, Notice of Public Hearing was published in the
Tri-Valley Herald, posted in public buildings, and mailed to
property owners within 300 feet of the project in accordance with
California State Law; and
WHEREAS, a Staff Analysis was submitted recommending
conditional approval of the application; and
WHEREAS, the Planning Commission held a Public Hearing
on November 18, 1985, to consider all reports, recommendations,
and testimony;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
a) the use is required by the public need in that
working parents need day care and pre-school facilities, and this
project has served this need since 1969;
b) the use will be properly related to other land uses
and transportation and service facilities in the vicinity in that
the site is located on a major residential street, across from a
public school: the exterior of the day care/pre-school structure
resembles a single family residence; and the daytime activities of
the project will be commensurate with the present use of
surrounding properties within the neighborhood;
c) the use, under all the circumstances and conditions
of this particular case will not materially affect adversely the
health or safety of persons residing or working in the vicinity or
be materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood as all applicable
regulations will be met;
d) the use will not be contrary to the specific intent
clauses or performance standards established fo
r the district in
which it is to be located, in that the day care and pre-school
center is consistent with the character of the residential
district.
BE IT FURTHER RESOLVED that the Planning Commission does
hereby conditionally approve PA 85-093 as shown by materials
labeled "Exhibit C" on file with the Dublin Planning Department
subject to the following conditions:

1) The day care and pre-school center shall be limited
to a maximum of 34 children.
2) Hours of operation for the day care/pre-school
center shall be limited to the hours between 7:00 a.m. and 6:00
p.m.
3) The existing driveway shall be kept clear to
accommodate vehicles dropping off and picking up children
attending the facility.
4) The day care/pre-school operators shall direct
patrons of the facility dropping off and picking up children to
exit and enter Vomac Road via Holanda Lane rather than via
Millbrook.
5) The day care/pre-school operator shall at the
minimum on an annual basis make arrangements to have the Dublin
Police Services Child Abuse Program or an equivalent program
presented to the center's staff and children attending the
facility.
6) The applicant shall submit evidence to the Director
of Planning that the appropriate licenses and permits to operate a
day care and pre-school center have been obtained from the State.
7) Upon termination of the day care/pre-school use, the
applicant shall convert "Room 3" (See Exhibit C) back to a garage
accessible for parking cars.
8) The applicant shall post a bond, letter of credit,
or cash deposit with the City of Dublin in the amount of $500.00
(five hundred dollars) to secure the faithful performance of
Condition #7 (garage conversion). Said bond, letter of credit, or
cash deposite shall guarantee that these funds will be available
and that the instrument of credit will remain effective until
February 18, 1991.
9) This permit shall expire on 11/18/90 and shall be
revocable for cause in accordance with Section 8-90.3 of the
Dublin Zoning Ordinance. Complaints received prior to the
expiration of this permit shall result in the Planning
Commission's re-review of the permit.
PASSED, APPROVED AND ADOPTED this 18th day of November,
1985.
