A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 85-089 ST. RAYMOND'S SCHOOL CONDITIONAL USE PERMIT
APPLICATION TO ESTABLISH AN ELEMENTARY SCHOOL (GRADES K THROUGH EIGHTH) IN
PORTABLE BUILDINGS ON A VACANT PORTION OF THE EXISTING CHURCH SITE AT
11555 SHANNON AVENUE
WHEREAS, the applicant, Ronald J. Lagasse, Pastor, representing
the Roman Catholic Bishop of Oakland, filed an application for a Site
Development Review and a Conditional Use Permit to operate an elementary school
(grades Kindergarten through eighth) for a maximum of 250 students in portable
buildings at 11555 Shannon Avenue; and
WHEREAS, this application has been reviewed in accordance with the
provisions of the California Environmental Quality Act and a Negative
Declaration has been adopted (Planning Commission Resolution No. 86-005) for
this project as it will have no significant effect on the environment; and
WHEREAS, notice of Public Hearing was published in The Herald,
posted in public buildings, and mailed to property owners within 300 feet of
the project in accordance with California State Law; and
WHEREAS, a Staff analysis was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning Commission held a Public Hearing on February
18, 1986, to consider all reports, recommendations, and testimony;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
a) The use is required by the public need in that there are no
other Catholic schools in Dublin, San Ramon, or Pleasanton, and it meets the
public need for an alternative to public education;
b) The use will be properly related to other land uses and
transportation and service facilities in the vicinity in that the site is
located on a major residential street, across from a public park and community
center, and the daytime activities of the project will be commensurate with the
present use of surrounding properties within the neighborhood;
c) The use, under all the circumstances and conditions of this
particular case, will not materially affect adversely the health or safety of
persons residing or working in the vicinity or be materially detrimental to the
public welfare or injurious to property or improvements in the neighborhood as
all applicable regulations will be met;
d) The use will not be contrary to the specific intent clauses or
performance standards established for the district in which it is to be
located, in that the elementary school is consistent with the character of the
residential district.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
conditionally approve PA 85-089 as shown by materials labeled "Exhibit A" on
file with the Dublin Planning Department subject to the approval of the related
Site Development Review and to the following conditions:
1) St. Raymond Catholic School shall be limited to a maximum total
of 250 students and shall be limited to grades Kindergarten through eighth
grade.
2) Hours of operation for the school shall be limited to 8:00 a.m.
to 2:30 p.m. Monday through Friday.

3) Outside play activities shall not occur prior to 8:00 a.m.
4) School noise shall be controlled so as not to create a nuisance
to the adjoining residential neighborhood.
5) The drop-off and pick-up of students shall occur on-site within
the existing parking lot area.
6) At the minimum, on an annual basis the school operator shall
make arrangements to have the Dublin Police Services Child Abuse Program, or an
equivalent program, presented to the school staff and all children attending
the school facility.
7) This permit shall expire on July 1, 1987, and shall be
revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning
Ordinance.
