HomeMy WebLinkAboutPC Reso 86-039 PA 86-057 Chrsyler Corp; dealership including automotive sales and service etc RESOLUTION NO. 86 - 039 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 86-057 CHRYSLER CORPORATION CONDITIONAL USE PERMIT TO OPERATE AN AUTO DEALERSHIP INCLUDING AUTOMOTIVE SALES AND SERVICE, AUTOMOTIVE PAINT AND REPAIR AND SALE OF MERCHANDISE SUCH AS AUTO PARTS AT 6451 SCARLETT COURT WHEREAS, the Applicant, Chrysler Corporation filed an application for a Conditional Use Permit to operate an automotive dealership at 6451 Scarlett Court; and WHEREAS, this application has ben reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, notice of Public Hearing was published in The Herald, posted in public buildings, and mailed to property owners within 300 feet of the project in accordance with California State Law; and WHEREAS, the City is currently studying various alternatives for the alignment of Dublin Boulevard extension. Although the specific alternative has not been selected, the future Dublin Boulevard extension is likely to affect a portion of the property at 6451 Scarlett Court (APN 941-550-12-7); and WHEREAS, a Staff analysis was submitted recommending conditional approval of the application; and WHEREAS, the Planning Commission held a Public Hearing on July 21, 1986, to consider all reports, recommendations, and testimony; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a) The use is required by the public need in that the use offers the Dublin consumer a specific auto dealer sales and services currently not available within the City; b) The use will be properly related to other land uses and transportation and service facilities in the vicinity in that the project will be commensurate with the present use of surrounding properties within the neighborhood; c) The use, under all the circumstanmces and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood as all applicable regulations will be met; d) The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located, in that the auto dealership is consistent with the character of the surrounding Commercial and Industrial District. BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve PA 86-057 as shown by materials labeled "Exhibit A" on file with the Dublin Planning Department subject to the following conditions. All said Conditions of Approval shall be met prior to occupancy. 1. The minimum dimension for compact parking stalls is 8 feet x 17 feet. Proposed parking stalls which do not meet this minimum requirement shall be corrected or removed. -1- 2. The following type and number of parking spaces shall be designated on the parking lot pavement and shall be maintained and kept available on a continuous basis for the designated user group: 13 Employee Parking Spaces 12 Customer Parking Spaces 8 Service Parking Spaces 3. The Applicant shall correct deficiencies in the existing frontage improvements such as off-set sidewalk, subject to review and approval of the City Engineer. 4. The Applicant shall maintain existing security lighting on the front of the main building and increase security lighting for the eastern perimeter and the rear portion of site, subject to review and approval by the Dublin Police Department and City Engineer. 5. The Applicant shall install two street lights as previously required in Planning Commission Resolution No. 84-36 (PA 84-029), the design and location subject to review and approval of the City Engineer. 6. Prior to expiration of this permit the applicant shall obtain approval of a more extensive Conditional Use Permit indicating building additions and site improvements such as landscaping and lighting, and addressing the future Dublin Boulevard extension alignment. 7. Subsequent site plans for this project shall be prepared by a licensed architect. 8. This permit shall expire on November 1, 1986, and shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
