HomeMy WebLinkAboutPC Reso 86-065 PA 86-089 Chrysler Corp n RESOLUTION NO. 86 - 065 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 86-089 CHRYSLER CORPORATION SITE DEVELOPMENT REVIEW TO OPERATE AN AUTO DEALERSHIP AT 6451 SCARLETT COURT WHEREAS, the Applicant, Chrysler Corporation, filed an application for a Conditional Use Permit and Site Development Review to operate an automotive dealership at 6451 Scarlett Court; and WHEREAS, the City of Dublin Zoning Ordinance provides in part for the establishment of an automobile, camper, boat and trailer sales, storage lot as a Conditional Use; and WHEREAS, the Planning Commission did hold a public hearing on said application on November 3, 1986; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the City is currently studying various alternatives for the alignment of Dublin Boulevard extension. Although the specific alternative has not been selected, the future Dublin Boulevard extension is likely to affect a portion of the property at 6451 Scarlett Court (APN 941-550-12-7); and WHEREAS, a Staff Report was submitted recommending that the Conditional Use Permit application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a) All provisions of Section 8-95.0 through 8-95.8 Site Development Review, of the Zoning Ordinance are complied with; b) This application, as modified by the Conditions of Approval, will promote orderly, attractive, and harmonious development, recognized environmental limitations on; stabilize land values and investments; and promote the general welfare by preventing establishment of uses or erection of structures having qualities which would not meet the specific intent clauses or performance standards set forth in the Zoning Ordinance and which are not properly related to their sites, surroundings, traffic circulation, or their environmental setting; c) The approval of the application as conditioned is in the best interests of the public health, safety, and general welfare; d) General site considerations, including site layout, orientation, and the location of buildings, vehicular access, circulation and parking have been designed to provide a desirable environment for the development; n e) General architectural considerations, including the character, scale, and quality of the design, the architectural relationship, with the site and other buildings, building materials, colors, exterior lighting, and similar elements have been incorporated in order to insure compatibility of this development with its design concept and the character of adjacent buildings; f) General landscape considerations including the location, type, size, color, texture, and coverage of plant materials, provisions for irrigation, maintenance and protection of landscaped areas and similar elements have been considered to insure visual relief to complement buildings and structures and to provide an attractive environment for the public. BE IT FURTHER RESOLVED that the Planning Commission does hereby approve Site Development Review application PA 86-089 as shown by materials labeled Exhibit A, on file with the Dublin Planning Department, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to issuance of building permits and shall be subject to Planning Department review and approval. General Conditions: 1. Comply with the plans labeled 'Exhibit A' as may be amended by the related Conditional Use Permit and these conditions. 2. Comply with all applicable Building Code requirements. 3. Comply with applicable Site Development Review standard conditions (attached). 4. Comply with applicable Dublin Police Services Standard Commercial Building Security Requirements (attached). Site Plan and Landscape Plan 5. Submit detailed landscape and irrigation plan (1 inch 20 feet scale) along with a cost estimate of works and materials subject to Planning Department review and approval indicating: 1) raised landscaping planters within the parking area; 2) proposed supplemental landscaping along front perimeter of property including replacement of damaged, diseased, or dead plants; 3) no landscape strip along the western property line is required; however, the western landscape triangle shall be completed; 4) provide landscaping within the parking area; and 5) landscaping in the southeastern corner of the property will be minimal (see Staff Study - Exhibit D). Landscape plans should indicate the general plant pallet including description of plants, rate of growth, container size, and typical planting and double staking detail. New landscape planter curbs shall have three- foot or greater radii. 6. All landscaping shall be irrigated by an automatic irrigation system. 7. Modify parking layout as generally depicted on Staff Study (Exhibit D). An alternate layout may be utilized provided raised landscaping and curbing is included to provide separation of parking and drive aisles, subject to Planning Director review and approval. 8. Landscape and irrigation plans shall be prepared and signed by a landscape architect or architect. Planting and maintenance specifications shall be prepared. Submit to the Planning Director for review and approval. 9. Comply with Standard Plant Material, Irrigation System, and Maintenance Agreement (attached). 10. Indicate on plans location of trash enclosure in compliance with Livermore Dublin Disposal Services standards. -2- Debris/Dust/Construction Activity 11. Measures shall be taken to contain all trash, construction debris, and materials on site until disposal off-site can be arranged. The Developer shall keep adjoining public streets free and clean of project dirt, mud, and materials during the construction period. The Developer shall be responsible for corrective measures at no expense to the City of Dublin. Areas undergoing grading, and all other construction activities, shall be watered, or other dust-palliative measures used, to prevent dust, as conditions warrant. Fire Protection 12. Prior to issuance of building permits, the Developer shall supply written confirmation that the requirements of the Dublin San Ramon Services District Fire Department have been, or will be, met. Lighting 13. Exterior lighting shall be of a design and placement so as not to cause glare onto adjoining properties. All subsequent exterior lighting shall conform with this condition. Architectural 14. Exterior colors and materials for the building addition shall be subject to final review and approval by the Planning Director and shall be consistent with those of the existing structure. All ducts, meters, air conditioning equipment and other mechanical equipment on the enlarged structures shall be effectively screened from view with materials architecturally compatible with the main structure. Miscellaneous 15. Development shall generally conform with the plans prepared by Engineering West, consisting of five sheets labeled Exhibit "A", dated received by the City Planning Department October 27, 1986, and the changes called for by these Conditions of Approval. 16. Landscaping shall not obstruct the sight distance of motorists. Except for tree trunks, the area between two feet and five feet above the ground should be clear for visibility purposes. 17. Handicapped ramps and parking shall be provided as required by State of California Title 24. 18. All customer parking spaces shall be double 4-inch striped approximately two feet apart between each space. Handicapped and compact car spaces shall be appropriately identified on pavement. 19. An encroachment permit shall be secured from.the City Engineer for any work done within the public right-of-way. 20. All signs are subject to Planning Department review and approval. 21. The Applicant shall repair on-site pavement; in particular, the pavement on the rear western drive aisle. 22. The Applicant shall replace all broken and missing wood slats on the existing eastern fence. 23. Approval for the Site Development Review shall be valid until November 13, 1987. If construction has not commenced by that time, this approval shall be null and void. -3- PASSED, APPROVED AND ADOPTED this 3rd day of November, 1986.
